The existing church facility contains a parish hall, administration offices, and preschool classrooms. No square footage increase is proposed. The additional students will be accommodated in the existing Sunday school classrooms located in the administration office building. To the east is the Newport Coast Child Development Preschool, to the west is the Bonita Canyon Sports Park, and to the south is the Newport Hills Shopping Center. The subject property is approximately 82,845 square feet in area and is developed with a 12,327- square -foot church facility consisting of a parish hall /sanctuary, administration offices, and classrooms, and a surface parking lot with 88 parking spaces. The adjacent preschool parking lot contains 14 parking spaces and the two uses have a shared parking agreement. Project Description The applicant requests an amendment to Use Permit No. UP3633 to increase the capacity of the preschool at St. Matthew's Church to allow an additional 16 children. The Use Permit currently allows a maximum of 60 children and this amendment would increase that number to 76 children. No additional square footage is proposed. The additional students will be accommodated in the existing Sunday school classrooms located in the administration office building. The applicant's project description is provided as Attachment No. PC 3. Background On September 10, 1998, the Planning Commission approved Use Permit No. UP3633 to allow the establishment of a religious facility on a vacant site. The approval allowed the church structure to exceed the 50 foot height limit with a steeple and included a parking management plan with a reduction in the number of required parking spaces. On March 23, 2000, the Planning Commission approved an amendment to Use Permit UP3633 allowing additional square footage, changes to the project plans, and an increase in the preschool capacity from 50 to 60 children. The approvals included two (2) phases of development. Phase 1 included construction of classrooms, the parish hall, and administrative offices. Phase 1 was completed in 2001. The Phase 2 approval included a sanctuary building with a chapel. Phase 2 was granted a time extension in 2005; however, it was not constructed and the approval expired. DISCUSSION Analysis 04/16/2012 St. Matthew's Preschool Capacity Increase (PA2012 -081) August 23, 2012 Page 4 General Plan and Zoning Code Consistency The subject property is designated as Private Institutions (PI) by the Land Use Element of the General Plan, which is intended to provide for privately owned facilities that serve the public, including places for religious assembly and private schools. The subject property is located within the Bonita Canyon Planned Community (PC -50) Zoning District. Within PC -50, the subject property is located within Residential Subarea 4, which is intended to provide for a wide variety of residential housing types and also allow for community service facilities. A church is an allowed use within Subarea 4 with the approval of a Use Permit. The church and associated preschool use are consistent with the land use and zoning designations. Operation and Existing Development The preschool office hours are from 9:00 a.m. to 6:00 p.m., Monday through Friday. The parish office hours vary from day to day, but do not exceed 9:00 a.m. to 4:00 p.m., Monday through Friday. The worship services are currently offered on Thursday mornings and at three times on Sundays. Sunday school is offered during services on Sundays. The preschool operates from 9:00 a.m. to 3:00 p.m., Monday through Friday. Day care is provided from 7:00 a.m. to 9:00 a.m. and 3:00 p.m. to 6:00 p.m. Counseling sessions and classes are also offered throughout the week. The church is made up of three buildings: the parish hall, administration building, and preschool. The administration building contains offices, classrooms, a youth room, restrooms, and storage. The classrooms on the first floor are used for Sunday school classes and would be used for the proposed additional preschool classrooms. The square footage of the existing church facilities is summarized in the Table 1 below. The subject property contains 88 parking spaces and the adjacent preschool parking lot contains 14 parking spaces, for a 04/16/2012 St. Matthew's Preschool Capacity Increase (PA2012 -081) August 23, 2012 Page 5 total of 102 spaces. The two uses have a shared parking agreement. There is also motorcycle parking available onsite. The parking requirement for the church is based on the number of seats in the sanctuary. The Phase 2 sanctuary was planned for 312 seats, which required 104 parking spaces, based on a parking requirement of one (1) space for every three (3) seats in the sanctuary. Use Permit No. UP3633 included approval of a parking management plan with a waiver of 16 parking spaces. However, the current sanctuary within the parish hall has fewer than 200 seats; therefore, there is currently excess parking of 21 parking spaces above the requirement. If a larger sanctuary is constructed in the future, an amendment to this Conditional Use Permit would be required. The church services are the highest generator of parking demand on site, and those services generally occur outside of the preschool hours. The preschool use is ancillary to the church use and does not generate a high parking demand. The increased capacity of 16 students will require additional staff members. The 102 parking spaces are sufficient to accommodate the adjacent preschool use and the proposed preschool expansion. The circulation and drop off /pick up of the children runs efficiently and the additional preschool capacity should not negatively affect it. Required Findings Pursuant to Section 20.52.020 (Conditional Use Permits and Minor Use Permits) of the Zoning Code, the Planning Commission may approve or conditionally approve a Conditional Use Permit only after making the following findings: 1. The use is consistent with the General Plan and any applicable specific plan; 2. The use is allowed within the applicable zoning district and complies with all other applicable provisions of this Zoning Code and the Municipal Code; 3. The design, location, size, and operating characteristics of the use are compatible with the allowed uses in the vicinity; 4. The site is physically suitable in terms of design, location, shape, size, operating characteristics, and the provision of public and emergency vehicle (e.g., fire and medical) access and public services and utilities, and 5. Operation of the use at the location proposed would not be detrimental to the harmonious and orderly growth of the City, or endanger, jeopardize, or otherwise constitute a hazard to the public convenience, health, interest, safety, or general welfare of persons residing or working in the neighborhood of the proposed use. Staff believes that findings for approval can be made, and facts in support of the required findings are included in the draft resolution (Attachment No. PC 1). The existing church and preschool use is consistent with the PI land use designation and the 04/16/2012 St. Matthew's Preschool Capacity Increase (PA2012 -081) August 23, 2012 Page 6 PC -50 zoning regulations. The proposed amendment is a minor expansion of the existing preschool use. The increased capacity should not negatively affect neighboring uses and it is an added amenity to the residents and employees in the area. The off - street parking that is provided is sufficient and the existing circulation for the drop off and pick up of children is effective. Alternatives The Planning Commission may also approve a modified project or deny the application. Should the Planning Commission determine that the required findings cannot be made, the attached Resolution for Denial (Attachment No. PC 2) is provided to facilitate the denial of the project, and would require additional information or findings that the Planning Commission may deem necessary or warranted. Environmental Review The project is categorically exempt under Section 15301, of the California Environmental Quality Act (CEQA) Guidelines - Class 1 (Existing Facilities), which exempts minor alterations to existing facilities involving negligible expansion of use. The proposed project consists of a minor expansion of an existing use with no additional square footage. Public Notice Notice of this review was published in the Daily Pilot, mailed to property owners within 300 feet of the property and posted at the site a minimum of 10 days in advance of this hearing consistent with the Municipal Code. Additionally, the item appeared upon the agenda for this meeting, which was posted at City Hall and on the City website. The 102 parking spaces are sufficient to accommodate the adjacent preschool use and the proposed preschool expansion. The sanctuary within the parish hall has fewer than 200 seats; therefore, the required parking is no more than 67 spaces and there is an excess of spaces above the requirement. Finding: C. The design, location, size, and operating characteristics of the use are compatible with the allowed uses in the vicinity. The operational characteristics are typical for a religious facility and the church is a compatible use with the allowed uses in the vicinity, including residential, commercial, and parks. Operation of the use at the location proposed would not be detrimental to the harmonious and orderly growth of the City, or endanger, jeopardize, or otherwise constitute a hazard to the public convenience, health, interest, safety, or general welfare of persons residing or working in the neighborhood of the proposed use. Facts in Support of Finding: E -1. The church has operated in this location since 2001 and has not proven detrimental to the surrounding areas. E -2. The project has been reviewed and conditioned to ensure that potential conflicts with surrounding land uses are minimized to the extent possible to maintain a healthy environment for residents and businesses. Any change in operational characteristics, expansion in area, or other modification to the approved plans, shall require an amendment to this Use Permit or the processing of a new Use Permit. 7. Noise generated by the use, which include the use of musical instruments, pre- recorded music and /or singing, shall be confined to the interior of the structure and all windows and doors within the facility shall be closed, except when entering and leaving by the main entrance of the facility. 8. All noise generated by the proposed use shall comply with the provisions of Chapter 10.26 and other applicable noise control requirements of the Newport Beach Municipal Code. Prior to the issuance of a building permit, the applicant shall pay any unpaid administrative costs associated with the processing of this application to the Planning Division. 10.
