AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH AMENDING DISTRICTING MAP NO. 11
SO AS TO ESTABLISH A NEW FRONT YARD SETBACK
ON THE BAY SIDE OF FOUR PARCELS LOCATED AT
1018 -1024 EAST BALBOA BOULEVARD ON THE NORTHWESTERLY
CORNER OF EAST BALBOA BOULEVARD AND "C" STREET
(PLANNING COMMISSION AMENDMENT NO. 735)
.WHEREAS, on April 22, 1991, the City Council held a public hearing
regarding Variance No. 1173 and denied the application and further requested that the
Planning Department initiate an amendment to Districting Map No. 11 with respect to
establishing a new front yard setback along the bay side property line of parcels on the north
side of East Balboa Boulevard between "B" Street and "C" Street; and
WHEREAS, it is desirable that a new front setback line be established,
located northerly 74.5 feet distant and parallel to the northerly right -of -way line of East
Balboa Boulevard, which will be consistent with the existing and proposed encroachments
on the subject four parcels; and
WHEREAS, the proposed setback along and across the original northerly lot
lines of the four subject parcels, is compatible with the allowable scale of development in
• the R -2 District and the adjacent R -3 District; and
WHEREAS, the establishment of the proposed front yard setback on the
subject properties will not obstruct any public or private views from surrounding property
and will create equitable levels of view preservation for the properties involved.
WHEREAS, on May 23, 1991, the Planning Commission of the City of
Newport Beach held a public hearing regarding Amendment No. 735, and at that time voted
to recommend that the City Council approve the Amendment; and
WHEREAS, on June 24, 1991, the City Council of the City of Newport Beach
held a duly noticed public hearing regarding this ordinance;
NOW THEREFORE BE IT RESOLVED, that the City Council of the City
of Newport Beach does hereby approve Amendment No. 735 to Districting Map No. 11 so
• as to establish a new front yard setback on the bay side of the four parcels in question.
SECTION 1. , The following described real property in the City of Newport
Beach, County of Orange, State of California,
Parcels 1 and 2 of Parcel Map 79 -18 (Resubdivision No. 509); Lots 10 and 11
and a portion of Lot 14, Block 15, East Side Addition to the Balboa Tract;
and a portion of Lot 9, Block J, Bay Front Section, located at 1018 -1024 East
Balboa Boulevard, on the northwesterly corner of "C" Street and East Balboa
Boulevard on the Balboa Peninsula.

as shown on Districting Map No. 11, referred to in Section 20.01.050 of the Newport Beach
Municipal Code, and by such reference made a part of Title 20 of said Code, is hereby
amended to designate a front yard setback, defined by a parallel line located a distance of
74.5 feet from the northerly right -of -way line of East Balboa Boulevard on said lots as
referenced above:
SECTION 2. The Planning Director of the City of Newport Beach is hereby
• instructed and directed to change Districting Map No. 11 referred to in Section 20.01.050
of the Newport Beach Municipal Code and by such reference made part of Title 20, to
reflect the changes described in Section 1 above, and when said Districting Map has been
so amended, the same shall be in full force and effect and be part of Title 20 of the
Newport Beach Municipal Code.
SECTION 3: The Mayor shall sign and the City Clerk shall attest to the
passage of this Ordinance. This Ordinance shall be published once in the official newspaper
of the City, and the same shall become effective thirty (30) days after the date of its
adoption.
This Ordinance was introduced at a regular meeting of the City Council of the City
of Newport Beach held on the 10th day of June, 1991, and adopted on the 24th day of June,
• 1991, by the following vote, to wit:
