This wavier would allow three LARGER outdoor dining patios in conjunction with eating and drinking establishments in the shopping center. This is more than what the property was originally permitted. (Please see attachment.) Several residents and I have some immediate concerns regarding this request. This request is in addition to the five (5) parking spaces that have already been waived as well as one (1) public parking space on 30th Street. However, our concerns are more focused on the relation and future impact that this parking request will have for the accommodation of ABC establishments both in the subject property and the immediate community. Perhaps this application should come with the individual restaurant applications rather than the overall project for some of the following concerns. These three restaurants spaces with the patios have or will be requesting ABC licenses and at least one (Crow Bar /Burger) is requesting extended hours. Possible negative impacts to our neighborhood are as follows: 1. Noise from the open patios especially if it is involving alcohol and late hours. It is my understanding that one of the restaurant tenants wishes to completely "open -up" their space to the patio with large folding or re- tracking doors. Rudy's and Newport Brewery already create too much noise from their patios that is often heard several streets away from these establishments at late hours. 2. We DO NOT wish to see these restaurants morph into bars after 10 PM. District 15 is already over - concentrated and saturated with bars and ABC establishments. According to the NBPD and ABC our area has 1 ABC license for every 38 residents! We have more ABC establishments in this small district than ANYWHERE in Orange County. This clearly is over - concentration. Also our neighborhood continues to unduly suffer the negative impacts to the drunk and disorderly behavior from these patrons of these establishments including excessive crime, yelling & screaming at 1 -2AM, drunk drivers, puke, public urination, property damage and fights. According to the Newport Beach Police Department, District 15 was 483.75% ABOVE the city -wide reporting district average for crimes reported. We DO NOT wish to see the restaurant tenants have late hours. Most true restaurants in the area close between 10 -11 PM. This area clearly has illustrated that ABC establishments that are open after 11 PM clearly turn into bars with the related late -night problems. We will expect the restaurant tenants to have limited hours and very specific limitations regarding any additional ABC license requests for this project. 3. There seems to be some discussion floating around talking about putting these tenants "on probation." Let's give these operators ABC licenses, extended hours, open patios and then see if their good neighbors /operators ? ? ?? Given the extremely poor record of "good behavior" by so many of these establishments the community is certainly not so trusting given the abuses that we have had to endure and continue to endure. This is not acceptable. 4. We also DO NOT wish see various precedents set for other ABC establishments /bars in the immediate area. For example, it is my understanding that Malarkey's bar wishes to double in size, add a patio and request a significant parking wavier. This is not acceptable. We also have to be concerned about the future. What if these new restaurants don't make it and go out of business? Their ABC licenses then seems to run with the location including possible alcohol on the larger patios. While we continue to support the Landing project, at this time, we have no guarantees such as CUPS /zoning that fully regulates these new restaurants tenants, their larger patios, their hours, and their alcohol. In other words, the residents have no guarantees that these restaurants will not become more like a bar or bar -type hang -out. We appreciate balance and the residents wish to see the addition of GOOD RESTAURANTS which we understand may serve beer and wine; we do not wish to see these restaurants ADD to alcohol problems in our area. The community is giving up three additional parking spaces and it seems the community is getting nothing in return. What the community and residents DO NOT want to see is that we gave up a total of 8 -9 parking spaces for three more abusive ABC establishments continue to add to the alcohol related problems in District 15 and our neighborhood. If we had in -place "guarantees" now, we may not be so concerned about controlling these new restaurants with the parking issues. The residents do not like the idea of moving forward without some sort of control for these future restaurants. Should you have any questions, please do not hesitate to contact me Drew M.
