They were appointed by the City Council by majority vote for 4 -year terms. At the table in front are City staff members who are here to advise the Commission during the meeting. HARP, Assistant City Attorney NOTICE TO THE PUBLIC Regular meetings of the Planning Commission are held on the Thursdays preceding second and fourth Tuesdays of each month at 6:30 p.m. Staff reports or other written documentation have been prepared for each item of business listed on the agenda. If you have any questions or require copies of any of the staff reports or other documentation, please contact the Planning Department staff at (949) 644 -3200. The agendas, minutes and staff reports are also available on the City's web site. The address is: http://www.city.newport-beach.ca.us/. It is the intention of the City of Newport Beach to comply with the Americans With Disabilities Act (ADA) in all respects. APPEAL PERIOD: Use Permit, Variance, Site Plan Review, Resubdivision, and Modification applications do not become effective until 14 days after the date of approval, during which time an appeal may be filed with the City Council. General Plan and Zoning Amendments are automatically forwarded to the City Council for final action. If in the future, you wish to challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues, which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. Speakers must limit comments to 3 minutes. Before speaking, please state your name for the record and print your name on the tablet provided at the podium. REQUEST FOR CONTINUANCES: ALL TESTIMONY GIVEN BEFORE THE PLANNING COMMISSION IS RECORDED. SPEAKERS MUST LIMIT REMARKS TO THREE MINUTES ON ALL ITEMS. HEARING ITEMS ITEM NO. 1 Minutes dated November 15, 2007 ACTION: Approve as written and order filed. ITEM NO. 2. Coastal Residential Development Permit No. 2006 -003 (PA2006 -278) 1703 W. Balboa Blvd. SUMMARY: The applicant requests approval of a Coastal Residential Development Permit (CRDP) to allow the demolition of a 10 -unit apartment building in the City's Coastal Zone. The apartment building is proposed to be replaced by three detached single - family homes. The purpose of the CRDP is to ensure compliance with Government Code Section 65590 (Mello Act) which regulates the demolition of low and moderate income dwelling units in the Coastal Zone. ACTION: Continue this item to January 17, 2008 at the request of staff to allow for the completion of the Feasibility Study. CEQA COMPLIANCE: This project has been determined to be categorically exempt under the requirements of the California Environmental Quality Act under Class 32 (In -Fill Development Projects) ITEM NO. 3. Planned Community Text Amendment No. 2007 -004 (PA2007 -166) Amendment to Newport Tract Map No. 2004 -001 919 Bayside Drive SUMMARY: The applicant requests to amend the Bayside Residential Planned Community District Development Regulations (Planned Community Text No. 55) to implement the conditions of approval of the Coastal Development Permit for the development of a 17 -lot single - family residential subdivision. Changes to the Planned Community Text are also proposed to simplify the administration of the Planned Community development regulations. To ensure consistency with the amended Planned Community Text and conditions of approval of the Coastal Development Permit, the applicant further requests amendments to Newport Tract Map No. 2004 -001 (Tentative Tract Map 15323) and the conditions of approval of said map. ACTION: 1) Conduct public hearing; and 2) Adopt Resolution CEQA COMPLIANCE: All significant environmental concerns for the proposed project have been addressed in a previously certified environmental document. The City of Newport Beach intends to use said document for the above noted project. There are no additional reasonable altematives or mitigation measures that should be considered in conjunction with said project. Copies of the previously prepared environmental document are available for public review and inspection at the Planning Department, City of Newport Beach, 3300 Newport Boulevard, Newport Beach, California, 92658- 8915 (949) 644 -3200. ITEM NO. 4. Joyce LCM RedWillow residence (PA2007 -152) 418 Redlands SUMMARY: An appeal of the Zoning Administrator's decision to approve Modification Permit No. 2007 -060 on property located in the R -1 District, which would permit the minor interior remodel of, and a 1,203 square -foot addition to a nonconforming single - family dwelling unit that encroaches 13 feet, 8 inches into the 20 -foot required front yard setback. ACTION: 1) Conduct public hearing; and 2) Adopt resolution denying Modification Permit No. 2007 -060. CEQA COMPLIANCE: The Modification Permit has been determined to be categorically exempt under the requirements of the California Environmental Quality Act under Class 1 (Existing Facilities).
