AMENDING CHAPTER 15.12 OF THE NEWPORT BEACH
MUNICIPAL CODE TO ADOPT THE NATIONAL
• ELECTRICAL CODE, 1981 EDITION
The City Council of the City of Newport Beach DOES
ORDAIN as follows:

15.12.010 Adoption of National Electrical Code.
• Subject to the particular additions, deletions and
amendments hereinafter set forth in this Chapter, the rules,
regulations, provisions and conditions set forth in that certain
Code entitled "National Electrical Code, 1981 Edition" (NFPA No.
70 -1981, published by the National Fire Protection Association,
and the whole thereof, including the appendix thereto, three full
printed copies of which, printed as a Code in book form, were by
the City Council ordered filed and which have been actually filed
in the office of the City Clerk and which, as so on file are
hereby referred to, adopted and made a part hereof as fully and
for all intents and purposes as though set forth herein at
length, shall be and the same are hereby established and adopted
as the rules, regulations, provisions and conditions to be
observed and followed in the construction, alteration, installa-
tion, moving, repair and use of any electrical wiring on any
premises within the incorporated area of the City of Newport
Beach; providing for issuance of permits and collection of fees
therefor; and providing penalties for violation of such code;
and subject to said additions, deletions and amendments herein-
after set forth, said Code is hereby established and adopted and
the same shall be designated, known and referred to as the
"Electrical Code" of and for the City of Newport Beach.
15.12.020 Exemptions
The provisions of this Code shall not apply to public
utilities or to electrical wiring for street lighting or traffic
signals located primarily in a public way.
15.12.030 Compliance With Electrical Code Required
• No person shall erect, construct, alter or repair any
electrical installation or wiring in the City or cause or permit

the same to be done without complying with all provisions of the
• Electrical Code.
15.12.040 Violations and Penalties
Any person, firm or corporation violating any of the
provisions of this Code shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be punishable by a fine or not
to exceed Five Hundred Dollars ($500.00) or by imprisonment in
the County jail for not to exceed six months, or by both such
fine and imprisonment. Each separate day or any portion thereof
during which any violation of this Code occurs or continues shall
be deemed to constitute a separate offense, and upon conviction
thereof shall be punishable as herein provided.
The issuance or granting of a permit or approval of
plans and specifications shall not be deemed or construed to be a
permit for, or an approval of, any violation of any of the
• provisions of this Code. No permit presuming to give authority
to violate or cancel the provisions of this Code shall be valid,
except insofar as the work or use which it .authorizes is

The issuance or granting of a permit or approval of
plans shall not prevent the Electrical Inspector from thereafter
requiring the correction of errors in plans and specifications or
from preventing construction operations being carried on-there-
under when in violation of this Code or of any other ordinance or
from revoking any Certificate of Approval when issued in error.
15.12.050 Amendment to Article 90 -4.
Article 90 -4 of the National Electrical Code, herein-
before adopted in Section 15.12.010 is amended to read:

190 -4 Enforcement. The Building official of the City of
Newport Beach shall enforce the provisions of this Code and shall

have the responsibility for making interpretations of the rules,
• for deciding upon the approval of equipment and materials, and
for granting the special permission contemplated in a number of
the rules.'
15.12.060 Addition of Article 90 -9.
Article 90 -9 is added to the National Electrical rode,
hereinbefore adopted in Section 15.12.020, to read:
90 -9 Electrical Inspector. Electrical Inspector shall
be the Building official of the City of Newport Beach and such
other person or persons in the Building Department as are autho-
rized and directed by the Building official to carry out under
his direction and supervision the powers and duties set forth in
this Code.
Whenever the term 'Electrical Inspector' is used in any
section of this ordinance such term shall be construed to mean
isthe Building official or his authorized representative.
15.12.070 Amendment to Article 100.
Article 100 of the National Electrical Code, entitled
"Definitions" hereinbefore adopted in Section 15.12.010 is amend-
ed to add the definitions of the following terms only. All
words, phrases or terms not hereinafter defined shall have the
same meaning as set forth in Article 100 as published.
Apartment House is any building or portion thereof,
which is designed, built, rented, leased, let or hired out to be
occupied, or which is occupied as the home or residence of three
or more families living independently of each other and doing
their own cooking in the said building, and shall include flats
and apartments.
• Building is any structure built for the support of
shelter of persons, animals, chattels or property of any kind.

Building Official is the officer or other designated
• authority charged with the administration and enforcement of this
Code or his duly authorized representative.
Master Electrician is a person who is engaged in the
business or installing or repairing electrical wiring or equip-
ment, or who does, or who holds himself out as willing to do
personally or through his employees any work or services in con-
nection with the installation, alteration or repair of any elec-
trical wiring or equipment or part thereof within the incorporat-
ed territory of the City of Newport Beach and who possesses an
appropriate contractor's license pursuant to Chapter 9, Division
3 of the Business and Professions Code.
Dwelling is any building or any portion thereof which is
not an "Apartment House ", "Lodging House" or a "Hotel" as defined
in this Code, which contains one or two "Dwelling Units ", or
• "Guest Rooms ", used, intended or designated to be built, used,
rented, leased, let or hired out to be occupied, or which are
occupied for living purposes.
Dwelling Unit is a single unit providing complete
independent living facilities for living, sleeping, eating, cook-
ing and sanitation.
Hotel is any building containing six or more rooms
intended or designed to be used, or which are used, rented or
hired out to be occupied, or which are occupied for sleeping
purposes by guests.
Maintenance Electrician is any electrician regularly
employed in accordance with the provisions of Sections 105 -2 and
105 -3 of this ordinance.
• Person is an individual human being, a firm, partnership
or corporation, his or their heirs, executors, administrators,

assigns, officers or agents; the City of Newport Beach and any
. local agency as defined in Section 53090 of the government Code,
or officer thereof.
Sign Electrician is any person holding a valid State
Contractor's License with a classification of C -45 engaged in the
business of installing or maintaining the electrical wiring of a
sign or of a gas tube electrical sign whether fixed or portable
for which a permit is required by this Code.
15.12.080 Addition of Article 105.
The title of Article 105 of the National Electrical
Code, hereinbefore adopted in Section 15.12.010 is added to read:
Article 105 ADMINISTRATION.
15.12.090 Addition of Article 105 -1.
Article 105 -1 is added to the National Electrical Code
hereinbefore adopted in Section 15.12.010 to read:
• 105 -1 Applications and Permits
(a) Applications. Applications for electrical permits,
describing the work to be done, shall be made in writing by a
master electrician, maintenance electrician or their authorized
representative. Where a license is required by the State of
California, a permit shall not be issued unless the applicant has
such a license. in the case of an owner, such application shall
be for a special owner's permit.
Applications shall give the location where such work is
to be done, either by street and house number, by lot, block and
tract, or similar description that will readily identify and
definitely locate the proposed work. A separate application
shall be required for each building.
• EXCEPTION: Applications for single - family dwellings may
include all accessory buildings such as garages, sheds, guest

houses, and the like that are located on the same lot, erected at
• the same time, and supplied from the same service as the main
building. A separate application shall be required for any.pri-
vate dock installation.
Each such application shall be accompanied by drawings
or plans as required by the Electrical Inspector. Application
may be made by a firm, partnership or corporation, any officer or
member of which is an electrician, sign electrician, master elec-
trician in the event that all construction or work is done under
the direct personal supervision of such officer or member.
(b) Special Owner's Permit. The Electrical Inspector
may issue to an individual a special owner's permit authorizing
said individual to install, alter, change or repair electrical
equipment in, on, or about a single - family residence of which
said individual is owner, and in which he resides or intends to
• reside, but not elsewhere; provided that no electrical work
authorized under any such special owner's permit shall be done,
nor shall the owner holding any such permit allow any such work
to be done, except personally by the owner to whom the permit is
issued, or by a member of his immediate family; and, if this or
any other provision hereof shall be violated by the holder of
such special owner's permit, such permit shall be subject to
immediate cancellation by the Electrical Inspector, and the hold-
er thereof shall be liable to the penalty hereinafter provided
for violation of this Code.
(c) Permits. No alteration or addition shall be made
to any existing wiring, nor shall any wiring for the placing or
installation of any electric light, power or heating device, or
• any apparatus which generates, transmits, transforms or utilizes
electricity, operating at a voltage exceeding 7.5 volts between

• conductors or capable of supplying more than 50 watts, be made
without first obtaining a permit therefor from the Electrical
Inspector, excepting minor repair work such as repairing flush
and snap switches, replacing fuses, changing lamp sockets and
receptacles, taping bare joints, repairing drop cords and the
like.
The application, plans and specifications filed as re-
quired by this section, shall be checked by the Electrical
Inspector, and if found to be in conformity with the requirements
of this Code and all other laws or ordinances applicable thereto,
the Electrical Inspector shall, upon receipt of the required fee,
issue a permit therefor.. Every permit issued shall be valid only
for the location described on the application therefor.
(d) Expiration of Permit. Every permit issued by the
Electrical Inspector under the provisions of this Code shall
• expire by limitation and become null and void if the building or
work authorized by such permit is not commenced within 180 days
from the date of such permit, if the building or work authorized
by such permit be suspended or abandoned at any time after the
work is commenced for a period of 180 days, or if the electrical
work authorized by such permit is not completed within one year
from date of issuance of such permit. When an electrical permit
expires, no electrical work shall be done thereafter without
first obtaining a separate electrical permit from the Electrical
Inspector in the same manner as is required herein for an origin-
al permit.
(e) Cancellation of Permit. If no portion of the work
or construction covered by a permit issued by the Electrical
• Inspector under the provision of this Code has been commenced,
the person to whom such permit has been issued may deliver such

• permit to the Electrical Inspector with a request that such per-
mit be cancelled. The Electrical Inspector shall thereupon stamp
or write upon the face of such permit the words, 'cancelled at
the request of the permittee.' Thereupon such permit shall be
null and void and of no effect.
(f) Additional Electrical Work after Final Approval.
After the Electrical Inspector has finally approved electrical
work authorized under an electrical permit, no additional
electrical work shall be.done thereunder without first obtaining
a separate electrical permit authorizing such additional electri-
cal work.
15.12.100 Addition of Article 105 -2
Article 105 -2 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010, to read:

0105 -2 Maintenance Electrician.
(a) A maintenance electrician shall not install, alter,
maintain or repair electrical wiring or equipment in or on any
building owned or occupied by his employer without first having
obtained a Certificate of Competency as herein provided.
(b) The Electrical Inspector shall establish minimum
standards of electrical competency to be used in determining
whether any person is qualified for a Certificate of Competency
as a Maintenance Electrician. The Electrical Inspector shall
issue such Certificate of Competency to any applicant meeting
such standards. If the Electrical Inspector determines that an
applicant is not so qualified, such applicant may appeal his
determination in accord with such procedures as may be set forth
by the City Council of the City of Newport Beach.

15.12.110 Addition of Article 105 -3
isArticle 3.05 -3 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.03.0 to read:
"105 -3 Registration of Maintenance Electricians.
(a) The Electrical inspector shall register each Main-
tenance Electrician to whom a Certificate of Competency is issu-
ed. The business identity of the Maintenance Electrician and his
employer, their business addresses and the location and descrip-
tion of buildings and premises in or on which the Maintenance
Electrician will be doing electrical work, shall be included in
such registration and the Maintenance Electrician shall notify
the Electrical Inspector of any changes in the information
required under such registration.
(b) Certificate of Competency shall expire on the 30th
day of June following their issuance, and may thereafter be re-
0 newed on an annual basis.
(c) An Applicant for such a Certificate of Competency
shall at the time of filing his application pay an examination
fee of Twenty Five Dollars ($25.00), and at the time a Certifi-
cate of Competency is issued pay a registration fee of Twenty
Five Dollars ($25.00). A registration fee of Twenty Five Dollars
($25.00) shall also be paid at the time of each annual renewal of
such certificate.
15.12.120 Addition of Article 105 -4
Article 105 -4 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010 to read:
"105 -4 Revocation or Suspension of Certificates of Com-
petency. The electrical inspector, with the approval of the Cit_v
• Manager, may suspend or revoke a Certificate of Competency when
the maintenance electrician holding such certificate has violated

any of the provisions of this Code or has engaged in conduct
constituting incompetency in connection with his electrical
• work. Any such maintenance electrician may appeal such suspen-
sion or revocation in the same manner as set forth in Section
15.12.110 of this Code. No electrical work shall be done by such
maintenance electrician pending a decision by such Board without
the approval of the City Manager.
15.12.130 Addition of Article 105.5
Article 105.5 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010 to read:
11105 -5 Interpretations by Electrical Inspector.
The electrical inspector is hereby empowered to make interpreta-
tions of any of the provisions of this Code wherever there is a
reasonable question as to what is required in the way of mater-
ials or methods or manner in which the materials shall be
installed. Such interpretations shall be in writing filed in the
• office of the electrical inspector and shall be final unless an
appeal is taken."
15.12.140 Addition of Article 105 -6
Article 105 -6 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010 to read:
105 -6 Inspection.
(a) Approval. Upon the completion of the electrical
wiring in or on any building or structure of any nature, or
premises, except as otherwise exempted in this ordinance, the
person, firm, or corporation installing the same shall notify the
electrical inspector, who shall inspect such installation, and if
it is found by him to be fully in compliance with the provisions
of this ordinance, he shall issue, as provided for herein, the
• certificate of inspection or approval tag authorizing connection
to the electrical service and the energizing of the installation.

(b) Permission to Cover Work. It shall be unlawful for
• any person to lath over, seal, cover or conceal any electrical
wiring or other electrical equipment, for the installation of
which a permit is provided herein, until such electric wiring or
other electrical equipment shall have been inspected and approved
by the electrical inspector. Said electrical inspector shall
have the power to remove, or to require the removal of any
obstruction which prevents proper inspection of any electrical
equipment.
(c) Corrections. All defects shall be corrected within
ten (10) days after inspection and notification or within such
other reasonable time as is permitted by the electrical inspec-
tor.

(d) Connection. It shall be unlawful to energize or
cause or permit to be energized any electrical wiring coming
• under the provisions of this Code, until such electrical wiring
shall have been inspected and approved by the electrical inspec-
tor and the building finalized. Provided, however, that the
electrical inspector may give written temporary permission to
furnish electric current to, or the use of electric current th-
rough any electrical wiring for a length of time not exceeding
thirty (30) days, if it appears to said electrical inspector that
such electrical wiring may be used safely for such purpose, and
that there exists an urgent necessity for such use.
(e) Governmental Agencies. The provisions of this Code
shall cover, govern and control the installation, alteration or
repair of any electrical wiring, connection, fixtures, sockets,
appliances, apparatus, machinery or other electrical device by or
• on behalf of the City of Newport Beach or any department or offi-
cer thereof or by or on behalf of any school district or any

• quasi - public or political corporation or governmental agency or
body, on any premises not owned by a public school district being
constructed within said incorporated territory. This paragraph
does not apply to such electrical wiring as is specifically ex-
empt under the provisions of Section 15.12.020.
15.12.150 Addition of Article 105 -7
Article 105 -7 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010, to read:
11105 -7 Reinspection. The Electrical Inspector is
hereby authorized and empowered to make at such times- and as
often as in his discretion it may seem necessary, a thorough
reinspection of the installation in or on any building, structure
or premises of all electrical wiring, electric devices and elec-
trical material now installed or that may hereafter be installed
• within the incorporated territory of said City and when the in-
stallation of any such wiring device or material is found to be
in a dangerous or unsafe condition the person, firm, corporation
or governmental agency owning, using or operating the same shall
be notified in writing and shall make the necessary repairs or
changes required to place such wiring, device or material in a
safe condition and to have such work completed within a period of
ten (10) days after such notice, or within such other reasonable
period specified by the electrical inspector in said notice and
shall pay such fees as are required by the provisions of this
ordinance.
The electrical inspector is hereby empowered to dis-
connect or to order the discontinuance of electrical wiring,
devices, or materials found to be defective until the installa-
tion of such wiring device or material has been made safe as
directed by the electrical inspector, and any person, firm, cor-

• poration, political subdivision or governmental agency ordered to
discontinue such electrical service shall. do so within 24 hours
after the receipt of such notice and shall not reconnect such
service or allow the same to be reconnected until. notified so to
do by the electrical inspector.
15.12.160 Addition of Article 105 -8 Article 105 -8 is
added to the National Electrical Code, hereinbefore adopted in
Section 15.12.010 to read:
"105 -8 Right of Entry.
1. The Electrical Inspector, or his duly authorized
representative, shall have the authority to enter any building or
premises for the purpose of investigating the exitence of
suspected or reported damage or defects which constitute an
immediate danger to human life or an immediate hazard to public
• safety or health.
2. Except in emergency situations as defined in
Article 105 -8 -1 of this Code, the Electrical Inspector, or his
authorized representative, shall not enter any building or pre-
mises without the consent of the owner or occupant thereof, un-
less he possesses an inspection warrant authorizing entry and
search of the premises.
3. No person shall hinder or prevent the Electrical
Inspector or his authorized representative, while in the perfor-
mance of the duties hereinbefore described as emergency situa-
tions or while in possession of a valid inspection warrant from
entering upon and into any and all premises under his jurisdic-
tion, at all reasonable hours, for the purpose of inspecting the
same to determine whether or not the provisions of this Code and
all other applicable laws or ordinances pertaining to the protec-
tion of persons or property, are observed therein.

• 15.12.170 Addition of Article 105 -9.
Article 105 -9 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010 to read:
11105 -9 Permits. ,
(a) An electrical permit shall be required whenever any
electrical equipment is to be installed within or on any build-
ing, structure, premises, whether publicly or privately owned,
and shall also be required for any alteration, addition to or
repair of any existing electrical equipment except as otherwise
provided herein.
(b) No electrical permit shall be required for the
following classes of electrical work:
1. Minor repair work, such as the replacement of
lamps or the connection of portable electrical equipment to suit-
able permanently installed receptacles.
2. The installation, alteration, addition to or
repair of electrical equipment, installed by or for an electri-
city supply agency for the use of such agency in the generation,
transmission, distribution or metering of electricity.
(c) Submission of any false statement in connection
with the issuance of any electrical permit shall constitute suf-
ficient cause for revocation of such electrical permit by the
Electrical Inspector.
15.12.180 Addition of Article 105 -10.
Article 105 -10 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010, to read:
11105 -10 Monthly Permits for Maintenance Electricians.
(a) In lieu of individual permits for electrical work,
• a monthly permit may be issued by the Electrical Inspector to any
person regularly employing one or more Maintenance

• Electricians. Such permit shall be issued on a calendar month
basis.
(b) Application for such monthly permit shall be on a
form provided by the Electrical Inspector and shall contain the
name and registration number of each Maintenance Electrician
employed and a description of the electrical work and the pre-
mises on which the electrical work has been done under such per-
mit.
(c) Each such Maintenance Electrician shall keep a
current detailed and accurate record in duplicate of all electri-
cal work which has been done by him and such record shall be
available for inspection by the Electrical Inspector.
(d) Within fifteen (15) days after the end of each
• calendar month, the person employing such Maintenance Electrician
shall file his application for such monthly Maintenance Electri-
cian permit with the Electrical Inspector, to which shall be
attached one copy of such Maintenance Electrician's record of
electrical work done during the preceding calendar month, and
shall pay such fees as are required for such work by this Code.
The Electrical Inspector shall then issue the monthly Maintenance
Electrician permit.
15.12.190 Addition of Article 105 -11.
Article 105 -11 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010, to read:
"105 -11 Fees. Payment of Fees. The fees prescribed
herein shall be paid to the Electrical Inspector for the City of
Newport Beach for each electrical installation, alteration, addi-
tion or repair for which an electrical permit is required, The
Electrical Inspector shall not issue an electrical permit, until
all such fees are paid in full.

15.12.200 Addition of Article 105 -12.
• Article 105 -12 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010, to read:
"105 -12 Fees. New Construction - Complete Structures
Only.
(a) Residential (single or multi- familv): The fees
herein set forth for new residential construction include all
electrical installations when the formula is applied to the
square `footage of area.
1. Three cents (.03) per square foot, plus Two Dollars
and Fifty Cents ($2.50) for each lighting meter, plus Five
Dollars ($5.00) for permit issuance, and
2. Two cents (.02) per square foot for detached or
attached garages and carports on the same service.
(b) Hotels and Motels: Use the regular fee schedule
isbelow for all areas except garages, and
1. Two cents (.02) per square foot for detached gar-
ages and carports on the same service in hotel and motel occupan-
cies.
•
(c) Commercial, Industrial and Assemblies: Use regular
fee schedule set forth in Section 105 -13.'
15.12.210 Addition of Article 105 -13.
Article 105 -13 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010, to read:
" 105 -13 Regular Fee Schedule. The regular fee sche-
dule shall apply to additions, alterations, extensions or renew-
als of existing electrical installations and to new construction
when so specified in the last preceding paragraph.

. In General:
Minimum permit fee of $5.00 for issuance of permit plus

IL5.12.220 Addition of Article 105 -14.
Article 105 -14 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.020, to read:
0105 -14 Plan Checking Fee.
A plan checking fee shall be paid at the time of
submitting plans as required for all proposed installations where
one or more services or feeders have a disconnecting means with a
single or combined total rating exceeding 600 amperes or having a
capacity of 150 kilovolt - amperes (KVA). Said fee shall be equal
to one -half (1/2) the required electrical permit fee as set forth
in Sections 105 -12 and 105 -13 of this Code.

15.12.230 Addition of Article 105.15.
• Article 105 -15 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.020, to read:
Article 105.15 Penalty Fee.
Any person who shall commence any electrical work for
which a permit is required by this ordinance without first having
obtained a permit therefor shall, if subsequently permitted to
obtain a permit, pay double the permit fee fixed by this section
for such work provided that this provision shall not apply to
emergency work when it shall be proved to the satisfaction of the
Electrical Inspector that such work was urgently necessary and
that it was not practical to obtain a permit therefor before the
commencement of work. In all such caes, a permit must be
obtained as soon as it is practical to do so, and if there be an
unreasonable delay in obtaining such a permit, a double fee as
• herein provided shall be charged.
15.12.240 Addition of Article 105 -16.
Article 105 -16 Fees is added to the National Electrical
Code, hereinbefore adopted in Section 15.12.010, to read:
"105 -16 Fees - Additional Electrical Work Under
Electric Permit. Whenever additional wiring will result in a
deviation from the electrical work authorized under an electrical
permit and such deviation has been approved by the Electrical
Inspector, an additional fee equal to the difference between the
fee paid when such permit was issued and the fee requried for the
additional wiring, plus issuance of permit fee, shall be paid."
]L5.12.250 Addition of Article 105 -17.
Article 105 -17 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010, to read:
• 11105 -17 Fees for Additional Inspection - The Electrical
inspector may charge an additional fee of $15.00 for each
additional inspection that he is required to make as a result of

faulty workmanship or material, or for any inspection requested
•before the work inspected has been completed, made ready for
inspection, or before an electrical permit has been obtained."
15.12.260 Addition of Article 105 -18.
Article 105 -18 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010, to read:
"105 -18 Fees - Temporary Electrical Services - Whenever
the owner or electrical contractor requests the temporary
energizing of a building's electrical system, the Electrical
Inspector when he finds the system safe may authorize the connec-
tion and use of a temporary electrical service for testing and
work with power. A fee of $25.00 shall be paid to the City for
one and two family residential buildings and $50.00 for all
others. When testing is required by the Electrical Inspector
this fee may be waived.
• The application for temporary energizing of the
building's electrical system shall be accompanied by cash,
certified check or cash bond in the amount of $500.00 for R -I &J
occupancies and $1,000.00 for all other occupancies. The
applicant shall complete an agreement to be provided by the City
agreeing and guaranteeing that the structure will not be occupied
prior to final inspection and permanent release of utilities.
The cash, certified check or cash bond shall be returned to the
applicant at the time the structure has received final
inspection, however, should the structure be occupied prior to
final inspection, said deposit shall be forfeited and paid to the
City to reimburse City for its administrative costs in enforcing
this code and the elctrical service shall be disconnected until
•such a time as the building has received final inspection and
authorization for permanent release of the utilties is granted by
the Building Official."

15.12.270 Addition of Article 105.19.
• Article 105 -19 is added to the National Electrical Code,
hereinbefore adopted in Section 15.12.010, to read:
"105 -19 Fees - Refunds. In the event that any person
shall have obtained an electrical permit and no portion of the
work or construction covered by such permit shall have been com-
menced and such permit shall have been cancelled as provided for
in Article 105 -1(e), the permittee upon presentation to said
Electrical Inspector of a request therfor, in writing on a spe-
cial form, shall be entitled to a refund in an amount equal to 80
percent of the permit fee actually paid for such permit.
The Electrical Inspector shall satisfy himself as to the
right of such applicant to such refund and each such refund shall
be paid as provided by law for the payment of claims against the
Article 110 -5 of the National Electrical Code, herein-
before adopted in Section 15.12.010 is amended to read as
follows:
"110 -5 - Conductors normally used to carry current shall
be of copper (6# AWG and larger may be aluminum). Where the
conductor material is not specified, the sizes given in this code
shall apply to copper conductors. Where other materials are
used, the size shall be changed accordingly.
For aluminum and copper clad aluminum conductors, see

15.12.290 Amendment to Article 210 -1.
. Article 210 -1 of the National Electrical Code, herein -
before adopted in Section 15.12.010 is amended to read-
"210-1 Scope - The provisions of this Article shall
apply to branch circuits supplying lighting or appliance loads or
combinations of such loads. Where motors, or motor - operated
appliances, are connected to any circuit supplying lighting or
other appliance loads, the provisions of both this Article and
Article 430 shall apply. Article 430 shall apply where branch
circuit supplies only motor loads.
(a) Accessory uses or other buildings, signs, etc.,
separately located on the same lot or premises shall have
connecting conductors run underground. (Agricultural areas
excepted.)
(b) Where spare circuit protective devices are provided
• or space for future circuit protective devices is provided on the
buss in any flush or semi -flush mounted panel, then raceways of
sufficient capacity to permit utilization of such space or spaces
shall be provided to an approval accessible location. Such
accessible location is defined as follows: Where sufficient
attic space is available or underfloor space is available, a
raceway shall terminate conveniently for future use in each such
space. Where this condition does not exist, then such termina-
tions shall be approved by the Electrical Inspector.
15.12.300 Amendment to Article 210- 52(f).
Article 210 -52(f) of the National Electrical' Code,
hereinbefore adopted in Section 15.12.010, is amended by the
addition of Exceptions No. 1, No. 2 and (g) to read as follows:
•"EXCEPTION No. 1. Garages or carports accessory to
dwelling units shall be wired with a minimum of one switched

light outlet and one receptacle per each two auto stalls and/or
• fraction thereof. Said wiring, if exposed shall be in approved
metal raceways. All wiring to detached accessory buildings shall
be run underground.
EXCEPTION No. 2. In hotel, motel and multiple occupan-
cies, receptacle may be omitted.
(g) Minimum Wire Size. For the supply of current to
general appliance and convenience receptacle circuits, no
conductor smaller than No. 12. A.W.G. shall be installed. No
convenience receptacle or applicance receptacle shall be
installed or operated on a general lighting branch circuit at any
time in any occupancy unless switched."
15.12.310 Amendment to Article 210- 70(a).
Article 210 -70(a) of the National Electrical Code
hereinbefore adopted in Section 12.15.010 is amended by the
• deletion of the word "attached" and now reads as follows:
(a) Dwelling -Type Occupancies: At least one wall switch
controlled lighting outlet shall be installed in every habitable
room, in hallways, stairways, garages, carports, and at outdoor
entrances.
15.12.320 Amendment to Article 220 -3.
Article 220 -3. of the National Electrical Code, herein -
before adopted in Section 15.12.010, is amended by adding Article
220 -3(e) to read as follows:
"No convenience receptacle or appliance receptacle shall
be installed or operated on a general lighting branch circuit at
any time in any occupancy. A one -half hot and one -half switched
receptacle may be installed on a lighting branch circuit when
used as the lighting outlet required for habitable rooms permitt-
ed in 210 -70.

(a) Exception No. 1. A maximum of 12 convenience recep-
tacle outlets or 12 lighting outlets to any one circuit.
]L5.12.330 Amendment to Article 230 -43.
Article 230 -43. Article 230 -43 of the National
Electrical Code, hereinfore adopted in Section 15.12.010, is
amended to read as follows:
Article 230 -43 Wiring Methods for 600 Vots, Nominal or
Less. Service - entrance conductors shall be installed in accor-
dance with the applicable requirements of this Code covering the
type of wiring method used and limited to the following methods:
(2) rigid metal conduit; (6) wireways, (7) busways; (8)
auxiliary gutters; (9) rigid non - metalic conduit (Delete 1, 3, 4,
5, 10, 11, 12).
15.12.340 Amendment to Article 230- 71(a).
Article 230 -71(a) of the National Electrical Code,
• hereinbefore adopted in Section 15.12.010, is amended to read:
"230 -71(a) Disconnection from service conductors. A
single fusible switch or automatic circuit breaker shall be
provided to disconnect all underground conductors supplying each
separately metered occupancy.
15.12.350 Amendment to Article 250 -83.
Article 250 -83 of the National Electrical Code, herein -
before adopted in Section 15.12.010, is amended to read:
"250 -83 Made Electrodes. Where electrodes described in
Article 250 -81 and 250 -82 are not available, the grounding elect-
rode shall consist of:
(a) Not less than 20 feet of bare coper conductor nor
smaller than No. 4; or not less than 20 feet of No. 4 steel rein-
forcing bar; or an approved equal installed as follows:

• The electrode shall be located in the bottom of the
foundation footing with minimum concrete encasement of 3
inches. One end of the electrode shall extend out of the
foundation adjacent to the equipment to be grounded to permit the
grounding conductor to be secured by an approved method.
EXCEPTION: Where the above method is not practical, the
following electrodes may be used upon approval of the enforcing
authority:
(b) Plate Electrodes. Each plate electrode shall present
not less than 2 square feet of surface to exterior soil. Elect-
rodes of iron or steel plates shall be a least 1/4 inch in thick-
ness. Electrodesofnon- ferrousmetalshallbeatleast0.06
inches in thickness.
(c) Rod Electrodes. Approved rod of non - ferrous mater-
ials or their approved equivalent used for electrodes shall be
not less than 1/2 inch in diameter.
15.12.360 Amendment to Article 250- 91(b).
Article 250 -91(b) of the National Electrical Code,
hereinbefore adopted in Section 15.12.010, is amended to read:
EXCEPTION No. 1. No flexible metal conduit shall be
permitted for grounding.
15.12.370 Amendment to Article 300 -2(b) and (c).
Article 300 -2(b) and (c) of the National Electrical
Code, hereinbefore adopted in Section 15.12.010, is amended to
read:
"300 -2. Wiring in Duct, Plenums, and other Air - Handling
Spaces.
(b), Ducts or Plenums Used for Environmental Air. Only
• wiring methods consisting of teflon insulated cable, electrical
metallic tubing, flexible metal tubing, intermediate metal con-

duit, or rigid metal conduit shall be installed in ducts or ple-
nums used for environmental air. Flexible metal conduit and
liquid tight flexible metal conduit shall be permitted, in
lengths not to exceed 4 feet (1.22m), to connect physically
adjustable equipment and devices permitted to be in these ducts
and plenum chambers. The connectors used with flexible metal
conduit shall effectively close any openings in the connection.
Equipment and devices shall be permitted within such ducts or
plenum chambers only if necessary for their direct action upon,
or sensing of, the contained air. Where equipment or devices are
installed and illumination is necessary to facilitate maintenance
and repair, enclosed gasket -type fixtures shall be permitted.
The above applies to ducts and plenums specifically
fabricated to transport environmental air.
(c) Other Space Used for Environmental Air. Only tef-
• lon insulated cable or other power cable which is specifically
listed for the use shall be used for wiring in systems installed
in other space used for environmental air. 'Other type cables and
conductor shall be installed in electrical metallic tubing, flex-
ible metallic tubing, intermediate metal conduit, rigid metal
conduit, metal surface raceway or wireway with metal covers where
accessible, or flexible metal conduit. Electric equipment that
is permitted within a building concealed space shall be permitted
to be installed in other space used for environmental air if the
associated wiring material and fixtures are suitable for the
ambient temperature.
The above applies to other spaces such as spaces over
hung ceilings which are used for environmental air - handling pur-
• poses.

EXCEPTION No. 1. Liquidtight flexible metal conduit in
single lengths not exceeding 6 feet (1.83m).
EXCEPTION No. 2. Integral fan systems specifically
indentified for such use.
EXCEPTION No. 3. This section does not include habit-
able rooms or areas of buildings, the prime purpose of which is
not air handling.
EXCEPTION No. 4. Listed prefabricated cable assemblies
of metallic manufactured wiring systmes without non - metallic
sheath shall be permitted where listed for this use.
EXCEPTION No. 5. This section does not include the
joist or stud spaces in dwelling units when wiring or equipment
passes through such spaces perpendicular to the long dimension of
such spaces.
15.12.380 Amendment to Article 300- 13(b).
Article 300 -13(b) of the National Electrical Code,
hereinbefore adopted in Section 15.12.101, is amended to read:
11300 -13(b) - In all circuits the continuity of
conductors shall not be dependent upon device connections, such
as lamp holders, receptacles, etc. where the removal of such
devices would interrupt the continuity.
15.12.390 Amendment to Article 334.
Deletion of Article 334 of the National Electrical Code
in its entirety.
15.12.4O0 Amendment to Article 336.3.
Article 336.3 of the National Electrical Code, herein -
before adopted in Section 15.12.010, is amended to read:
"336 -3 Use - Non - metallic sheathed cable shall not be
used for exposed wiring and shall only be used for concealed
• wiring on single family or duplex dwelling as follows:

(a) Type NM. This type of non - metallic sheathed cable
• may be installed for concealed work in normally dry locations.
It may be installed or finished in air voids in masonry block or
tile walls where such walls are not exposed or subject to exces-
sive moisture or dampness. Type NM cable shall not be installed
where exposed to corrosive fumes or vapors; nor shall it be
embedded in masonry or concrete and covered with plaster or
similar finish.
(b) Moisture and Corrosion - Resistant Type NMC. This
type of non - metallic sheathed cable may be installed for conceal-
ed work in dry, moist, damp or corrosive locations, and in out-
side and inside walls of masonry block or tile. Where embedded
in plaster or run in shall chase in masonry walls and covered
with plaster within two inches of the finished surface, it shall
be protected against damage from nails by a cover of corrosion-
isresistant coated steel at least 1/16 inch in thickness and 3/4
inch wide in the chase or under the final surface finish.
15.12.410 Amendment to Article336 -6 eliminated.
15.12.420 Amendment to Article 345 -3(b).
Aritcle 345 -3(b) of the National Electrical Code,
hereinbefore adopted in Section 15.12.010 is amended to read:
"345 -3(b) - of the Code is hereby deleted."
15.12.430 Amendment to Article 346 -1(c).
Article 346 -1(c) of the National Electrical Code,
hereinbefore adopted in Section 15.12.010 is amended to read-
346-1(c) - of the Code is hereby deleted.

Article 348 -1 of the National electrical Code, herein-
before adopted in Section 15.12.010 is amended to read: -
11348 -1 Use - Electrical metallic tubing may be used for
both exposed and concealed work inside of structures. Electrical

metallic tubing shall not be installed in a manner which will
• cause it to be exposed to the outside air or weather
conditions. Electrical metallic tubing protected from corosion
soley by enamel shall not be used. Electrical metallic tubing
shall not be used (1) where during installation or afterwards, it
will be subject to severe physical damage; (2) for installation
underground or in concrete. Where practicable the use of
dissimilar metals throughout the system shall be avoided to
eliminate the possibility of galvanic action. (See Article 300 -4
for limitation in the use of ferrous raceways and fittings
protected form corrosion solely by enamel.
15.12.450 Amendment to Article 350 -2.
Article 350 -2 of the National Electrical Code, herein -
before adopted in Section 15.12.010, is amended to read:
"350 -2 Use - Flexible metal conduit shall not be used
• (1) in wet locations unless conductors are of the lead covered
type oe of other type specifically approved for the conditions:
(2) in hoistways, except as provided in Article 620 -21; (3) in
storage battery rooms; (4) in any hazardous location except as
permitted in Article 501 -4(b), 502 -4 and 503 -3; nor (5) where
rubber- covered conductors are exposed to oil, gasoline, or other
materials having a deteriorating effect on rubber; (6) for
installation underground, exposed to the water, embedded in ma-
sonry, concrete, adobe, plaster or similar finish; (7) where
exposed to physical damage.

Article 350 -5 of the National Electrical Code, herein -
before adopted in Section 15.12.010, is amended to read:
•"350 -5 Grounding - Flexible metal conduit shall not be

• Article 410 -8 of the National Electrical Code, herein -
before adopted in Section 15.12.010, is amended by adding the
following:
(c) All lighting outlets shall be operated by a wall or
door switch (no pull chain lighting fixtures permitted).
25.12.480 Amendment to Article 422 -5.
Article 422 -5 of the National Electrical Code, herein -
before adopted in Section 15.12.010 is amended by adding the
following:
(c) In every dwelling unit fixed appliances, such as
garage door openers, food grinders, dishwashers, washing
machines, dryers, laundry tray locations, built -in heaters, or
any other fixed appliances with 1/3 H.P or larger shall be on a
separate branch circuit supplied by a minimum No. 12 A.W.G.
• Wire. Each dwelling unit shall have installed therein an
individaul food waste grinder branch circuit. Said circuit shall
be supplied with a minimum No. 12 A.W.G. and a 20 ampere
indicating typeswitch. Said switch shall be located in the wall
adjacent to the sink.
SECTION 2. This ordinance shall be published once in
the official newspaper of the City, and the same shall be effec-
tive 30 days after the date of its adoption.
