ORDINANCE NO. 1620
AN ORDINANCE OF THE CITY OF NEWPORT BEACH
• AMENDING SECTIONS 5.10.030, 5.12.320, 5.14.180,
5.15.110, 5.24.050, 5.28.030, 5.32.040, 5.41.040
AND 5.50.040 OF THE NEWPORT BEACH MUNICIPAL CODE
TO INCREASE THE AMOUNTS OF INVESTIGATION AND
PERMIT FEES REQUIRED IN CONNECTION WITH BUSINESS
LICENSE APPLICATIONS
The City Council of the City of Newport Beach does
ordain as follows:
SECTION 1. Section 5.10.030 of the Newport Beach
Municipal Code is amended to read:
"5.10.030 Application for Permit. Application
for a special event permit shall be filed at least fourteen
(14) days prior to the date of the proposed event with the
City Manager, on forms supplied by the City, together with
an application processing charge in the amount of Twenty-
Five Dollars ($25.00) for all applications where a special
• event permit fee is also required, and in the amount of
Twenty Two Dollars and Fifty Cents ($22.50) for all applica-
tions where no special event permit fee is required.
The City Manager may, in his discretion, waive the
requirement that applications be filed fourteen (14) days
prior to the date on which the activity is to be conducted."
SECTION 2. Section 5.12.320 of the Newport Beach
Municipal Code is amended to read:
"5.12.320 Driver's Permit. A. APPLICATION. No
person shall drive or operate any vehicle described in
this Chapter in the City without first obtaining a permit
in writing so to do from the Chief of Police. Any person
• desiring to obtain such driver's permit shall make a written
application therefor to the Chief of Police accompanied by
a fee of Fifteen Dollars ($15.00). No permit shall be
issued to any person under the age of eighteen (18) years,
to any person not a citizen of the -United States unless such
person has lawfully declared his intention of becoming
such, or to any person who is incompetent or for any
• reason whatsoever unable to safely handle such vehicle.
No permit shall be issued to any person who has been
convicted of a felony, or within the period of two years
immediately preceding such application has been convicted
of reckless driving or driving a vehicle upon a highway
while under the influence of intoxicating liquors or drugs,
or who has been convicted of violating any provisions of
the Alcoholic Beverage Control Act of the State of California,
unless such person shows to the satisfaction of the Chief of
Police that issuing a driver's permit to him would not in
any way be contrary to the public interest, welfare or
safety. Each such applicant shall demonstrate his skill and
ability to safely handle his vehicle in driving it through
the crowded sections of the City accompanied by an inspector
designated by the Chief of Police. No driver's permit
shall be granted to any person who is not of a good moral
character or who cannot speak the English language or who
does not hold a chauffeur's license issued by the Motor Vehicle
Department of the State, or who is not sufficiently acquainted
with the laws or ordinances regulating the operation of motor
vehicles. Any falsification on the application for said
permit will be grounds for refusal of the permit.
B. PERSONAL APPEARANCE. Before a permit is granted to
any applicant, the applicant shall present himself to the
Police Department, be photographed or furnish an acceptable
photograph, and be fingerprinted, and such photographs and
fingerprints shall be filed with the permanent records of the
Police Department.
C. TEMPORARY PERMIT. Pending the completion of the
investigation of an applicant, the Chief of Police may grant
a temporary permit to a person who has made application for

D. INDENTIFICATION CARD. Upon obtaining the regular
permit, the driver or operator shall at all times keep posted
in full view in the vehicle operated by him an identification
card furnished by the Chief of Police, which shall have plainly
printed thereon the name of the drive or operator, his business
address and telephone number, his permit number and his
photograph.
E. TERM -- RENEWAL. All driver's permits shall expire
at the end of the calendar year for which issued. Applica-
tions for renewal shall be made on or before December first of
each year for the following calendar year. If so made within
the period prescribed, the charge for renewal shall be Two
Dollars ($2.00). The permits are personal and nontransferable.
F. REVOCATION. The Chief of Police may revoke or
suspend any such driver's permits so issued for any violation
of the provisions of this Chapter by the holder of such permit
or for the existence of any state of facts which would have
been a good reason for denying such permit when applied for,
whether such state of facts existed at the time application was
made for such permit or came into existence thereafter.
G. APPEAL. In the event of a refusal, revocation or
suspension of any driver's permit by the Chief of Police, the
applicant or permittee may appeal from the decision to the
City Council, which may in its discretion affirm, reverse or modii
the decision made by the Chief of Police."
SECTION 3. Section 5.14.180 of the Newport Beach
Municipal Code is amended to read:

"5.14.180 Application for Driver's and Attendant's
Permit. An applicant for an ambulance driver's or ambulance
attendant's permit shall file his application with the Finance
• Director on forms furnished by the City, together with an
application fee of Sixteen Dollars and Seventy -Five Cents
($16.75). Each applicant shall submit with his application
three (3) recent photographs of himself of a size designated
by the Finance Director. To be eligible for either type of
permit, an applicant must be at least 21 years of age."
SECTION 4. Section 5.15.110 of the Newport Beach
Municipal Code is amended to read:
"5.15.110 Attendant or Operator's Permit Required.
(a) Application: No person shall drive or operate any
official police towing vehicle described in this Chapter in
the City without first obtaining a permit in writing to do
so, from the Chief of Police. Any person desiring to obtain
such operator's permit shall make a written application
• therefor to the Chief of Police;.accompanied by,the fee of
Nineteen Dollars and Fifty Cents ($19.50). Applicant for
attendant or operator's permit shall be required to be
photographed and fingerprinted. No attendant or operator's
permit shall be issued to any person:
1. Under the age of 18 years.
2. Who is not a citizen of the United States or who
has not lawfully declared intention of becoming such.
3. Who has been convicted of a felony.
4. Who, within a period of two years immediately pre-
ceding such application, has been convinced of reckless
driving or any provisions of the Alcoholic Beverage Control
Act, California Penal Code, California Vehicle Code, or any
other code, which is directly concerned with the operation
• of a motor vehicle while under the influence of alcoholic

beverage, or drug, or combination of alcohol and
drug.
5. Who is incompetent or for any reason whatosever
• unable to handle such vehicle safely.
6.
Who
is not
of good moral character.
7.
Who
cannot
speak the English language.
8. Who does not hold a vehicle driver's license issued
by the Motor Vehicle Department of the State of California.
9. Who is not sufficiently acquanited with the laws
or ordinances regulating the operation of,motor vehicles.
10. Who falsifies the application for said permit."
SECTION 5. Section 5.24.050 of the Newport Beach
Municipal Code is amended to read:
"5.24.050 Applications for Permits -- Fees. A.
PRIVATE PATROL SERVICE. Applications for permits for private
patrol services shall be filed with the License Division of
• the Finance Department on forms supplied by the City, together
with an investigation fee of One Hundred Dollars ($100.00).
The application shall be signed and verified by the applicant
and shall state the name, address and organization of the
patrol service, its method of operation, the territory or
locations it proposes to serve, and the names, addresses and
physical description of its officers and employees, and such
other identification and information as may be deemed necessary
by the Chief of Police, including, but not limited to, finger-
prints and recent photographs of the applicant and his
employees.
B. PRIVATE PATROLMAN. Any person to be employed as
a private patrolman shall file a verified application with
the License Division of the Finance Department on forms supplied
• by the City, setting forth such information as may be required
by the Chief of Police, together with an investigation fee
of Twenty Eight Dollars ($28.00)."

SECTION 6. Section 5.28.030 of the Newport Beach
Municipal Code is amended to read:
"5.28.030 Application for Permit. Applications for
entertainment permits shall be filed with the City Manager
on forms supplied by the City, together with a fee of
Thirty Three Dollars and Fifty Cents ($33.50) to cover.the
costs of processing and investigation. The application shall
be signed and verified by the applicant and shall contain
such information as may be deemed necessary. The City Manager
may require that the applicant be fingerprinted."
SECTION 7. Section 5.32.040 of the Newport Beach
Municipal Code is amended to read:
"5.32.040. Application for Permit. Applications
for cafe dance permits shall be filed with the City Manager
on forms supplied by the City, together with an application
fee of Thirty Three Dollars and Fifty Cents ($33.50). The
application shall be signed and verified by the applicant and
shall contain such information as may be deemed necessary
by the City Manager. The City Manager may require that the
applicant be fingerprinted."
SECTION 8. Section 5.41.040 of the Newport Beach
Municipal Code is amended to read:
"5.41.040 Permit Fee. At the time of filing an
application for a permit, a fee of Sixteen Dollars and Seventy
Five Cents ($16.75) shall be paid to partially cover the cost
of investigating and processing the application and issuing
the permit."
SECTION 9. Section 5.50.040 of the Newport Beach
Municipal Code is amended to read:
"5.50.040 Application; Fee. (a) Any person
desiring to obtain a permit to operate a massage establishment

or to perform massage services shall make application
to the Director of Finance who shall refer all such
applications to the Chief of Police for an investigation.
• An application to obtain a permit to operate a massage
establishment shall be accompanied by an investigation fee
of One Hundred Dollars ($100.00).
(b) Each application for a permit to permit an
individual to perform massage services shall be accompanied
by an investigation fee of Twenty Eight Dollars ($28.00).
(c) Permits and fees required by this Chapter shall
be in addition to any license, permit or fee required under
any other chapter of this Code."
SECTION 10. This ordinance shall be published once
in the official newspaper of the City, and the same shall be
effective thirty (30) days after the date of its adoption.
This ordinance was introduced at a regular meeting of
•the City Council of the City of Newport Beach held on the 97th
day of May , 1975, and was adopted on the 9th
day of June 1975, by the following vote, to wit:
