AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AMENDING SECTION 1.12.020 OF
CHAPTER 1.12 OF THE NEWPORT BEACH MUNICIPAL
CODE PERTAINING TO THE AUTHORITY OF PUBLIC
OFFICERS OR EMPLOYEES TO ISSUE CITATIONS.
The City Council of the City of Newport Beach does hereby
• ordain as follows:
SECTION 1: Section 1. 12.020 of Chapter 1.12 of the Newport
Beach Municipal Code is amended to read:
1.12.020 Authority Of Public officers Or Employees To Issue
Citations. The following designated public officers and employees
shall have the power to issue citations for violations of the
provisions of this Code (either as a misdemeanor or infraction)
hereinafter provided:
(1) Animal Control Officers shall have the power to
issue citations for any violation of Title 7 of this Code, entitled
"Animals ", or Section 10.12.010.
(2) Parking Control Officers and Police Cadets shall
inhave the power to issue citations for any violation of Title 12 of
this Code, entitled "Vehicles and Traffic ", and for any violation
of the following sections of the California Vehicle Code: Section
4000 entitled "Registration Required ", Section 4454 entitled
"Registration Card Kept With Vehicle ", Section 5200 entitled
"Display Of License Plates ", Section 5201 entitled "Positioning Of
Plates ", Section 5202 entitled "Period Of Display ", Section 5204
entitled "Tabs ", Section 22500 entitled "Prohibition Of Stopping,
Standing Or Parking ", Section 22502 entitled "Curb Parking ",
Section 22505 entitled "State Highway Parking ", Section 22514
entitled "Fire Hydrants ", Section 22515 entitled "Unattended
Vehicles ", Section 22516 entitled "Locked Vehicles ", Section 22520
• entitled "Stopping On Freeway ", and Section 22700 entitled
"Abandonment Prohibited."
(3) The Marine Director and members of the staff of the
Marine Department, as specifically designated by the Marine
Director, shall have the power to issue citations for any violation
of Chapter 5 of Division 3 of the California Harbors and Navigation
Code Title 11 of this Code, entitled "Recreational Activities ",

Title 17 of this Code entitled "Harbor Regulations ", and Chapter
7.04 of this Code entitled "Dogs ", Chapter 7.16 of this Code
entitled "Animals At Large" and Chapter 7.20 of this Code entitled
"Animal Nuisances", and shall have the power to issue citations for
violations of the following sections of this Code: Section
• 6.04.060 "Improper Garbage Disposal ", Section 6.04.200 "Tampering
With Public Refuse Containers ", and Section 10.06.010 "Human
Waste."
(4) The Marina Park Manager shall have the power to
issue citations for any violation of Chapter 12.40 of the Newport
Beach Municipal Code, entitled "Stopping, Standing And Parking
Regulations ", relating to parking of vehicles.
(5) The Revenue Manager, License Supervisor and all
License Inspectors shall have the power to issue citations for any
violation of Title 3 of this Code, entitled "Revenue And Finance,
Title 5 of this Code, entitled "Business License and Regulations ",
Title 6 of this Code, entitled "Health And Sanitation ", Title 10 of
this Code, entitled "Offenses And Nuisances ", and shall have the
• power to issue citations for violations of Section 12.40.060 of
this Code, entitled "Parking For Certain Purposes Prohibited ",
Chapter 12.62 of this Code, entitled "Temporary Street Closure" and
Chapter 12.63 of this Code, entitled "Commercial Refuse Bins."
(6) The General Services Director and such Department
employees as he or she may designate in writing, shall have the
power to issue citations for any violations of Chapter 6.04 of this
Code.
(7) The Code Enforcement Supervisor and Code Enforcement
Officers shall have the power to issue citations for any violation
of Title 20 of this Code, entitled "Planing And Zoning."
(8) The Building Director and the Chief Building
• Inspector shall have the power to issue citations for any violation
of Title 15 of this Code, entitled "Building And Construction."
(9) The Fire Chief and members of the staff of the Fire
Department, as specifically designated by the Fire Chief, shall
have the power to issue citations for any violations of Title 9 of
this Code, entitled "Fire Code ", a violation of Sections 22500.1
and 22514 of the California Vehicle Code, any violation of other

state or local laws related to fire suppression or fire prevention,
and any violation of the state or local laws pertaining to the
handling, use, storage or disposal of hazardous materials or waste.
SECTION 2: That if any section, subsection, sentence,
clause or phrase of this ordinance is for any reason, held to be
• invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this
ordinance. The City Council hereby declares that it would have
passed this ordinance, and each section, subsection, clause or
phrase hereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses and phrases be declared
unconstitutional.
SECTION 3: The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The City Clerk shall
cause the same to be published once in the official newspaper of
the City, and it shall be effective thirty (30) days after its
adoption.
SECTION 4: This ordinance was introduced at a regular
• meeting of the City Council of the City of Newport Beach, held on
the 13th day of January , 1992, and adopted on the 27th day of
January 1992, by the following vote, to wit:
