PROJECT SUMMARY
On May 20, 2010, the appellant appealed the Zoning Administrator's decision to
approve Condominium Conversion No. CC2010 -005, Parcel Map No. NP2010 -003, and
Modification No. MD 2010 -008, which allows for a condominium conversion of an existing
duplex, and for the width of the required parking spaces for the project to be less than the
minimum requirements required by the Zoning Code.
On July 23, 2010, the appellant withdrew the appeal (Attachment No. PC 1), which
obviates the requirement for a public appeal hearing.
RECOMMENDATION
1) Planning Commission motion finding that the appellant's withdrawal of the appeal
obviates the requirements for a public appeal hearing, that no further action is
necessary, and the Zoning Administrator's action is final.

Dear Mr. Lepo:
As you know, I have appealed the captioned matter for review by the Planning Commission.
Based upon the Department's representations, I had understood that the hearing would be on or after
August 19, 2010. I note that the Department appears ready to set this matter for hearing on August 5,
2010. Twill not be prepared to present this appeal on August 5, 2010, and I do not understand why the
Department has advanced this bearing.
In addition, the appeal contends that a specific plan applies to the captioned property. However,
after a more full review of the specific plan, it appears that it will not apply to captioned property upon
sale of the property to a third party. Hence, I hereby withdraw the appeal. .
