AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING CHAPTER 15.08 OF THE NEWPORT BEACH
MUNICIPAL CODE TO ADOPT THE UNIFORM PLUMBING
CODE, 1970 EDITION
The City Council of the City of Newport Beach DOES
ORDAIN as follows:
SECTION 1. Chapter 15.08 of the Newport Beach Municipal
Code is amended to read:

15.08.020 Amendment to Section 1.1 of
Section 1.1 of the Plumbing Code, hereinbefor
15.08.010, is amended to read:
'Sec. 1.1 Administrative Authority. Whenever the
term "administrative authority" is used in this Code it
shall be construed to mean the Building Official of the
City of Newport Beach or his authorized representative.'
15.08.030 Amendment to Section 1.2 of the Plumbing Code.
Section 1.2 of the Plumbing Code, hereinbefore adopted in Sectic
15.08.010, is amended to read:
'Sec. 1.2 Assistants. Whenever the term assistants
is used in this Code it shall be construed to mean the
duly authorized inspectors of the Community Development
Department.'
15.08.040 Deletion of _Section 1.3 of the Plumbing Code.
Section 1.3 is hereby deleted from the Plumbing Code, herein -
before adopted in Section 15.08.010.
15.08.050 Amendment to Section 1.4 of the Plumbing Code
Section 1.4 of the Plumbing Code, hereinbefore adopted in Secti
15.08.010, is amended to read:
'Sec. 1.4 Duties of the Administrative Authority.
The Administrative Authority shall maintain public office
hours necessary to efficiently administer the provisions
of this Code and amendments thereto and shall perform the
following duties:
(1) Require submission of, examine and check plans
and specifications, drawings, descriptions, and /or dia-
grams necessary to show clearly the character, kind and
extent of plumbing work covered by applications for a
permit and upon approval thereof shall issue the permit
applied for.
(2) Collect all fees for permits issued as pro-
vided in this Code, issue receipts therefor in duplicate,

15.08.010 AdoAtion of Uniform Plumbing Code. Subject
to the particular additions, deletions and amendments herein-
after set forth in this Chapter,, the rules, regulations, pro-
visions and conditions set forth in that certain Code entitled
'Uniform Plumbing Code, 1970 Edition,' which Code is promul-
gated and published by the International Association of Plumbing
and Mechanical Officials, including Chapters 1 through 13 and
Appendices A, B, C, F and G, three full printed copies of which,
printed as a Code in book form, were by the City Council ordered
filed and which have been actually filed in the office of the
City Clerk and which, as so on file are hereby referred to,
adopted and made a part hereof as fully and for all intents
and purposes as though set forth herein at length, shall be
and the same are hereby established and adopted as the rules,
regulations, provisions and conditions to be observed and fol-
lowed in the installation, alteration or repair of plumbing
and drainage systems and the inspection thereof; and subject
to said additions, deletions and amendments hereinafter set
forth, said Code is hereby established and adopted and the same
shall be designated, known and referred to as the 'Plumbing
Code' of and for the City of Newport Beach.

15.08.020 Amendment to Section 1.1 of
Section 1.1 of the Plumbing Code, hereinbefor
15.08.010, is amended to read:
'Sec. 1.1 Administrative Authority. Whenever the

15.08.040 Deletion of _Section 1.3 of the Plumbing Code.

15.08.050 Amendment to Section 1.4 of the Plumbing Code
Section 1.4 of the Plumbing Code, hereinbefore adopted in Secti
15.08.010, is amended to read:
'Sec. 1.4 Duties of the Administrative Authority.

this Code or amendments thereto, approving or condemning
said work in whole or in part as conditions require.
(4) Issue upon request a certificate of approval
for any work approved by him.
(5) Condemn and reject all work done or being done
or materials used or being used which do not in all res-
pects comply with the provisions of this Code and amend-
ments thereto.
(6) Order changes in workmanship and /or materials
essential to obtain compliance with all provisions of
this Code.
(7) Investigate any construction or work regulated
by this Code and issue such notices and orders as pro-
vided in Section 1.6.
(8) Keep a complete record of all the essential
transactions of his office.
(9) Transfer all fees collected by him to the
proper authority provided by law to receive such funds.'
• 15.08.060 Amendment to Section 1.5 of the Plumbing Code.
Section 1.5 of the Plumbing Code, hereinbefore adopted in Section
15.08.010, is amended to read:
'Sec. 1.5 Right of Entry.
(1) The Administrative Authority, or his duly authori-
zed representative, shall have the authority to enter any
building or premises for the purpose of investigating the
existence of suspected or reported damage or defects which
constitute an immediate danger to human life or an im-
mediate hazard to public safety or health.
(2) Except in emergency situations as defined in
Section 1.5(1) of this Code, the Administrative Authority,
or his authorized representative, shall not enter any
building or premises without the consent of the owner or
occupant thereof, unless he possesses a valid search war-
rant authorizing entry and search of the premises.
(3) No person shall hinder or prevent the Adminis-
trative Authority or his authorized representative, in
the performance of the duties hereinbefore described as
emergency situations or while in possession of a valid
search warrant, from entering upon and into any and all
premises under his jurisdiction, at all reasonable hours,
for the purpose of inspecting the same to determine
whether or not the provisions of this Code and all other
applicable laws or ordinances pertaining to the protec-
tion of persons or property, are observed therein.'

15.08.070 Amendment to Section 1.7 of the Plumbing Cod
Section 1.7 of the Plumbing Code, hereinbefore adopted in Sect
15.08.010, is amended to read:
i- 'Sec. 1.7 Violations and Penalties. Any person,
firm or corporation violating any of the provisions of
this Code shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be punishable by a fine
not to exceed Five Hundred Dollars ($500) or by imprison-
ment in the County Jail for a period not to exceed six
(6) months, or by both such fine and imprisonment.
Each separate day or any portion thereof during which
any violation of this Code occurs or continues shall
be deemed to constitute,a_ separate offense, and upon
conviction thereof shall be punishable as herein pro-
vided.
The issuance or granting,of a permit or approval
of plans and specifications shall not be deemed or
construed to be a permit for, or an approval of, any
violation of any of the provisions of this Code. No
permit presuming to give authority to violate or can-
cel the provisions of this Code shall be valid, except
insofar as the work or use which it authorizes is lawful.
The issuance or granting of a permit or approval of
plans shall not prevent the Administrative Authority
from thereafter requiring the correction of errors in
plans and specifications or from preventing construction
operations being carried on thereunder when in violation
of this Code or of any other ordinance or from revoking
any Certificate of Approval when issued in error.
Every permit issued by the Administrative Authority
under the provisions of this Code shall expire by limita-
tion and become null and void if the work authorized by
such permit is not commenced within sixty (60) days from
the date of issuance of such permit, or if the work auth-
orized by such permit is suspended or abandoned at any
time after the work is commenced for a period of sixty
(60) days. Before such work may be recommended a new
permit shall be first obtained to do so.'
15.08.080 Amendment to Section 1.10 of the Plumbing Code.
Section 1.10 of the Plumbing Code, hereinbefore adopted in Section
15.08.010, is amended to read:
'Sec. 1.10 Issuance of Permits.
(a) No permit shall be issued to any person to do or
cause to be done any construction or work regulated by
this Code unless such person is a duly registered or
licensed contractor as required by this Code except, when
and as otherwise provided herein.
(b) Any permit required by this Code may be issued
to a person to do any plumbing or drainage work regulated
by this Code in a single family dwelling used exclusively
• for living purposes, including common accessory and minor
poultry or agricultural buildings in the event that such
person is the bona fide owner of such dwelling and acces-
sory buildings and that the same are occupied and used

exclusively by said owner, provided that said owner shall
personally perform all labor in connection therewith.
(c) A permit may be issued to any responsible person
not acting in violation of Chapter 9, Division 3, of the
Business and Professions Code of the State of California
for the installation, alteration, or repair of water piping,
water treatment equipment, and for private sewage disposal
systems and house sewers connecting thereto. Permits may
be issued for the installation, alteration, or repair of
house sewers connecting with the public sewers to owners
as described in Subsection (b) of this Section or to other
persons properly registered or licensed as required by
this Code.'
15.08.090 Amendment to Section 1.12 of the Plumbing Code.
Section 1.12 of the Plumbing Code, hereinbefore adopted in Sectic
15.08.010, is amended to read:
'Sec. 1.12 Permit Fees.
(a) GENERAL. Any person applying for a permit shall,
at the time the application is made, pay to the Administra-
tive Authority the fees set forth in this section. Except
as provided herein a plumbing permit and a sewer or private
sewage disposal permit shall be required for each building
or installation.
Exception: Where accessory buildings and /or
appurtenances, such as laundry rooms,
guest houses, bath houses or swimming
• pools, are used in conjunction with a
single family residence, are located
on the same lot and under the same
ownership, and are erected at the
same time as the main building, all
plumbing items may be combined on
one plumbing permit. All buildings
and appurtenances regardless of type,
located on the same lot and under the
same ownership may, when being con-
nected at the same time to a common
house sewer or to a common or multiple
private sewage disposal system, be
combined on one sewerage permit.
Plumbing permit fees shall be as specified in Table
No. I. Sewer and private sewage disposal permit fees shall
be as specified in Table No. II. For the purpose of this
Section a sanitary plumbing outlet on which or to which a
plumbing fixture or applicance may be set or attached shall
be construed to be a fixture. Built -in dishwashers shall
be construed fixtures whether individually trapped or not.
Fees for reconnection and retest of existing plumbing sys-
tems in relocated buildings shall be based on the number
of plumbing fixtures, gas systems, water heaters, etc.
involved. When interceptor traps or house trailer site
traps are installed at the same time as a house sewer on
. any lot no sewer permit shall be required for the con-
nection of any such trap to an appropriate inlet fitting
provided in the house sewer by the permittee constructing
such sewer.

When a permit has been obtained to connect an existing
building or existing work to the public sewer, or to con-
nect to a new private disposal facility, backfilling of
private sewage disposal facilities abandoned consequent to
such connection is included in the house sewer permit.

supply 4" or larger.
3) Building or premises with fuel gas piping
4" or larger or containing medium or high
pressure fuel gas.
(c) Special, Whenever any1work for which a permit
is required under the - provisions of this Code has been com-
menced, constructed or completed without the authorization
of such permit, a special investigation may be required
before a permit will be issued for such work in order to
determine whether the work done complied with Code require-
ments. In addition to the regular permit fee, an investi-
gation fee shall be collected as follows:

(b) Plan Check. Plans and specifications shall be
submitted and approved prior to the commencement of any work
described in this section.
A plan checking fee shall be paid to the Building Of-
ficial at the time of submitting the plans and specifica-
tions for work described in this section.
Said fee shall be equal to one -half (1/2) the required
plumbing permit fee as set forth in Table I of this Chapter.
All plan checking fees shall be based on the aggregate
quantities required for the complete project:
1) Building or premises containing over 180
drainage fixture units.
2) Building or premises with a potable water
supply 4" or larger.
3) Building or premises with fuel gas piping
4" or larger or containing medium or high
pressure fuel gas.
(c) Special, Whenever any1work for which a permit
is required under the - provisions of this Code has been com-
menced, constructed or completed without the authorization
of such permit, a special investigation may be required
before a permit will be issued for such work in order to
determine whether the work done complied with Code require-
ments. In addition to the regular permit fee, an investi-
gation fee shall be collected as follows:

The payment of the investigation fee shall not exempt
(d) Conversion Inspection Fee. A fee as set forth
below shall be paid when a conversion inspection is required
by the Administrative Authority.

NOTE: Above fees do not include the fees for the
building permit, nor fees for electrical,
plumbing, or heating and ventilating permits
covering the alterations and /or repairs of
the conversion.
• (e) Investigation Fee.' A fee of Fifteen Dollars ($15.00)
may be charged by the Administrative Authority for any inves-
tigation of a building, structure, work reports, certifica-
tion or any other related work, requested by an owner or
authorized agent of such-owner.
The provisions of this Section shall not apply to
emergency work when it shall be proved to the satisfaction
of the Administrative Authority that such work'was urgently
required and that it was not practical to obtain a permit
therefor before commencement of the work. In all such
cases a permit must be obtained as soon as it is practical
to do so, and if there is an unreasonable delay in obtain-
ing such permit, an investigation fee as herein provided
shall be charged.
(f) Reinspection Fee. Five Dollars ($5.00) per
inspection-may be charged for additional inspections neces-
sary as a result of faulty workmanship or material or both;
or for any inspection requested before the work to be in-
spected has been completed and made ready for inspection.
Notice of completion of the work or of correcting faulty
workmanship or material shall be given the Administrative
Authority and reinspection requested.'
15.08.100 Addition of Section 1.15 to the Plumbing Code.
Section 1.15 is added to the Plumbing Code, hereinbefore adopted
in Section 15.08.010, to read:
'Sec. 1.15 Surrender of Permit. If no portion of the
work or construction covered by a permit issued by the Chief
Plumbing Inspector under the provisions of this Code has
any person from compliance with the provisions of this
Code nor from any penalty prescribed by law.
The permit fee herein specified shall be doubled when
work requiring a permit has been started or carried on
prior to obtaining said permit and the applicant had know-
ledge that a permit was necessary as evidenced by the fact
that at the time of doing such work he held a license as
required by Section 1.10 of this Code, or had previously
applied for a permit as provided in this Code, but payment
of such double fee, provided the permit is subsequently
used, shall not relieve any persons from fully complying
with the requirements of this Code in the execution of the
work nor from any other penalties prescribed herein.
(d) Conversion Inspection Fee. A fee as set forth
below shall be paid when a conversion inspection is required
by the Administrative Authority.

15.08.100 Addition of Section 1.15 to the Plumbing Code.
Section 1.15 is added to the Plumbing Code, hereinbefore adopted
in Section 15.08.010, to read:
'Sec. 1.15 Surrender of Permit. If no portion of the
work or construction covered by a permit issued by the Chief
Plumbing Inspector under the provisions of this Code has
been commenced the person to whom such permit has been
issued may deliver such permit to the.Chief Plumbing
Inspector with the request that such permit be cancelled.
The Chief Plumbing Inspector shall thereupon stamp or
write on the face of such permit the words "Cancelled
at the request of the permittee." Thereupon such permit
shall be void and of no effect.'
15.08.110 Addition of Section 1.16 to the Plumbing Code.
Section 1.16 is added to the Plumbing Code, hereinbefore adopted
in Section 15.08.010, to read:
'Sec. 1.16 Suspension or Revocation of Permit. The
Chief Plumbing Inspector may suspend or revoke any permit
issued under the provisions of this Code whenever such per-
mit is issued in error, or is issued on the basis of in-
correct information supplied, or has been obtained by
falsification or misrepresentation, or when work is being
done thereunder in violation of this or any other related
ordinance or regulation..'
15.08.120 Addition of Section 1.17 to the Plumbing Code.
Section 1.17 is added to the Plumbing Code, hereinbefore a opted
in Section 15.08.010, to read:_
'Sec. 1.17 Refund,. In the event that any person
shall have obtained a.permit and no portion of the work
or construction covered by such permit shall have been
commenced and such permit shall have been cancelled with-
out any work having been done, the permittee upon presenta-
tion to the Chief Plumbing Inspector of a request therefor
in writing, shall be entitled to a refund in an amount equal
to 80 percent of the fee actually paid for such permit.
The Chief Plumbing Inspector will satisfy himself as
to the right of such applicant to such refund and each such
refund shall be paid as provided by law for the payment of
claims against the City. No refund shall be made when a
permit has been obtained by falsification or misrepresenta-
tion and has been revoked for such cause.'
15.08.130 Addition of Section 1.18 to. the Plumbing Code.
Section 1.18 is added to the Plumbing Code, hereinbefore adopted
in Section 15.08.010, to read:
'Sec. 1.18 Transfer. Permits are not transferable
from one person to another or from one location to another.'
15.08.140 Addition of Section 1.19 to the Plumbing Code.
Section 1.19 is added to the Plumbing Code, hereinbefore adopted
in Section 15.08.010, to read:
'Sec. 1.19 Exemption from Fee. The requirements for
fees contained in this Chapter shall not apply when the col-
lection of such fees is legally prohibited by other statutes.'
15.08.150 Amendment to Part Two of the Plumbing Code.
Part Two of the Plumbing Code, hereinbefore adopted in Section
. 15.08.010, is amended to read:
'Sec. 2.1 General Provisions. For the purpose of
this Code, all persons engaged in the business of plumbing
contractor or laboring at the trade of plumbing within the
City of Newport Beach shall be classified as set forth in
this part.
Sec. 2.2 Plumbers. Plumbers shall be those persons
who labor at the trade of plumbing in return for wages or
salary but who do not furnish any materials or supplies
in the execution or performance of any plumbing work. All
plumbers shall be classified in one of the following cate-
gories:
(a) Plumber Journeyman: A person who labors at the

contractor and under the direction of said con-
tractor or master plumber.
(b) Plumber Apprentice: A person who labors at the
trade of plumbing as an employee under the direct
supervision and in the immediate presence of a
plumbing contractor or journeyman plumber.
(c) Plumber, Maintenance: A person who is regularly
employed to install, alter, maintain or repair
plumbing, gas piping or sewage disposal systems
in or on buildings or premises owned or occupied
by his employer.'
15.08.160 Amendment to Section 506(b) of the Plumbi
Code. Section 506(b) of the Plumbing Code, hereinbefore a
in Section 15.08.010, is amended to read:
Sec..,506 Vent Termination
N.
'(b) Each vent shall terminate not less than ten (10)
feet from or at least three (3) feet above any window, door
opening, air intake or vent shaft, nor less than ten (10) feet
in any direction from_the nearest point on any adjacent lot
openable windows are permitted in a building thereon.
(Example: Seven feet (7') from lot line in residential,
and five feet (51) from lot line in commercial.)'
15.08.170 Amendment to Section 1001 of the Plumbing Code.
Section 1001 of the Plumbing Code, hereinbefore adopted in Sectio
15.08.010, is amended to read:
'Sec. 1001 Running Water Required. Except where not
deemed necessary for safety or sanitation by the Administra-
tive Authority, each plumbing fixture shall be provided with
an adequate supply of potable running water piped thereto
in an approved manner, so arranged as to flush and keep it
in a clean and sanitary condition without danger of back -
flow or cross - connection. Water closets shall be flushed
by means of an approved tank or flushometer valve. Such
tanks or valves shall have a sufficient water flushing
capacity that no hazard, nuisance or unsanitary condition
is evidenced.'
15.08.180 Amendment to Section 1008(c
Code. Section 1008(c) of the Plumbing Code,
in Section 15.08.010, is amended to read:

Sec. 1008 Installation Inspection and Testing.
'(c) Water piping installed within a building and in
or under a concrete floor slab resting on the ground shall
be installed in accordance with the following requirements:
(1) Non - metallic and ferrous piping shall be pro-
hibited; except that ferrous piping four inches
(4 ") and larger may be used when protected
against corrosion and installed in channels,
tubes or in similar protective manner when ap-
proved by the Administrative Authority. Cast
iron pressure water piping excepted.
(2) Copper tubing shall be installed without joints
where possible. Where joints are permitted,
they shall be brazed and fittings shall be
wrought copper.'
15.08.190 Amendment to Section 1C
Code. Section 1009(h) of the Plumbing C
in Section 15.08.010, is amended to read:

Sec. 1009 Size of Potable Water Piping.
'(h) No building supply line shall be less than three -
quarters inch (3/4 ") in diameter and not less than one inch
(1 ") diameter for each single family residential structure.
Each main building shall have a minimum of two (2) three -
quarter inch (3/4 ") hose bibbs located one readily to the
front yard and one readily accessible to the rear yard.'
15.08.200 Amendment to T

SECTION 2. This ordinance shall be published once in the
official newspaper of the City, and the same shall be effective 30
days after the date of its adoption.
This ordinance was introduced at a regular meeting of the
City Council of the City of Newport Beach held on the 10th day of
