They were appointed by the City Council by majority vote for 4 -year terms. At the table in front are City staff members who are here to advise the Commission during the meeting. HARP, Assistant City Attorney NOTICE TO THE PUBLIC Regular meetings of the Planning Commission are held on the Thursdays preceding second and fourth Tuesdays of each month at 6:30 p.m. Staff reports or other written documentation have been prepared for each item of business listed on the agenda. If you have any questions or require copies of any of the staff reports or other documentation, please contact the Planning Department staff at (949) 644 -3200. The agendas, minutes and staff reports are also available on the City's web site. The address is: hftp:/Avww.city.newport-beach.ca.us/. It is the intention of the City of Newport Beach to comply with the Americans With Disabilities Act (ADA) in all respects. APPEAL PERIOD: Use Permit, Variance, Site Plan Review, Resubdivision, and Modification applications do not become effective until 14 days after the date of approval, during which time an appeal may be filed with the City Council. General Plan and Zoning Amendments are automatically forwarded to the City Council for final action. If in the future, you wish to challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues, which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. Before speaking, please state your name for the record. REQUEST FOR CONTINUANCES: ITEM NO. 1 Minutes dated 02/08/2007. ACTION: Approve as written and order filed. ALL TESTIMONY GIVEN BEFORE THE PLANNING COMMISSION IS RECORDED. SPEAKERS MUST LIMIT REMARKS TO THREE MINUTES ON ALL ITEMS. (Red light signifies when three minutes are up; yellow light signifies that the speaker has one minute left for summation.) ITEM NO. 2. Fancher Development Services (PA2006 -269)) 849 Newport Center Dr. SUMMARY: Request to amend an existing Use Permit to allow an eating and drinking establishment to extend their hours of operation to 2:00 a.m., seven days a week. ACTION: 1) Conduct public hearing, and 2) Adopt Resolution to approve an amendment to Use Permit UP2004 -007 CEQA COMPLIANCE: This project has been reviewed, and it has been determined that it is categorically exempt under the requirements of the California Environmental Quality Act under Class 1 (Existing Facilities). ITEM NO. 3. Advanced Real Estate Services (PA2005 -196) 201 & 207 Carnation Avenue and 101 Bayside Place SUMMARY: The application would allow the demolition of an existing 14 -unit apartment building and a single - family home and the construction of a 7- level, 9 -unit multiple - family residential condominium complex with subterranean parking on a 1.4 acre site located bayward of the intersection of Ocean Boulevard and Carnation Avenue. The existing General Plan, Coastal Land Use Plan and Zoning Designations of a small portion of the site (584 square feet) would be changed to be consistent with the larger portion of the site (from two- family residential to multi- family residential). The application includes a tentative tract map for the creation of 9 "airspace' condominium units for individual sale and. The Modification Permit application requests the encroachment of subterranean portions of the building within the front and side yard setbacks. Lastly, the Coastal Residential Development Permit application relates to replacing lost units occupied by low or moderate - income households. No units meeting this criteria are known to exist and therefore, no replacement of affordable housing is required. ACTION: Staff recommends that the Planning Commission, after holding a public hearing on General Plan Amendment No. 2005 -006, Zone Change No. 2005 -009, Coastal Land Use Plan Amendment No. 2005 -002, Newport Tract Map No. 2005 -004 (TTM 16882), Modification Permit No. 2005 -087 and Coastal Residential Development Permit No. 2005 -002, continue the hearing to a future date to be determined at the meeting, and direct the applicant to modify the project-to be consistent with Coastal Land Use Plan policies. CEQA COMPLIANCE: A Mitigated Negative Declaration has been prepared by the City of Newport Beach in connection with the application noted above. The Mitigated Negative Declaration states that the subject development will not result in a significant effect on the environment with implementation of Mitigation Measures. ITEM NO. 4. Mariner's Mile Gateway, LLC (PA2006 -279) 100 -600 West Coast Highway SUMMARY: Request for Comprehensive Sign Program CS2006 -012 for the previously approved Bel Mare Shopping Center. In addition, the Planning Commission will be reviewing the project's landscape plan and evaluating proposed refinements to exterior elevations to determine their substantial conformance with the approved project. ACTION: Continue this item to a date uncertain to allow the applicant time to address unresolved issues with the project submittal. CEQA COMPLIANCE: This project has been reviewed, and it has been determined that it is categorically exempt under the requirements of the California Environmental Quality Act under Class 11 (Accessory Structures). ADDITIONAL BUSINESS: a) City Council Follow -up. b) Report from Planning Commission's representative to the Economic Development Committee. C) Report from the Planning Commission's representative to the General Plan /Local Coastal Implementation Committee. d) Matters which a Planning Commissioner would like staff to report on at a subsequent meeting. e) Matters which a Planning Commissioner may wish to place on a future agenda for action and staff report. f) Project status. g) Requests for excused absences.
