• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ADDING SECTION 5.11.040 OF THE
NEWPORT BEACH MUNICIPAL CODE PERTAINING TO THE
PROHIBITION OF THE SALE OF FOOD PRODUCTS ON PUBLIC
BEACHES.
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1: Section 5.11.040 of the Newport Beach Municipal
Code is hereby added to read as follows:
5.11.040 Sale of Food Products on Public
Beaches Prohibited.
No person shall sell, solicit orders for or
deliver any beverage, food or food product on
any Newport Bay beach or oceanfront beach open
is to the public.

SECTION 2: The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance. The City Clerk shall
cause the same to be published once in the official newspaper
within fifteen (15) days after its adoption. The Ordinance shall
become effective thirty (30) days from its adoption.
This Ordinance was introduced at a regular meeting of
the City Council of the City of Newport Beach, held on
the 23rd
