The term "Bulkhead Line" shall mean the harbor land /water perimeter lines established in Newport Harbor by the federal government which define the permitted limit of filling or solid structures that may be constructed in the Harbor. The establishment of Bulkhead Lines does not necessarily allow the property owner to build to the limits of the Bulkhead Line due to potential environmental considerations established by the State of California and /or the federal government. • Pierhead Line. The term "Pierhead Line" shall mean the harbor water area perimeter lines established in Newport Harbor by the federal government that define the permitted limit of fixed pier, floating dock and other in -water structures which may be constructed in the Harbor. The Pierhead Line typically shall define the limit of pier and floating dock structures and defines the limit of construction except as otherwise approved by City Council. Vessels may extend channelward of the Pierhead Line. • Project Lines. The term "Project Lines" shall mean the harbor water area channel lines of the improvements constructed by the federal government in 1935 -1936, and as shown on navigation charts of Newport Harbor. Also referred to as the "Federal Channel' (see City of Newport Beach Waterfront Project Guidelines and Standards, Harbor Design Criteria — Commercial and Residential Facilities.) 2 Newport Harbor "As Built" • Entire Marina is built over the project line. • Numerous vessels at Lido Marina Village exceed the project line. • Federal Government still has responsibility for the design, depths of this inland body of water. • Title 33- Chapter 9- Subchapter -403 403. Obstruction of navigable waters generally; wharves; piers, etc.; excavations and filling in The creation of any obstruction not affirmatively authorized by Congress, to the navigable capacity of any of the waters of the United States is prohibited; and it shall not be lawful to build or commence the building of any wharf, pier, dolphin, boom, weir, breakwater, bulkhead, jetty, or other structures in any port, roadstead, haven, harbor, canal, navigable river, or other water of the United States, outside established harbor lines, or where no harbor line have been established, except on plans recommended by the Chief of Engineers and authorized by the Secretary of the Army; and it shall not be lawful to excavate or fill, or in any manner to alter or modify the course, location, condition, or capacity of, any port, roadstead, heaven, harbor, canal, lake, harbor or refuge, or enclosure within the limits of any breakwater, or of the channel of any navigable water of the United States, unless the work has been recommended by the chief of Engineers and authorized by the Secretary of the Army prior to beginning the dam. 3 Design "Gaps" Balboa Island. Other, areas are neat and fit inside the 1930's drawn lines. Some areas have no lines. Excavated and built after lines were drawn. Dock construction, dredging, who is responsible? Bay Shores piers "Mr. Terrible" Conflicts with use of channel. Entire Marina exceeds the project line. Lido Shipyard Rhine Channel — No Lines at all. Did the original design contemplated, smaller, narrow vessels? NHYC — Same Channel properties built "in bounds ". 10 • Peninsula — Could you put a vessel out to project line? • Could you side tie or change the dock to exceed the pierhead line? 11 12 Aerie - Carnation Cove Reach • Project line extends significantly into the entrance channel. • No existing project has ever been built out this far into the channel. • Site Problem — Storm surge — Traffic — Sand movement • Current rules would allow new pier construction out to pierhead line. Vessel over - hang could go to project line. 13 Carnation Cove • Seawall was never completed. • Piers could go into pierhead lines. • Property lines. • Frequent Neighbor conflicts on pier repair /expansion. • Harbor Lines have not been reviewed since 1930's. • City is hard pressed to deny projects that build out to pierhead line. • Attention needed on overhang as vessels get wider and longer. • New commercial projects want larger ships and slips. • "10lbs in a 51b bag ". 14 The Big Boats The rise of the charter business 0 1 a m -i v,'f 15 • Most piers, docks, ramps and shore side facilities were not built to accommodate these larger, wider vessels with more sail and power than older vessels. • Cracked piles, bouncing docks, and marginal fire control plague these facilities. • Shore side electrical, sanitation, parking are inadequate for these vessels in mixed use areas. • Most of these recreational harbor docks have exceeded their useful life. 16 Attachment A 2901 West Coast Highway, Aerial Photo Current operation on Mariners mile. Vessels exceed the project line and project into the federal waterway. 17 DOCK AREA: 4,095 5F GANC.WA Iti & PIER WA IER CO4FIZAC� - 344 SF TOTAL WATER COWRACC.' 4.440 2F I • Operators seek to accommodate current fleet with innovative designs. • Project extends to project line. • Note "Frozen vessel" in case of fire. 18 Why are these Bayward problems important? • New projects coming at Lido Marina Village and Mariner's Mile. • Comprehensive planning and design standards are needed for vessels and new visitor serving facilities. — No DBAW standards for commercial docks. — City has limited engineering on planning expertise. — Current facilities are undersized in the areas they operate in. — No special marine electrical standard for 3 phase "over the wall" no ELLI Systems (ABYL E -11) on Marina construction. — Cold Ironing — air quality, turn over of ships between charters. — Steel ships — wooden docks. — Fire control — no rescue provisions for crew or passengers in the water. 19
