AN ORDINANCE OF THE CITY OF NEWPORT BEACH
• AMENDING CHAPTER 15.06 OF THE NEWPORT BEACH
MUNICIPAL CODE TO ADOPT THE UNIFORM HOUSING
CODE, 1973 EDITION
The City Council of the City of Newport Beach
DOES ORDAIN as follows:
SECTION 1. Chapter 15.06 of the Newport Beach Municipal
Code is amended to read as follows:
"Section 15.06.010. Adoption of Uniform Housing Code.
Subject to the particular additions, deletions and amend-
ments hereinafter set forth in this Chapter, the rules,
regulations, provisions and conditions set forth in that
certain Code, entitled "Uniform Housing Code, 1973 Edition,"
which Code is promulgated and published by the International
Conference of Building Officials, three (3) full printed
• copies of which, printed as a Code in book form, were by
the City Council ordered filed and which have been actually
filed in the office of the City Clerk and which, as so on
file are hereby referred to, adopted and made a part hereof
as fully and for all intents and purposes as though set
forth herein at length, shall be and the same are hereby
established and adopted as the rules, regulations, provisions
and conditions to be observed and followed in the erection,
construction, enlargement, alteration, repair, maintenance,
moving, improving, remodeling, conversion, demolition and
occupancy of all buildings or portions thereof used, designed
or intended to be used for human habitation within the City;
and subject to said additions, deletions and amendments
hereinafter set forth, said Code is hereby established and
• adopted and the same shall be designated, known, and referred
to as the "Housing Code" of and for the City of Newport
Beach.
Section 15.06.020. Addition of Section 104 to the
Housing Code. Section 104 is added to the Housing Code,

hereinbefore adopted in Section 15.06.020 to read:
"Section 104. Application. All references to the
"Mayor and Council" contained within the Housing Code
shall mean the Mayor and City Council of the City of
Newport Beach. All references to the 'City' shall mean
the incorporated area of the City of Newport Beach.
The provisions of the Housing Code of the City of
Newport Beach shall apply to and affect all-of the
incorporated territory of Newport Beach, except work located
primarily in a public way, public utility towers and poles,
mechanical equipment not specifically regulated in this
Code, hydraulic floor control structures, facilities for
the production, generation, storage or transmission of
water or electrical energy by a local agency, and the
buildings and structures of administration and instruction
of public schools."
Section 15.06.030. Amendment to Section 202 of the
Housing Code.. Section 202 of the Housing Code hereinbefore
adopted in Section 15.06.010 is amended to read:
"Section 202. All buildings or portions thereof which
are determined to be substandard as defined in Chapter 15.28
of the Newport Beach Municipal Code are hereby declared to
be public nuisances and shall be abated by repair, rehabilita-
tion, demolition, or removal in accordance with the procedure
specified in that chapter."
Section 15.06.040. Amendment to Section 203 of the
Housing Code. Section 203 of the Housing Code hereinbefore
adopted in Section 15.06.010 is amended to read:
"Section 203. In order to provide for final interpreta-
tion of the provisions of this Code and to hear appeals provided
for herein, there is established a Housing Advisory and
Appeals Board which shall be the City Council of the City of
Newport Beach. Appeals to the Board shall be processed in

accordance with the provisions of Chapter 15.28 of
the Newport Beach Municipal Code."
Section 15.06.050. Amendment to Section 204 of the
isHousing Code. Section 204 of the Housing Code, hereinbefore
adopted in Section 15.06.010, is amended to read:
"Section 204. Penalty for Violations. Any person,
firm, corporation, partnership or co- partnership who
wilfully violates any of the provisions or fails to comply
with any of the mandatory requirements of this Chapter is
guilty of a misdemeanor, and upon conviction thereof, shall
be punishable by a fine not to exceed Five Hundred Dollars
($500.00) or by imprisonment in the County Jail, not to
exceed six (6) months or by both such fine and imprisonment.
Nothing contained herein shall be deemed to bar any legal,
equitable, or summary remedy to which the City of Newport
Beach or other political subdivision, or any person, firm,
corporation, partnership or co- partnership may otherwise
be entitled."
Section 15.06.060. Amendment to Section 401 of the
Housing Code. Section 401 of the Housing Code, hereinbefore
adopted in Section 15.06.010 is amended to change the
definitions of the following terms only:
All words, phrases or terms not hereinafter defined by
amendment, shall have the same meaning as set forth in
Section 401.
"Section 401
FAMILY. The term "family" shall mean (1) an individual
or two or more persons related by blood, marriage or
adoption; or (2) a group of not more than four persons who
are not related by blood, marriage or adoption; (3) a
combined group of related and unrelated persons where the
• total number of related and unrelated persons does not
exceed four, living together as a single housekeeping unit
in a dwelling unit.

UNIFORM BUILDING CODE. Uniform Building Code shall
mean the Building Code of the City of Newport Beach as
contained in Chapter 15.04 of Title 15 of the Newport Beach
Municipal Code, including all deletions, modifications
and amendments made thereto."
Section 15.06.070. Amendment to Section 501 (b) of the
Housing Code. Section 501 (b) of the Housing Code, herein-
before adopted in Section 15.06.010, is amended to read:
"Section 501. (b) Occupancy Space. Occupancy space of
a lot shall be regulated by the Zoning Code, Title 20 of
the Newport Beach Municipal Code."
Section 15.06.080. Amendment to Section 502 (b) of
the Housing Code. Section 502 (b) of the Housing Code,
hereinbefore adopted in Section 15.06.010 is amended to
read:
"Section 502 (b) Yards. Yards of a residential lot
shall be as regulated by the Zoning Code, Title 20 of
the Newport Beach Municipal Code, and the 1973 Uniform
Building Code."
Section 15.06.090. Amendment to Section 503 (b) of
the Housing Code. Section 503 (b) of the Housing Code,
hereinbefore adopted in Section 15.06.010 is amended to
read:
"Section 503. (b) Floor Area. Each dwelling unit shall
have at least one room which shall have not less than 120
square feet of floor area. Every room which is used for
both cooking and living or both living and sleeping purposes
shall have not less than 150 square feet of floor area.
Every room used for sleeping purposes shall have not less
than 70 square feet of floor area. Where more than two
persons occupy a room used for sleeping purposes the
required floor area shall be increased at the rate of 50
square feet for each occupant in excess of two. The minimum
floor area of a dwelling unit shall be 600 square feet."

EXCEPTION: Nothing in this Section shall prohibit
the use of an existing dwelling unit constructed under
permit prior to January 1, 1972, and meeting the following
• requirements.
1. The unit shall have a living room of not less than
220 square feet of floor area. An additional 100 square
feet of floor area shall be provided for each occupant of
such unit in excess of two.
2. The unit shall be provided with a separate closet.
3. The unit shall be provided with a kitchen sink,
cooking appliance and refrigeration facilities each having
a clear working space of not less than 30 inches in front.
Light and ventilation conforming to this Code shall be
provided.
4. The unit shall be provided with a separate bathroom
containing a water closet, lavatory, and bathtub or
• shower.
Section 15.06.100. Deletion of Chapters 10, 11, 12,
13, 14, 15 & 16. Chapters 10 entitled "Substandard Buildings ",
11 entitled "Notices and Orders of Building Official ",
12 entitled "Appeal ", 13 entitled "Procedures for Conduct
of Hearing Appeals ", 14 entitled "Enforcement of the Order
of the Building Official or the Board of Appeals ", 15 entitled
"Performance of Work or Repair or Demolition ", 16 entitled
"Recovery of Cost of Repair or Demolition," are hereby deleted
from the Housing Code, hereinbefore adopted in Section
15.06.110.
SECTION 2. This ordinance shall be published once in
the official newspaper of the City, and the same shall be
effective thirty (30) days after the date of its adoption.
