AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF NEWPORT BEACH AMENDING
SECTIONS 2.12.0101 2.12.060, 2.12.070,
AND DELETING SECTION 2.12.090 OF
CHAPTER 2.12, AND AMENDING SECTIONS
• 13.08. 13.08.020, 13.08.050 OF
CHAPTER R 13 13.08 AND SECTION 11.04.030
OF CHAPTER 11.04, AND SECTION 19.24.110
OF CHAPTER 19.24 OF THE NEWPORT BEACH
MUNICIPAL CODE PERTAINING TO THE
CREATION OF A COMMUNITY SERVICES
DEPARTMENT.
The City Council of the City of Newport Beach does hereby
ordain as follows:
SECTION 1: Sections 2.12.010, 2.12.060, 2.12.070 of Chapter
2.12 of the Newport Beach Municipal Code are hereby amended to
read:
2.12.010 Departments Designated. The administrative
service of the City is divided into the following
departments:
Building Department
® Community Services Department
Finance Department
Fire Department
General Services Department
Marine Department
Planning Department
Police Department
Public Works Department
Utilities Department

1382 § 1 (part), 1971).
2.12.060 General Services Department. The General
Services Department shall be under the supervision of the
General Services Director. The functions of the General
Services Department shall include:
(a) Street and beach cleaning.
® (b) Refuse and garbage collection and disposal.
(c) Maintenance and repair of streets, alleys, curbs,
sidewalks, storm drains, bridges, piers, bulkheads and
floats.
(d) Maintenance and repair of City equipment.
(e) operation of City sign shop and carpenter shop.
(f) Street striping, barricade, curb, crosswalk,
parking stall, and pavement painting.

(g) Street name, traffic, and regulation sign posting
maintenance.
(h) Custodial maintenance and minor repair services
for City -owned and occupied buildings and facilities.
(i) Landscaping and maintenance of City parks,
parkway trees, and planted areas on City -owned property,
easements and rights -of -way.
2.12.070 Community Services Department. The Community
Services Department shall be under the supervision of the
Community Services Director /City Librarian. The
functions of the Community Services Department shall
include:
(a) Advising the Board of Library Trustees.
(b) Advise and liaison to the Parks, Beaches and
Recreation Commission.
(c) operation and management of the City's libraries,
including selection, organization and dissemination of
materials in all formats - print, multi- media, electronic
publishing.
(d) Planning coordination and direction of community
recreational and cultural activities.
(e) operation and control of all parks and
recreational facilities over which the City exercises
jurisdiction.
(f) Master planning for the acquisition and
development of park and recreational facilities.
SECTION 2: Section 2.12.090 of Chapter 2.12 is hereby
deleted:
SECTION 3: Section 11.04.030 of Chapter 11.04 and Sections
13.08.010, 13.08.020, 13.08.050 of Chapter 13.08 and Section
19.24.110 of Chapter 19.24 are hereby amended to read:
11.04.030 Use of Parks at Night. Parks shall be closed
between the hours of 11:00 p.m. and 6:00 a.m. of the following
day. No person shall remain in any park during the prohibited
hours. Parks may remain open at the discretion of the Community
Services Director.
13.08.010 Jurisdiction and Authority. Subject to the
administrative control established by the City Charter,
and any applicable City Council Policy, the provisions of
this Chapter, the General Services Department shall
exercise jurisdiction and control over the planting,
maintenance, and removal of trees, shrubs, and plants in
all public areas under the control of the City, and shall
have the authority and duties prescribed in this Chapter.

•13.08.020 Official Tree List. The City Council shall
adopt an official tree list which shall set out the names
of the streets in the City and the species of tree or
trees that may be planted on each such street or portion
thereof. The list shall be adopted by resolution and
three copies thereof shall be kept on file in the office
of the City Clerk for inspection by the public, and
copies shall be available in the General Services
Department for information. (Ord. 1634 § 1 (part), 1975:
Ord. 1015 (part), 1962: 1949 Code § 7302).
13.08.050 Prohibited Activities. A. PLACING ROPE,
WIRE, POSTERS, ETC. No person shall place or affix any
rope, wire, sign, poster, or other object on any tree,
shrub, or plant, or upon any guard device protecting
same, located upon the public street right -of -way or
upon other public property.
• B.DEPOSITING DETRIMENTAL SUBSTANCE. No person shall
deposit or throw upon any public street right -of -way or
other public property any substance detrimental to the
growth of any tree, shrub, or plant.
C.REMOVING GUARD OR PROTECTIVE DEVICE. No person shall
remove or damage any guard or device placed to protect
any tree, shrub, or plant growing in any public street
right -of -way or upon other public property.
D.ATTACHING ELECTRICAL APPARATUS. No person shall
attach any electric wires or any device for holding
electric wires to any tree, plant or shrub growing in any
public street right -of -way or other public property under
the control of the City without approval of the City
Council. No person shall, without written permission
from the Director of General Services, trim, cut or break
• any part of such tree, shrub, or plant in order to make
passage for electric wires.
19.24.110 Street Trees. Street trees shall be required
and planted in accordance with specifications established
by the General Services Department. A $4.00 inspection
fee will be charged for the installation of every tree.
The fee is payable upon approval of the final tract map.

SECTION 4: That if any section, subsection, sentence,
clause or phrase of this Ordinance is for any reason,
held to be invalid or unconstitutional, such decision
shall not affect the validity or constitutionality of the
• remaining portions of this Ordinance. The City Council
hereby declares that it would have passed this Ordinance,
and each section, subsection, clause or phrase hereof,
irrespective of the fact that any one or more sections,
subsections, sentences, clauses and phrases be declared
unconstitutional.
SECTION 5: The Mayor shall sign and the City Clerk
shall attest to the passage of this Ordinance. The City
Clerk shall cause the same to be published once in the
official newspaper of the City, and it shall be effective
thirty (30) days after its adoption.
SECTION 6: This Ordinance was introduced at a regular
meeting of the City Council of the City of Newport Beach,
held on the 22nd day of November , 1923 , and adopted
on the 13th day of December , 1993 , by the following
