AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING SECTION 12.56.140 AND AMENDING
CHAPTER 12.57 OF THE NEWPORT BEACH MUNICIPAL
CODE TO READ "SKATEBOARDING AND ROLLERSKATING
REGULATIONS"
The City Council of the City of Newport Beach DOES
ORDAIN as follows:
SECTION 1. Section 12.56.140 of the Newport Beach
Municipal Code is hereby amended to read as follows:
"12.56.140 Operating Bicycle on Sidewalk. No
person shall operate or ride a bicycle, surrey cycle,
pedicab, or other wheeled device or conveyance used
for transportation and propelled by human power, upon
any sidewalk in the City, except that bicycles may be
ridden on those sidewalks designated by the City
Council by resolution adopted by the City Council,
which permits bicycle riding on certain specified
sidewalks.
The foregoing prohibition shall not apply to
children's or invalids' tricycles, wheel chairs,
roller skates, or skateboards, except as provided in
Chapter 12.57 of the Municipal Code."
SECTION 2. Chapter 12.57 of the Newport Beach
Municipal Code is hereby amended to read as follows:
"CHAPTER 12.57
SKATEBOARDING AND ROLLERSKATING
- REGULATIONS
Sections:
12.57.010 Definitions.
12.57.020 Skateboarding Restrictions.
12.57.025 Rollerskating Restrictions.
12.57.030 Posting of Signs Prohibiting.
12.57.040 Penalty.
12.57.010 Definitions. (A) SKATEBOARD. For the
. purpose of this Chapter, the term 'skateboard' includes .
all wheeled objects, coasters, scooters, toys, conveyances,
or similar devices used for transportation or sport which
are propelled by human power and which are not classified
as bicycles in this Code.
(B) ROLLER SKATE. For the purpose of this Chapter,
the term 'roller skate' includes any form of device worn
on the feet with four wheels or rollers, for use on a
sidewalk or other surface offering traction.
12.57.020 Skateboarding Restrictions. Skateboarding
shall be prohibited on all public streets and sidewalks
located in the City of Newport Beach having a grade of
six percent (6%) or more and which are declared by
resolution of the City Council to be harzardous to pedes-
trians, motorists, or persons operating skateboards. The
City Council may by resolution prohibit skateboarding on
public streets and sidewalks having a grade of less than
six percent (6 %) when it is determined to be necessary
to protect the health, safety and welfare of pedestrians,
motorists, Or persons Operating skateboards On said streets
and sidewalks.
12.57.025 Rollerskating Restrictions. Rollerskating
shall be prohibited on all public streets and sidewalks in
the City of Newport Beach which are declared by resolution
of the City Council to be hazardous to pedestrians, motorists,
or persons rollerskating.
12.57.030 Posting of Signs Prohibiting. The City
"77W7 : Manager is hereby authorized to post or erect or cause to
be posted or erected signs prohibiting skateboarding or
rollerskating or the use of skateboards or roller skates

on public streets and sidewalks so designated by
resolution of the City Council.
12.57.040 Penalty. It shall be unlawful for any
person to violate or fail to comply with any provision of
this Chapter. Any person violating the provisions of this
Chapter shall be guilty of an infraction."
SECTION 3. This ordinance shall be published once in
the official newspaper of the City, and the same shall be
effective thirty (30) days after the date of its adoption.
This ordinance was introduced at a regular meeting of
the City Council of the City of Newport Beach held on the 14th
day of May, 1979, and was adopted on the 29th day of May ,
1979, by the following vote, to wit:
