TAB 1 (The 1924 Deed) Deed recorded on June 19, 1924 in Book 530, Page 128, of Deeds, at 8:30 a.m. A. This is a deed from The Irvine Company to Title Guarantee and Trust Company, covering 354 acres of the old "Irvine Subdivision ", a portion of which was immediately subdivided into Tract No. 706. B. Tract No. 706 contains the vacated portions of Birch Street. C. In this deed, "Reservation No. 7" reserves to The Irvine Company the underlying fee title to all streets depicted thereon, and more importantly, specifically rg anted the successors in interest (e.g., Moriarty) the right to use Birch Street and other roads within this deed: "7. Reserving a stria thirty (30) feet wide on each side of the lot lines in said Irvine Subdivision above mentioned... as shown on resubdivision map of said land [e.g., Tract No. 706], approved by the grantor [the Irvine Company], and also right to use any streets or roads shown on said re- subdivision map, for roads highway purposes, and for telephone, water -pipe, and electric power or Uhtlines, to be used in connection with said lands...." (Emphasis added). Anal, sis: This deed formed the basis for Tract No. 706, the first "true" subdivision of Mr. Moriarty's property. The Irvine Company sold this large parcel to Title Insurance and Trust Company, subject to specific reservations running in favor of The Irvine Company and successive grantees, such as Mr. Moriarty, for road use, and for the installation of utilities to benefit their parcels. _ r.r •. A. Tract No. 706 was filed for record on October 14, 1924, about 4 months after the 1924 Deed recorded. B. It is clear that the 1924 Deed was the precursor to the filing of Tract No. 706. C. The 1924 Deed was specifically mentioned on the tract map: (1) "Reservations: Reservation and restrictions contained in the deed from the THE IRVINE COMPANY to the TITLE GUARANTY & TRUST COMPANY recorded in Book 530, Page 128, of Deeds, Records of Orange County, California." D. The County's Board of Supervisors approved Tract No. 706 in October 1924, and accepted the 1924 Deed as a public dedication, which included Birch Street: (1) "I, J.M. BACKS, County Clerk in and for said County, do hereby certify that a good and sufficient bond, approved by the County Board of Supervisors has been Fled with said Board which said bond is conditioned for the payment of all taxes which are a lien upon the land covered by the accompanying map not yet due and payable; also this map was presented for approval to said Board at a regular meeting held thereof on this [illegible] day of October ...1924 and that thereupon said Board did by an order duly passed entered approve said map and did accept on behalf of the public the avenues, streets, drives and places shown hereon." E. This Tract map created Birch Street, including the "vacated" portions. On July 10, 1951, the County Board of Supervisors vacated portions "of Birch Street lying Southwesterly of the Southwesterly line of Mesa Drive ". This document was recorded on July 17, 1951, in Book 2145, Page 618. B. This affects Birch Street running along the Brockman and Moriarty parcels. C. This document states: "Be it further resolved that other existing easements and or franchises shall not be affected by these proceedings." (Emphasis added.) Analysis: ' The vacation of Birch Street merely terminates the rights of the City (or County) to maintain the road on behalf of the public, but not Moriarty's rights to use Birch Street for road and utility purposes under the 1924 Deed.
