AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH AMENDING
DISTRICTING MAPS NO. 51 AND 52
RECLASSIFYING PROPERTY HEREIN KNOWN AS
"UPPER BUCK GULLY" FROM THE R -1 -B DISTRICT
TO THE O -S(P) DISTRICT.
(Planning Commission Amendment No. 673)
WHEREAS, the City Council of the City of Newport Beach FINDS that
it has considered the determination regarding the proposal's categorical
exemption in making its decision on the proposed amendment to Districting
Maps No. 51 and 52.
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN,
AS FOLLOWS:
SECTION 1. Districting Maps No. 51 and 52 are hereby amended
for the property known as "Upper Buck Gully ", Corona del Mar, as set forth
in Exhibits "A" and "B" attached hereto, as follows:
• Change the zoning designation from the "R -1 -B" District to the "0-
S(P)" District.
Staff is further instructed to enter into an agreement with the
Irvine Company which acknowledges:
1) That no development rights exist for the "Upper Buck Gully"
parcel.
2) The rezoning of the "Upper Buck Gully" parcel to the "Open
Space" [O -S(P)] District is in consideration for the in-
creased density on the "Fifth Avenue" parcel.
3) The increased density on the "Fifth Avenue" parcel is
sufficient compensation for the rezoning of "Upper Buck
Gully" to the "Open Space" [O -S(P)] District.

4) The Irvine Company will grant an open space easement to the
City of Newport Beach over the "Upper Buck Gully" parcel if
requested by the City.
SECTION 2. The Planning Director of the City of Newport Beach
is hereby instructed and directed to change Districting Maps No. 51 and No.
52 referred to in Section 20.01.050 of the Newport Beach Municipal Code and
by such reference made part of Title 20, to reflect the changes described in
Section 1 (above), and when said Districting Maps have been so amended, the
same shall be in full force and effect and be part of Title 20 of the
Newport Beach Municipal Code.
SECTION 3. The Mayor and City Clerk shall attest to the
passage of this ordinance. This Ordinance shall be published once in the
official newspaper of the City, and the same shall become effective thirty
(30) days after the date of its adoption.
This ordinance was introduced at a regular meeting of the City
Council of the City of Newport Beach, held on the 23rd day of January, 1989,
and adopted on the 13th day of February , 1989, by the following vote,
to wit:

Beach County of Orange, State of California, as shown on map recorded in
Book 1, Page 88 of Miscellaneous Maps, records of said county, described as
follows:
Commencing at the westerly corrner of said Block 96 as shown on Parcel Map
84 - -728 filed in Book 197, pages 39, 40, 41 and 42 of Parcel Maps, records
of said County; thence S49 °30'19" E along the southwesterly line of said
block 2203.00 feet to the most easterly corner of Tract No. 673 as shown on
map recorded in Book 20, pages 17 and 18 of Miscellaneous Maps, records of
said County and as shown on said Parcel Map; thence N77 °02'41" E along the
