HomeMy WebLinkAbout85-13 - Amending the Provisions of Chapter 20.83 Pertaining to the intensification or Expansion of Non-Conforming UsesORDINANCE NO. 85 -13 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING THE PROVISIONS OF CHAPTER 20.83 PERTAINING TO THE INTENSIFICATION OR EXPANSION OF NON - CONFORMING USES The City Council of the City of Newport Beach DOES ORDAIN as follows: SECTION 1. Sections 20.83.010 and 20.83.020 of the Newport Beach Municipal Code are hereby amended to read as follows: 20.83.010 Non - Conforming Uses. A non - conforming use shall mean the use of land, a building, or a building site which was lawfully in existence on the date this Title was adopted, or • amended, but does not conform to the requirements for the district in which the land or building site is located. Except as provided in Sections 20.83.020, 20.83.030 and 20.83.040, a non - conforming use shall not be enlarged, increased or intensified. If any such use ceases, the subsequent use of such land, building or building site shall be in conformance with the regulations specified by this Title for the districts in which such land is located. 20.83.020 Intensification and Enlargement of Non- Conforming uses. A non - conforming use may be intensified by way of an increase in the hours of operation or in significant change in operational characteristics, enlarged or increased, provided • that the use is permitted by the regulations specified for the district in which it is located, and provided further, that in each case a Use Permit must first be obtained. a This Ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach held on the 13th day of May, 1985, and was adopted on the 28th day of May , 1985 by the following vote: • AYES, COUNCILMEMBERS Agee, Cox, Hart, Heather, Plummer, Strauss NOES, COUNCILMEMBERS ATTEST: • City Clerk ORP /Planning • ABSENT COUNCILMEMBERS Maurer Mayor Pro em 2
