Definitions
• Bulkhead Line. The term "Bulkhead Line" shall mean the harbor land /water perimeter lines
established in Newport Harbor by the federal government which define the permitted limit of filling
or solid structures that may be constructed in the Harbor. The establishment of Bulkhead Lines
does not necessarily allow the property owner to build to the limits of the Bulkhead Line due to
potential environmental considerations established by the State of California and /or the federal
government.
• Pierhead Line. The term "Pierhead Line" shall mean the harbor water area perimeter lines
established in Newport Harbor by the federal government that define the permitted limit of fixed
pier, floating dock and other in -water structures which may be constructed in the Harbor. The
Pierhead Line typically shall define the limit of pier and floating dock structures and defines the
limit of construction except as otherwise approved by City Council. Vessels may extend
channelward of the Pierhead Line.
• Project Lines. The term "Project Lines" shall mean the harbor water area channel lines of the
improvements constructed by the federal government in 1935 -1936, and as shown on navigation
charts of Newport Harbor. Also referred to as the "Federal Channel' (see City of Newport Beach
Waterfront Project Guidelines and Standards, Harbor Design Criteria — Commercial and
Residential Facilities.)

The creation of any obstruction not affirmatively authorized by Congress, to the navigable capacity of any of the waters of the United States is prohibited; and it shall not be lawful
to build or commence the building of any wharf, pier, dolphin, boom, weir, breakwater, bulkhead, jetty, or other structures in any port, roadstead, haven, harbor, canal, navigable
river, or other water of the United States, outside established harbor lines, or where no harbor line have been established, except on plans recommended by the Chief of Engineers
and authorized by the Secretary of the Army; and it shall not be lawful to excavate or fill, or in any manner to alter or modify the course, location, condition, or capacity of, any port,
roadstead, heaven, harbor, canal, lake, harbor or refuge, or enclosure within the limits of any breakwater, or of the channel of any navigable water of the United States, unless the
work has been recommended by the chief of Engineers and authorized by the Secretary of the Army prior to beginning the dam. 3

overhang as vessels get
wider and longer.
• New commercial projects
want larger ships and slips.

• Most piers, docks, ramps
and shore side facilities
were not built to
accommodate these larger,
wider vessels with more sail
and power than older
vessels.
• Cracked piles, bouncing
docks, and marginal fire
control plague these
facilities.
• Shore side electrical,
sanitation, parking are
inadequate for these
vessels in mixed use areas.
• Most of these recreational
harbor docks have
exceeded their useful life.

Why are these Bayward problems important?
• New projects coming at Lido Marina Village and
Mariner's Mile.
• Comprehensive planning and design standards are
needed for vessels and new visitor serving facilities.
— No DBAW standards for commercial docks.
— City has limited engineering on planning expertise.
— Current facilities are undersized in the areas they operate in.
— No special marine electrical standard for 3 phase "over the wall" no ELLI
Systems (ABYL E -11) on Marina construction.
— Cold Ironing — air quality, turn over of ships between charters.
— Steel ships — wooden docks.
— Fire control — no rescue provisions for crew or passengers in the water.
