HomeMy WebLinkAbout92-14 - Amending a Portion of Districting Map No. 10 so as to Reclassify the Property Located At 706 and 708 West Balboa Boulevard and 717 West Bay Avenue, from the R-1 and R-2 Districts to the O-S (Open Space) District (Planning Commission Amendment No.ORDINANCE NO. 92 -14 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING A PORTION OF DISTRICTING MAP NO. 10 SO AS TO RECLASSIFY THE PROPERTY LOCATED AT 706 AND 708 WEST BALBOA BOULEVARD AND 717 WEST BAY AVENUE, FROM THE R -1 AND R -2 DISTRICTS TO THE O -S (OPEN SPACE) DISTRICT • (Planning Commission Amendment No. 751) WHEREAS, the Planning Commission has conducted public hearings on March 19, 1992 and on April 9, 1992, at which time this amendment to Districting Map No. 10 was discussed and determined to be in conformance with the Newport Beach General Plan and compatible with the surrounding land uses, inasmuch as the proposed parking lot expansion is not an intensification of use of the adjacent Newport Harbor Yacht Club; and WHEREAS, the approval of this zone change amendment will allow for the future development of the subject properties in a manner which will be consistent with the existing off -site parking lot associated with the Newport Harbor Yacht Club; and WHEREAS, the approval of this zone change amendment has been conditioned so as to alleviate any adverse impacts associated with the elimination of the • residential units and the expansion of the parking lot; and WHEREAS, the project has been determined to Categorically Exempt from the provisions of the California Environmental Quality Act (CEQA). WHEREAS, on April 9, 1992, the Planning Commission of the City of Newport Beach held a public hearing regarding Amendment No. 751, and at that time voted to recommend that the City Council approve the amendment; and WHEREAS, on May 11 1992, the City Council of the City of Newport Beach held a duly noticed public hearing regarding this ordinance; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach does hereby approve Amendment No. 751, as further set forth in the attached Planning Commission minutes dated March 19, 1992 and April 9, 1992. • SECTION 1: The following described real property in the City of Newport Beach, County of Orange, State of California, Lot 11, Block 5, East Newport, located at 717 West Bay Avenue, on the southerly side of West Bay Avenue, between 7th Street and 8th Street; and Lots 25 and 26, Block 5, East Newport, located at 706 and 708 West Balboa Boulevard, on the northerly side of West Balboa Boulevard, between 7th Street and 8th Street, on the Balboa Peninsula as shown on Districting Map No. 10, referred to in Section 20.01.050 of the Newport Beach Municipal Code and by such reference made part of Title 20 of said Code, is hereby amended to change the zoning designation from the R -i and R -2 Districts to the O -S (Open Space) District. •SECTION 2: The Planning Director of the City of Newport Beach is hereby instructed and directed to change Districting Map No. 10 referred to in Section 20.01.050 of the Newport Beach Municipal Code and by such reference made part of Title 20, to reflect the changes described in Section 1 (above), and when said Districting Map has been so amended, the same shall be in full force and effect and be part of Title 20 of the Newport Beach Municipal Code. SECTION 3: The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the same shall become effective thirty (30) days after the date of its adoption.
