AN ORDINANCE OF THE CITY OF NEWPORT BEACH
• AMENDING SECTION 20.02.060 AND ADDING
SECTIONS 20.02.061, 20.02.062 AND 20.02.063
OF THE NEWPORT BEACH MUNICIPAL CODE AS
THEY PERTAIN TO HEIGHT LIMITS FOR CHIMNEYS
AND VENTS; ARCHITECTURAL FEATURES; FLAG
POLES; AND PARAPET WALLS, ELEVATOR AND
MECHANICAL PENTHOUSES, AND MECHANICAL
EQUIPMENT
The City Council of the City of Newport Beach
DOES ORDAIN as follows:
SECTION 1. Section 20.02.060 of the Newport
Beach Municipal Code is amended to read as follows:
"20.02.060. Chimneys and Vents. Chimneys and
vents shall be permitted in excess of height limits
to the minimum extent required by the Uniform Building
Code. All chimneys and vents exceeding the minimum
height required by the Uniform Building Code shall be
• subject to the approval of the Planning Commission."
SECTION 2. Section 20.02.061 is added to the
Newport Beach Municipal Code to read as follows:
"20.02.061. Architectural Features. Architectural
features such as, but not limited to, cupolas, weathervanes,
wrought iron railings and other decorative roof top
features of an open nature may be permitted in excess
of height limits subject to the approval of the Planning
Commission."
SECTION 3. Section 20.02.062 is added to the
Newport Beach Municipal Code to read as follows:
"20.02.062. Flag Poles. Flag poles shall be
permitted in the 24/28 and the 28/32 Foot Height
• Limitation Zones not to exceed a height of 35 feet.

Flag poles shall be permitted in the 26/35 and the
32/50 Foot Height Limitation Zones not to exceed
a height of 50 feet. All other flag poles in excess
of the height limits noted above may be permitted
subject to the approval of the Planning Commission."
SECTION 4. Section 20.02.063 is added to the
Newport Beach Municipal Code to read as follows:
"20.02.063. Parapet Walls, Elevator and Mechanical
Penthouses, and Mechanical Equipment. Parapet walls,
elevator and mechanical penthouses, and mechanical
equipment and other items not expressly permitted in
excess of the height limits shall be prohibited."
SECTION 5. This Ordinance shall be published once
in the official newspaper of the City, and the same shall be
effective thirty (30) days after the date of its adoption.
This Ordinance was introduced at a regular meeting
of the City Council of the City of Newport Beach held on
the 13th day of September 1976, and was adopted on the
27th day of September , 1976, by the following vote,
to wit:
