ORDINANCE NO.
AN ORDINANCE OF THE CITY OF NEWPORT BEACH REPEALING
SECTION 15.04.040, AMENDING SECTION 15.06.090 AND
REPEALING CHAPTER 15.21 OF THE. NEWPORT BEACH
MUNICIPAL CODE TO ELIMINATE THE 600 SQUARE FEET
MINIMUM FLOOR AREA FOR RESIDENTIAL DWELLINGS WITHIN
THE CITY OF NEWPORT BEACH, CALIFORNIA
The City Council of the City of Newport Beach DOES
ORDAIN as follows:
SECTION 1. Section 15.04.040 of the Newport Beach
Municipal Code is hereby repealed..
SECTION 2. Section 15.06.090 of the Newport Beach
Municipal Code is hereby amended to read as follows:
"Section 15..06.090.
Amendment to Section 503(b) of
the Housing Code. Section 503(b) of the Housing
Code hereinbefore adopted in Section 15.06.010 is
amended to read:
"Section 503.(b) Floor Area. Each dwelling unit
shall have at least one room which shall have not less
than 120 square feet of floor area. Every room which is
used:for both cooking and living or both living and sleeping
purposes shall have not less than 150 square feet of floor
area. Every room used for sleeping purposes shall have not
less than 70 square feet of floor area. Where more than
two persons occupy a room used for sleeping purposes the
required floor area shall be increased at the rate of 50
square feet for each occupant in excess of two.
EXCEPTION: Nothing in the Section shall prohibit the
use of an existing dwelling unit constructed under permit
prior to January i, 1972, and meeting the following requirements.
1. The unit shall have a living room of not less than
220 square feet of floor area. An additional 100 square feet
of floor area shall be provided for each occupant of such
unit in excess of two.
2. The unit shall be provided with a separate closet.
3. The unit shall be provided with a kitchen sink,
cooking appliance and refrigeration facilities each having
a clear working space of not less than 30 inches in
front. Light and ventilation conforming to this Code
shall be provided.
4. The unit shall be provided with a separate bathroom con-
etaining a water closet, lavatory, and bathtub or shower.

SECTICN 3. CHAPTER 15.21of the Newport Beach
Municipal Code is repealed.
SECTION 4. This ordinance shall be published once
on the official newspaper of the City and the .same shall be effective
thirty (30) days after the date of its adoption.
This ordinance was introduced at a regular meeting of
the City Council of the City of Newport Beach held on the 21st day
of I January , 1980, and was adopted on the 11th day of
February 1980, by the following vote, to -wit:
