ORDINANCE NO. 67 -13
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AMENDING SECTION 10.50.060 OF THE
NEWPORT BEACH MUNICIPAL CODE PERTAINING TO
PUBLIC NUISANCE ABATEMENT APPEAL.
The City Council of the City of Newport Beach does hereby
ordain as follows:
10.50.060 Right of Appeal to City Council
Any person who is dissatisfied with any decision of the
enforcement officer shall have the right to appeal to the City
Council within ten (10) days from the date of mailing of the
decision of the enforcement officer by filing a written notice of
appeal with the City Clerk. Upon receiving such a notice of
appeal the City Clerk shall set the matter for consideration by
the City Council at a meeting not more than thirty (30) days
thereafter and shall advise the appellant of the date, time and
place on which the matter will be heard at least ten (10) days
prior to such date.
The City Council of the City of Newport Beach may
preside over the hearing on appeal or, in the alternative,
appoint a hearing officer to conduct the hearing, receive
relevant evidence and to submit to the City Council findings and
recommendations to be considered by the City Council of the City
of Newport Beach. The City Council of the City of Newport Beach
shall render its decision within forty -five (45) days from the
date of the hearing or, in the event that a hearing officer has
been appointed, within forty -five (45) days from the date on
which the City Council receives the findings and recommendations
of the hearing officer. The decision of the City Council shall
be final.

The City Clerk shall notify the property owner of the
decision of the City Council in the same manner as provided in
Section 10.51
