ORDINANCE NO. 84 -19
AN URGENCY ORDINANCE OF THE CITY OF
NEWPORT BEACH REPEALING CHAPTER 10.18 OF
THE NEWPORT BEACH MUNICIPAL CODE
PERTAINING TO FORTUNE TELLING
WHEREAS, Chapter 10.18 of the Newport Beach Municipal
Code prohibits fortune telling uses throughout the City; and
WHEREAS, Court of Appeal recently ruled that a City of
Azusa ordinance, similar to Chapter 10.18, was unconstitutional;
and
WHEREAS, although the ruling is under review by the
California Supreme Court, repeal of the the prohibition against
fortune telling is appropriate, pending a decision in the case.
NOW, THEREFORE, the City Council of the City of Newport
Beach does ordain as follows:
Section 1: Chapter 10.18 of the Newport Beach
Municipal Code is hereby repealed in its entirety.
Section 2: This Ordinance is declared by the City
Council to be necessary as an emergency measure for preserving
the public peace, health, safety and welfare for the reasons
stated herein, and shall take effect immediately.
Section 3: This Ordinance shall be published once in
the official newspaper of the City of Newport Beach.
This Ordinance was introduced at a regular meeting of
the City Council of the City of Newport Beach held on the 27th
day of August, 1984, and was adopted on the 27th day of August,
1984 by the following vote;
