NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on November 20, 2008, at 6:30 p.m., a public hearing will be
conducted in the City Council Chambers (Building A) at 3300 Newport Boulevard, Newport Beach,
California. The Planning Commission of the City of Newport Beach will consider the following
application:
An application for approval of a Development Agreement between Sober Living By The Sea and
the City of Newport Beach that provides an entitlement for the operation of residential care facilities
in the City while also containing limitations on the number of beds that may be operated City -wide
and within West Newport, the Balboa Peninsula, and Lido Isle, including beds in facilities otherwise
not subject to City regulation under state law and containing operational standards applicable to the
operation.
This activity has been determined to be categorically exempt under the requirements of the
California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities). This class of
projects has been determined not to have a significant effect on the environment and is exempt
from the provisions of CEQA. This activity is also covered by the general rule that CEQA applies
only to projects that have the potential for causing a significant effect on the environment (Section
15061(b)(3) of the CEQA Guidelines). It can be seen with certainty that there is no possibility that
this activity will have a significant effect on the environment and it is not subject to CEQA.
All interested parties may appear and present testimony in regard to this application. If you
challenge this project in court, you may be limited to raising only those issues you or someone else
raised at the public hearing (described in this notice) or in written correspondence delivered to the
City, at, or prior to, the public hearing. The agenda, staff report, and environmental documents may
be reviewed at the Planning Department, City of Newport Beach, 3300 Newport Boulevard,
Newport Beach, California, 92663 or at the City of Newport Beach website at www.citv.newport-
