AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING SECTION 20.87.140 OF THE NEWPORT
-40 DEFINITION MUNICIPAL CODE AS IT PERTAINS TO THE
DEFINITION OF THE TERM "DWELLING UNIT."
The City Council of the City of Newport Beach
DOES ORDAIN as follows:
SECTION 1. Section 20.87.140 of the Newport
Beach Municipal Code is amended to read as follows:
"20.87.140. Dwelling Unit. The term "dwelling
unit" shall mean a single unit providing complete
independent living facilities for one or more persons,
including provisions for living, sleeping, and sanitation
and having at least one entrance opening to the outside
or to a common hallway or entryway shared by other
dwelling units or facilities.
Dwelling units constructed after August 24, 1972,
must contain a minimum of 600 square feet of superficial
floor area.
Every dwelling unit shall have at least one
room which shall Have not less than 150 square feet of
floor area. Other habitable rooms, except kitchens,
shall have an area of not less than 70 square feet.
An efficiency type unit shall have a living
room of not less than 220 square feet of superficial floor
area. An additional 100 square feet of superficial
floor area shall be provided for each occupant of each
unit in excess of two persons. The kitchen facilities
shall be provided with a clear working space of not
less than 30 inches in front. The unit shall be provided
with a separate bathroom containing a water closet,
lavatory and bathtub or shower. All areas must meet
the Housing Code Regulations for ceiling height, light
and ventilation.
Existing units not meeting the above outlined
criteria shall not be occupied by more than two persons.

The provisions of Chapter 20.83 entitled "Nonconforming
Structures and Uses" notwithstanding the following
regulation, shall apply to buildings on lots which
contain a greater number of dwelling units than permitted.
Buildings on lots which contain a greater number
of dwelling units than permitted by Chapter 20 of the
Newport Beach Municipal Code must be altered to conform
to the requirements of the Code within 60 years from the
date of original construction, unless specifically exempted
by the City Council."
SECTION 2. This ordinance shall be published once
in the official newspaper of the City and the same shall be
effective thirty (30) days after the date of its adoption.
This ordinance was introduced at a regular meeting of
the City Council of the City.of Newport Beach held on the
10th day of December 1979, and was adopted on the
7th day of January 1980, by the following vote,
