Also to Amend a Portion of Districting Map No. 11 so as to Establish a Front Yard SetbackORDINANCE NO. 91 -1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING A PORTION OF DISTRICTING MAP NO. 9 SO AS TO ESTABLISH A FRONT YARD SETBACK OF 19 FEET ON LOTS 10 -13, BLOCK 114, TRACT NO. 234 (200 - 20615TH STREET). ALSO TO AMEND • A PORTION OF DISTRICTING MAP NO. 11 SO AS TO ESTABLISH A FRONT YARD SETBACK OF 5 FEET ON THE FOLLOWING LOTS: LOTS 9 -12, BLOCK 3, BALBOA TRACT AND PARCELS NO. 1 AND 2, PARCEL MAP 99 -12 (404 -416 EAST BALBOA BOULEVARD) AND LOTS 10 -12 AND LOT 18, BLOCK 2, NEWPORT BAY TRACT (301 AND 313 -317 EAST BALBOA BOULEVARD) (PLANNING COMMISSION AMENDMENT NO.719) WHEREAS, when Ordinance No. 1484 and Ordinance No. 89 -34, which rezoned two entire blocks and a portion of another from the C -1 district to the R -2 district were adopted, the front yard setbacks for these blocks were not established on the Districting Maps; and WHEREAS, the R -2 district requires a 20 foot front yard setback, except as may be noted on the Districting Maps; and • WHEREAS, many of the properties in the blocks rezoned by these ordinances have use permits that established residential uses and front yard setbacks before the rezoning; and WHEREAS, many of the properties in the affected blocks along Balboa Boulevard have established front yard setbacks of less than 20 feet and the average front yard setback along Balboa Boulevard is 5 feet; and WHEREAS, the properties located on Lots 10 -13, Block 114, Tract No. 234 (200 -206 15th Street) have established front yard setbacks of 19 feet; and WHEREAS, on December 6, 1990, the Planing Commission of the City of Newport Beach held a public hearing regarding Planning Commission Amendment No. 719, and at that time voted to recommend that the City Council approve the amendment; • NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEARBY ORDAIN AS FOLLOWS: SECTION 1. The subject property is the following real property in the City of Newport Beach, County of Orange, State of California: 1 • • • follows: AREA A Lots 10 -13, Block 114, Tract No. 234 (200 -206 15th Street) AREA B Lots 9 -12, Block 3, Balboa Tract and Parcels No. 1 and 2, Parcel Map 99 -12 (404 -416 East Balboa Boulevard) and Lots 10 -12 and Lot 18, Block 2, Newport Bay Tract (301 and 313 -317 East Balboa Boulevard) SECTION 2. Front yard setbacks are established on the Districting Maps as AREA A Districting Map No. 9: 19 feet. AREA B Districting Map No. 11: 5 feet. SECTION 3. The Planning Director of the City of Newport Beach is hereby instructed and directed to change Districting Maps Nos. 9, and 11, referred to in Section 20.01.050 of the Newport Beach Municipal Code, and by such reference is made a part of Title 20, to reflect said change as described in Section 2 hereof, and when said Districting Maps have been so amended, the same shall be in full force and effect and be a part of Title 20 of the Newport Beach Municipal Code. SECTION 4. This Ordinance shall be effective thirty days from and after the date of its adoption. SECTION 5. The Planning Director of the City of Newport Beach is also hereby instructed and directed to apply all of the provisions of said Districts to the Properties as described herein; the same shall be in full force and effect and be a part of Title 20 of the Newport Beach Municipal Code. SECTION 6. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. This Ordinance shall be published once in the official newspaper of the City within fifteen (15) days of its adoption. The Ordinance shall be effective thirty (30) days after the date of its adoption.
