AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AMENDING TITLE 20 OF THE
MUNICIPAL CODE SO AS TO AMEND CHAPTER 20.33
(COMMERCIAL DISTRICT REGULATIONS) TO PERMIT
FREE - STANDING ANCILLARY COMMERCIAL USES IN
THE ADMINISTRATIVE, PROFESSIONAL, AND
FINANCIAL COMMERCIAL (APF) DISTRICT; TO AMEND
CHAPTERS 20.68 AND 20.79 TO PROVIDE CONSISTENT
• USE OF THE TERMS "ACCESSORY" AND "ANCILLARY;'
AND TO AMEND CHAPTER 20.87 TO ADD A
DEFINITION FOR THE TERM "USE- ANCILLARY:'
(PLANNING COMMISSION AMENDMENT NO. 774)
WHEREAS, The Administrative, Professional, & Financial District was established
to provide areas which are predominantly used for offices, but which also accommodate
support retail and service uses; and
WHEREAS, the mixture of office and commercial uses is seen as beneficial to the
Administrative, Professional, & Financial District, provided that office development remains
the predominate use; and
WHEREAS, it was the intent that the mixture of office uses and support retail and
service uses apply to a greater commercial office area, as well as to individual properties,
provided such commercial development continues to remain subordinate to the overall office
development; and
WHEREAS, amendment of the Zoning Code is required to clarify these concepts;
• and
WHEREAS, on September 24, 1992, the Planning Commission of the City of
Newport Beach held a public hearing regarding Amendment No. 772, and at that time voted
to recommend that the City Council approve the amendment; and
WHEREAS, on November 9 . 1992, the City Council of the City of Newport Beach
held a duly noticed public hearing regarding this ordinance;
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of
Newport Beach does ordain as follows:
SECTION 1. Section 20.33.070 (C) of the Newport Beach Municipal Code is hereby
amended to read as follows:
C. ADMINISTRATIVE, PROFESSIONAL, AND FINANCIAL
COMMERCIAL (APF) DISTRICT.
1. Intent
It is the intent of the APF District to provide areas which are
• predominantly used for offices but which also accommodate support
retail and service uses.
2. Special Controls
Notwithstanding the provisions of Section 20.33.045 A, a fifteen
foot front yard setback shall be maintained on all property
located in the APF District except where otherwise specified on
the Districting Maps. (Ord. 90 -41; December 13, 1990).

SECTION 2. Section 20.68.020 of the Newport Beach Municipal Code is hereby
amended to read as follows:
20.68.020 Massage Establishments As An Aftei14 °: Use. A
massage establishment which is operated as an a " "
use in
conjunction with an approved health club, athletic club, gym, or hotel which
is or will be operated pursuant to an approved use permit; or in conjunction
with a medical office or chiropractic office which is regulated by State law,
shall be permitted in any District where the primary use is permitted. For
the purpose of this Section, an mkiilary WO use shall mean a use which
is not more than twenty -five percent of the floor area of the related health or
athletic activities of the primary use. (Ord. 922, March 25, 1992).
SECTION 3. Section 20.79.015 of the Newport Beach Municipal Code is hereby
amended to read as follows:
20.79.015 DEFINITION. The following term used in this
Chapter shall have the meaning indicated herein:
Second Family Residential Unit. A dwelling unit aaeiHar-y �3 . to and
either attached to, detached from, or contained within the primary dwelling
unit on a building site. (Ord.8839, November 23, 1988).
SECTION 4. CHAPTER 20.87 of the Newport Beach Municipal Code is hereby
amended to read as follows:
SECTION S. The Mayor shall sign and the City Clerk shall attest to the passage of
this Ordinance. This Ordinance shall be published once in the official newspaper of the
City, and the same shall become effective thirty (30) days after the date of its adoption.
SECTION 6. This Ordinance was introduced at a regular meeting of the City
Council of the City of Newport Beach held on the 12th day of October, 1992, and adopted
on the 9th day of November 1992, by the following vote, to wit:
