Alford, Planning Manager Michael Torres, Deputy City Attorney Tony Brine, City Traffic Engineer Rosalinh Ung, Associate Planner Russell Bunim, Assistant Planner Gaylene Olson, Department Assistant POSTING OF THE AGENDA: The Planning Commission Agenda was posted on April 16, 2010. PUBLIC COMMENTS: None REQUEST FOR CONTINUANCES Item No. 2 - D'Ambrosia Residence - PA2010 -017 - 1500 Serenade Terrace Applicant would like to continue this item to the May 20, 2010 Planning Commission meeting. Item No. 4 - Newport Bay Marina - PA2001 -210 - 2300 Newport Boulevard Patrick J. Alford, Planning Manager, requested this item be continued to the meeting of May 20, 2010. Motion made by Commissioner Toerge, seconded by Commissioner Peotter, to continue these items to May 20, 2010. Motion carried with the following vote Ayes: Eaton, Unsworth, Peotter, Hawkins, Toerge, and Hillgren Noes: None I Excused: McDaniel NEWPORT BEACH PLANNING COMMISSION MINUTES 04/22/2010 CONSENT ITEMS SUBJECT: MINUTES of the regular meeting of April 8, 2010. ITEM NO. 1 Motion was made by Commissioner Peotter, seconded by Commissioner Approved Hillgren, to approve the minutes as corrected. Motion carried with the following vote: Ayes: Eaton, Unsworth, Peotter, Hawkins, and Hillgren Abstained: Toerge Excused: McDaniel PUBLIC HEARING ITEMS SUBJECT: D'Ambrosia Residence (PA2010 -017) ITEM NO. 2 1500 Serenade Terrace PA2010 -017 The application consists of a code amendment to change a front -yard Continued to setback established on Districting Map No. 24 from 38 feet to 20 feet. May 20, 2010 SUBJECT: Coastline Community College Learning Center - (PA2009 -072) ITEM NO. 3 1505 -1535 Monrovia Avenue PA2009 -072 Coast Community College District (CCCD) will be constructing a 3- Approved story, 68,800- square -foot higher- education learning center. A tentative parcel map approval pursuant to Title 19 (Subdivision Code) and a traffic study pursuant to Title 19 (Subdivision Code) are required. Rosalinh Ung, Associate Planner, gave a brief overview of the staff report. Public comment was opened. Comment in support was given by the following: Kevin McElroy, Vice President Administrative Services Coastline Community College Public comment was closed. Motion made by Commissioner Hillgren, seconded by Commissioner Toerge, to adopt a resolution, after debate and amendment, as follows: Approve Tentative Parcel Map No. NP2009 -004; modify Findings - Section 1- Statement of Facts — Item 2, by inserting `the necessary' after CCCD Board of Trustees took, to read "On February 18, 2009, CCCD Board of Trustees took the Page 2 of 4 NEWPORT BEACH PLANNING COMMISSION MINUTES 04/22/2010 necessary action under California Government Code Section 53094....'; modify the following items under Section 3 - Required Findings — Item 2, first sentence to read "The project is consistent with the General Plan and the Zoning designations in that the applicant took action of February 18, 2009, to exempt itself from the Title 20 (Planning and Zoning Code), pursuant to California Government Code Section 53094.'; Item 5 — A -1, first sentence to read "The proposed tentative parcel map is consistent with the Multiple -Unit Residential General Plan land use designation in that the applicant took action on February 18, 2009, to exempt itself from Title 20 (Planning and Zoning Code), pursuant to California Government Code Section 53094.'; modify Section 4 — Decision — Item 2 to read "The Planning Commission of the City of Newport Beach does hereby find that the traffic study complies with the Traffic Phasing Ordinance, and based on the weight of the evidence in the administrative record, including Traffic Study No.TS2009 -001, the construction of the project will be completed with 60 months of project approval; and the project will neither cause nor make worse an unsatisfactory level of traffic service at any impacted primary intersection within the City of Newport Beach.'; modify Condition No. 1 to read "Tentative Parcel Map No. 2009 -004 shall expire 24 months from the date of approval, unless the Final Map is recorded or an extension is otherwise granted in accordance to Section 19.16.020 of the Newport Beach Title 19 Subdivision Code.'; modify Condition No. 24 to read "The applicant is required to construct a new 5 -foot wide concrete sidewalk, with appropriate curbs and gutters, and landscaped parkways along the length of the Monrovia Avenue street frontage.'; modify Condition No. 29 to read "The applicant is required to construct a 10 -foot wide concrete sidewalk along the 15`h Street frontage per plans to be reviewed and approved by the Public Works Department.'; Motion carried with the following vote: Ayes: Eaton, Unsworth, Peotter, Hawkins, McDaniel, Toerge, and Hillgren Noes: None I Excused: McDaniel NEW BUSINESS: SUBJECT: Newport Bay Marina— PA2001 -210 ITEM NO. 4 2300 Newport Boulevard PA2001 -210 Review and approval of a Construction Traffic Management and Continued to Control Plan and a Parking Management Plan for the Newport Bay May 20, 2010 Marina project. Location of upcoming Planning Commission meetings — Patrick Alford reported ITEM NO. 5 that the Council Chambers should be repaired before the next Planning Commission meeting of May 20, 2010. City Council Follow -up — Patrick Alford noted there was nothing directly related to ITEM NO. 6 the Planning Commission at the City Council meeting. Planning Commission reports — Commissioner Eaton reported that a GP /LCP ITEM NO. 7 Implementation meeting was held on April 21, 2010 and the Zone Code update Page 3 of 4 NEWPORT BEACH PLANNING COMMISSION MINUTES 04/22/2010 will soon be ready for staff to present to the Commission. Patrick Alford noted an introductory meeting on May 20, 2010 might be considered to discuss the Zone Code update process. Commission Eaton also noted the Fair Share Fees was sent back to staff for corrections. Chairman Hawkins suggested we have a Study Session on May 20, 2010 for Zone Code update discussion. Chairman Hawkins commented on his concerns that City projects will be exempt in the Zone Code update. Chairman Hawkins reported that the Economic Development Committee meeting was held on April 21, 2010.
