AN ORDINANCE OF THE CITY OF NEWPORT BEACH
REZONING PROPERTY AND AMENDING DISTRICT MAPS
• NOS. 34 AND 35
The City Council of the City of Newport Beach does
ordain as follows:
SECTION 1. The following described real property in
the City of Newport Beach, County of Orange, State of California,
to wit:
That portion of Block 50 of Irvine's Subdivision; in
the City of Newport Beach, County of Orange, State of
California, as per map recorded in Book 1, page 88 of
Miscellaneous Maps, in the office of the County Recorder
of said county, described as follows:
BEGINNING at a point on a line parallel with and
distant northeasterly 50.00 feet, measured at right angles,
from the southwest line of said Block 50, said point being
distant South 49° 21' 45" East 1929.11 feet from the inter-
section of said parallel line with the centerline of Campus
Drive (formerly Acacia Street) said centerline being the
northwest line of said Block 50; thence along said parallel
line, South 490 21' 45" East 2175.77 feet to the south-
easterly line of the land described in a deed to Lockheed
Aircraft Corporation, recorded October 21, 1959, in Book
4936, page 267 of Official Records, in the office of the
County Recorder of said Orange County, California; thence
along said southeasterly line and parallel with the north-
westerly line of said Block 50, North 40° 39' 17" East
128.85 feet to the most westerly corner of the land
described in a deed to Lockheed Aircraft Corporation,
recorded November 25, 1969, in Book 9145, page 787, of
Official Records, in the office of the County Recorder of
said Orange County, California; thence along the boundary
of said land the following courses: South 490 21' 51" East
119.33 feet; thence North 400 39' 17" East 273.01 feet;
thence North 490 21' 51" West 119.33 feet to the most
northerly corner of said land, being also the most southerly
corner of the land described in a deed to The Irvine Company,
a West Virginia Corporation, recorded November 25, 1969, in
Book 9145, page 786, of Official Records in the office of
the County Recorder of said Orange County, California;
thence along the boundary of said land North 491 21' 51"
West 65.10 feet to the southeasterly right -of -way line
of Jamboree Road as described in a Grant of Easement to
the City of Newport Beach, recorded January 16, 1969, in
Book 8847, page 703 of Official Records in the office of
the County Recorder of said Orange County, California;
thence along said southeasterly right-of-way line the
following courses: North 41° 56' 48" East 529.20 feet;
thence North 870 56' 12" East 72.35 feet; thence North
400 39' 17" East 30.00 feet to the intersection of said

southeasterly right -of -way line of Jamboree Road with
the westerly right -of -way line of MacArthur Boulevard,
110.00 feet wide, as described in.P:arcel.l of a deed
to the State of California, recorded July 25, 1940, in
Book 1047, page 557 of Official Records in the office
of the County Recorder of said Orange County, California;
thence along said westerly line North 6° 59' 41" West
2029.39 feet to an angle point in said westerly line;
thence continuing along said westerly line North 60 59' 31"
West 2430.66 feet to the southeasterly right -of -way line
of Birch Street as shown on a map of Tract 5169, recorded
in Book 190, pages 11 through 13, inclusive, Miscellaneous
Maps, in the office of the County Recorder of said Orange
County, California; thence along said southeasterly right -
of -way line the following courses: South 830 00' 29" West
87.14 feet to the beginning of a tangent curve, concave
southeasterly and having a radius of 192.00 feet; thence
southwesterly 141.93 feet along said curve through a
central angle of 420 21' 12 "; thence tangent to said
curve, and continuing along said southeasterly right -of-
way line of Birch Street as shown on said map of Tract
5169, and as shown on the map of Tract 3201, recorded in
Book 130" pages 25 through 30, inclusive, Miscellaneous
Maps, in the office of the County Recorder of said Orange
County, California, South 40° 39' 17" West 3821.93 feet
to a line parallel with and distant northeasterly 50.00
feet, measured at right angles, from said southwest line
of Block 50; thence along said last mentioned parallel
line, South 49° 21' 45" East 1229.11 feet to the POINT
OF BEGINNING.
CONTAINING: 200.750 acres, more or less.
SUBJECT TO: All Covenants, Rights, Rights -of -Way, and
Easements of Record,
as shown on District Maps Nos. 34 and 35, referred to in Section
20.06.030 of the Newport Beach Municipal Code, and by such refer-
ence made a part of Title 20 of said Code, is hereby rezoned from
an Unclassified "U" District to a Planned Community "PC" District,
and said District Maps Nos. 34 and 35 are hereby amended to show
this zoning change. The Planned Community Development Standards
in connection with said Planned Community District are attached
hereto marked Exhibit "A" and made a part hereof by this reference.
SECTION 2. The Planning Director of the City of
Newport Beach is hereby instructed and directed to change District
Maps Nos. 34 and 35 so as to 'show the zoning changes described in
Section 1 hereof, and, as said District Maps shall have been so
amended, the same shall be in full force and effect and be a part

of Title 20 of the Newport Beach Municipal Code.
SECTION 3. This ordinance shall be published once in
the official newspaper of the City, and the same shall be
effective 30 days after the date of its adoption.
This ordinance was introduced at a regular meeting of
the City Council of the City of Newport Beach held on the 14th
day of December 1970, and was adopted on the 21st
day of December 1970, by the following vote, to wit:

GENERAL NOTES
1 . The Newport Project, a planned community development is a project
of Emkay Development Company, Inc., a subsidiary of Morrison -
Knudsen Company, Inc. The area is most appropriate for commercial
and light industrial use because of its central location, ideal topography,
availability to four freeways, accessibility to two railroads and its
relation to the Orange County Airport. Attached drawings indicate
land use, grading and roads, storm drains, water and sewer, topography
and traffic analysis.
2. Water within the Planned Community area will be furnished by the City
of Newport Beach.
3. Sewerage Disposal facilities within the Planned Community area are by
the City of Newport Beach.
4. Prior to or coincidental with the filing of any tentative map or use
permit, the developer shall submit a master plan of drainage to the
Director of Public Works.
5. The height of all buildings and structures shall comply with F.A.A.
criteria.
6. Except as otherwise stated in this ordinance, the requirements of the zoning
code, City of Newport Beach, shall apply.
The contents of this supplemental text notwithstanding, no construction
shall be proposed within the boundaries of this Planned Community District
except that which shall comply with all provisions of the Building Code
and the various mechanical and electrical codes related thereto.

DEFINITIONS
Advertising Surface:
The total area of the face of the structure, excluding supports.
Area of Elevation:
Total height and length of a building as projected to a vertical plane.
Building Line:
An imaginary line parallel to the street right -of -way line specifying the closest
point from this street right -of -way line that a building structure may be located
(except for overhangs, stairs and sunscreens).
Public Safety Area:
A strip of land twenty (20) feet in width and running parallel with street rights -
of -way.
Right -of -Way Line:
When reference is made to right -of -way line it shall mean the line which is then
established on either the adopted Master Plan of Streets and Highways or the
filed Tract Map for Minor Roads as the ultimate right -of -way line for roads or
streets.
Side and Front of Corner Lots:
For the purpose of this ordinance, the narrowest frontage of a lot facing the street
is the front, and the longest frontage facing the intersecting street is the side,
irrespective of the direction in which structures face.
Sign:
Any structure, device or contrivance, electric or non - electric and all parts
thereof which are erected or used for advertising purposes upon or within which
any poster, bill, bulletin, printing, lettering, painting, device or other advertising

of any kind whatsoever is used, placed, posted, tacked, nailed, pasted or
otherwise fastened or affixed.
Site Area-
The total land area of the land described in the use or other permit.
Special Landscaped Street:
Special landscaped streets are designated as MacArthur Boulevard, Jamboree
Road, Palisades North and Birch Street. The landscaping requirements for
special landscaped streets and for the remaining streets are described in the
following text.
Streets - Dedicated and Private:
Reference to all streets or rights -of -way within this ordinance shall mean
dedicated vehicular rights -of -way. In the case of private or non- dedicated
streets, a minimum setback from the right -of -way line of said streets of ten (10)
feet shall be required for all structures. Except for sidewalks or access drives,
this area shall be landscaped according to the setback area standards from
dedicated streets contained herein.

A.' Building Height of structure shall be limited to a height

1. Setbacks
All setbacks shall be measured from the property line.
For the purpose of this ordinance, a street side property
"line is that line created by the ultimate right -of -way
line of the frontage street.
Front Yard Setback
Thirty (30) feet minimum, except that unsupported roofs
or sun - screens may project six (6) feet into the setback area.
Side Yard Setback
Ten (10) feet, except that unsupported roofs and sun - screens
may project three (3) feet into the setback area.
In the ease of a corner lot, the street side setback shall be
thirty (30) feet, except that unsupported roofs and sun-
screens may project six (6) feet into the setback area.
Interior lot lines for a corner lot shall be considered side
lot lines.
Rear Yard Setback

One (1) construction sign denoting the architects, engineers,
contractor, and other related subjects, shall be permitted
upon the commencement of construction. Said sign shall
conform with the requirements of Item 3 above, Ground Sign,
and will be permitted until such time as a final inspection
of the building (s) designates said structure (s) fit for
occupancy, or the tenant is occupying said building (s),
whichever occurs first.
7. Future Tenant Identification Sign
A sign listing the name of future tenants, responsible agent
or realtor, and identification of the industrial complex
shall be permitted. Said sign shall conform with the require -
ments of Item 3 above, Ground Sign, and will be permitted
until such time as a final inspection of the building (s)
designates said structure (s) fit for occupancy or tenant is
occupying said building (s), whichever occurs first.

Permanent directional and identification signs, not exceeding

permitted but subject to use permit.
