PROJECT SUMMARY
West Santa Ana Heights (WSAH) will be annexed into the City of Newport Beach
effective January 1, 2008. Newport Beach is required by the Local Agency Formation
Commission (LAFCO) to adopt land use designations and zoning for the property. This
proposed General Plan Amendment (GPA) will include WSAH on City land use maps
and assign land use category designations.
Pre - Zoning that placed the majority of the area into the Santa Ana Heights Specific Plan
was approved by the City Council in 2004. At that same time, WSAH was incorporated
into the old General Plan (GP) by the approval of Resolution No. 2004 -5. However,
WSAH was not included in the 2006 GP update since it was not in the City's Sphere of
Influence (SOI).
A comprehensive amendment to the GP that will update statistical data and exhibits in
all GP elements to reflect annexation of WSAH will follow after the annexation effective
date.
RECOMMENDATION
Staff recommends that the Planning Commission, after holding a public hearing,
recommend that the City Council amend the GP to include WSAH with land use
designations as proposed.

INTRODUCTION
Proiect Setting
WSAH is approximately 70.6 acres and developed with single - family housing, multiple -
family housing, offices, and a nursery. It is located adjacent to the northern area of the
City of Newport Beach and is bounded by Mesa Drive, Santa Ana Avenue, Bristol
Street, and the Newport Beach Golf Course.
Proiect Description
The General Plan Amendment, as proposed, assigns land use designations that are
consistent with the Santa Ana Heights Specific Plan and the County's General Plan
(see the chart below and the draft resolution map exhibits).
Zoning and General Plan
The Zoning for most of the annexed property is Santa Ana Heights Specific Plan, except
for a small portion located adjacent to Santa Ana Avenue which is zoned RMD
(Residential Medium Density). The Zoning will become effective January 1, 2008, at the
time of annexation.

Background —Annexation Timeline
March 11, 2003
City Council directed staff to prepare an application to annex WSAH and surrounding
area. The annexation application was accompanied by a Sphere of Influence (SOI)
amendment to realign the SOI boundaries between Newport Beach and Costa Mesa.
November 20, 2003
The Planning Commission voted 7 -0 to recommend that the City Council approve the
General Plan and Pre - Zoning Amendments for WSAH and surrounding area.
January 13, 2004
The City Council voted 6 -0 (with one absent) to approve Resolution 2004 -5 and
Ordinance 2004 -1 approving GP land use designations and Pre - Zoning. A negative
declaration was approved with the GPA and Pre - Zoning.
July 25, 2006
The City of Newport Beach adopted the comprehensive GP update. However, as
WSAH was not in the SOI of Newport Beach, it was not included in the General Plan
update.
February 14, 2007
City Council adopted Resolution 2006 -15 requesting LAFCO to initiate proceedings for
the reorganization of territory at WSAH.
July 11, 2007
LAFCO approved the City's application to annex WSAH.
July 19 —August 17, 2007
Annexation reconsideration period (a LAFCO commissioner that voted for the City's
annexation of WSAH can request LAFCO reconsideration of July 11, 2007 action).
August 20 — September 10, 2007
Annexation protest period (registered voters in the affected area can register a protest
against the annexation; if fewer than 25% of the registered voters protest, the project
moves forward).
September 10, 2007
Protest hearing date; project moved forward.
September 12, 2007
LAFCO recorded the annexation.

Annexation effective date (City begins providing services).
City Charter Section 423
This GPA is not subject to Section 423 of the City Charter (Protection from Traffic and
Density) because the proposed GPA is only translating existing GP land use
designations from County to City GP format. The GPA has been formulated to correlate
to existing land uses and land use designations. Therefore, they do not provide for any
increase in density or intensity and thus will not result in increases in peak hour trips,
dwelling units or square feet.
Environmental Review
Annexation requires California Environmental Quality Act (CEQA) documentation. A
negative declaration was prepared in conjunction with the Pre - Zoning and previous
GPA, and approved on January 13, 2004, and is adequate.
Public Notice
Notice of this hearing was published in the Daily Pilot, mailed to property owners within
annexed land and posted at the site a minimum of 10 days in advance of this hearing
consistent with the Municipal Code. The item appeared upon the agenda for this
meeting, which was posted at City Hall and on the City website.

RESOLUTION NO.
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF NEWPORT BEACH RECOMMENDING CITY COUNCIL
APPROVAL OF GENERAL PLAN AMENDMENT NO. GP2007 -007
TO ADOPT LAND USE CATEGORIES FOR THE AREA KNOWN AS
WEST SANTA ANA HEIGHTS TO BE ANNEXED INTO THE CITY
JANUARY 1, 2008 (PA2007 -209)
WHEREAS, pursuant to Section 65300 of the California Government Code, the City of
Newport Beach has prepared and adopted a comprehensive long -term General Plan for the
physical development of the City; and
WHEREAS, the California Government Code requires zoning to be consistent with the
City's General Plan designations; and
WHEREAS, land use and other General Plan designations for the subject annexation
area known as West Santa Ana Heights (WSAH) are not currently included in the General Plan
and therefore must be provided; and
WHEREAS, the Local Agency Formation Commission ( LAFCO) approved the City's
application to annex WSAH on July 11, 2007; and
WHEREAS, LAFCO recorded the annexation on September 12, 2007; and
WHEREAS, the annexation will be effective on January 1, 2008; and
WHEREAS, pursuant to the California Environmental Quality Act (CEQA) it was
determined that the subject amendment will not have a significant effect on the environment,
and accordingly a draft Negative Declaration was prepared for the amendment and
annexations; and
WHEREAS, on November 15th, 2007, the Planning Commission of the City of Newport
Beach held a public hearing regarding the proposed General Plan Amendment and
recommended approval to the City Council; and
WHEREAS, the public was duly notified of the public hearing.
NOW THEREFORE BE IT RESOLVED:
Section 1. Adoption of General Plan Amendment GP2007 -007. The Planning
Commission recommends that the City Council adopt the proposed amendment to include the
West Santa Ana Heights Annexation Area on the land use maps and assign the land use
designations as depicted on the maps attached as Exhibit A.
Section 2. Statistical Area. The Planning Commission recommends that the City
Council amend maps of statistical area J6 to include the WSAH annexation area as shown on
Exhibit B.
