AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH, AMENDING TITLE 20
OF THE NEWPORT BEACH MUNICIPAL CODE
AMENDING DISTRICTING MAP NO. 3, SO AS TO ESTABLISH
A 2.85 FOOT FRONT YARD SETBACK ON 3 LOTS FROM
• THE EXISTING 10 FOOT WIDE CLUBHOUSE AVENUE
EASEMENT ADJACENT TO THE BULKHEAD
ON THE RIVO ALTO CHANNEL
(Planning Commission Amendment No. 775)
WHEREAS, Section 20.84.010 of the Municipal Code of the City of Newport
Beach provides that Title 20 (the Zoning Code) may be amended by changing the zoning
designation of Districts and other provisions whenever the public necessity and convenience
and the public welfare require such amendment; and
WHEREAS, the proposed 2.85 foot front yard setback on the three parcels
in question will be consistent with the front yard setback existing on the subject property
located at 400 Clubhouse Avenue; and
.WHEREAS, the project has been determined to be Categorically Exempt
from the provisions of the California Environmental Quality Act (CEQA) under Class 5
(Minor Alterations in Land Use Limitations); and
WHEREAS, pursuant to Section 20.84.030, the Planning Commission has held
a duly noticed public hearing to consider Amendment No. 775, amending a portion of
Districting Map No. 3; and
WHEREAS, on March 18, 1993, the Planning Commission of the City of
Newport Beach held a public hearing regarding Amendment No. 775;
WHEREAS, on April 26 1993, the City Council of the City of Newport
Beach held a public hearing regarding Amendment No. 775.
NOW THEREFORE, the City Council of the City of Newport Beach does
• hereby ordain as follows:
SECTION 1: The following described real property in the City of Newport
Beach, County of Orange, State of California,
Lot 1, Block 432, Canal Section and an abandoned portion of Clubhouse Avenue,
located at 400, 400 1/2, and 402 Clubhouse Avenue, on the northeasterly side of
Clubhouse Avenue, between the Rivo Alto Channel and Finley Avenue, in West
Newport,
as shown on Districting Map No. 3, referred to in Section 20.01.050 of the Newport Beach
Municipal Code and by such reference made part of Title 20 of said Code, is hereby
amended so as to delete the existing 3 foot front yard setbacks measured from the original
lot line of the subject properties, and that a 2.85 foot front yard setback be established on
Districting Map No. 3 measured from the southwesterly Clubhouse Avenue frontage of the
subject properties as established by abandonment of a portion of the Clubhouse Avenue
• right -of -way with a reservation of a minimum 10 foot wide right -of -way for future City use.
SECTION 2: The Planning Director of the City of Newport Beach is hereby
instructed and directed to change Districting Map No. 3 referred to in Section 20.01.050 of
the Newport Beach Municipal Code and by such reference made part of Title 20, to reflect
the changes described in Section 1 above, and when said Districting Map has been so
amended, the same shall be in full force and effect and be part of Title 20 of the Newport
Beach Municipal Code.
SECTION 3: The Mayor shall sign and the City Clerk shall attest to the
passage of this Ordinance. This Ordinance shall be published once in the official newspaper
of the City, and the same shall become effective thirty (30) days after the date of its
adoption.
• SECTION 4. This Ordinance was introduced at a regular meeting of the City
Council of the City of Newport Beach, held on the 12th day of April , 1993, and was
