ISSUE
Should the City approve a pre- annexation General Plan Amendment and Code
Amendment to "pre -zone' property located at 107 Industrial Way, in the City of Costa
Mesa?
Staff recommends the Planning Commission adopt the attached resolution
recommending approval of General Plan Amendment No. 2006 -002 and Code
Amendment No.. 2006 -003 to the City Council.
DISCUSSION
Site Description and Location
The 0.42 acre parcel is part of the Newport Beach General Services Department
Corporation Yard and serves as a fueling station for department vehicles. The property
is owned by the City of Newport Beach but is located within the City of Costa Mesa. The
property is adjacent to the Newport Beach /Costa Mesa boundary, at the southerly
corner of the intersection of Superior Avenue and Industrial Way. The majority of the
General Services Department Corporation Yard is located on the adjacent parcel to the
south in the City of Newport Beach (see Vicinity Map).

Backaround
On February 14, 2006, the Council adopted Resolution 2006 -15 directing staff to file an
application with the Orange County Local Agency Formation Commission ( OCLAFCO)
to reorganize three areas adjacent to the City, one of which is the subject property.
Since the parcel is within the Costa Mesa city limits, "reorganization" entails working
with OCLAFCO and the City of Costa Mesa to detach the parcel from Costa Mesa and
annex it into the City of Newport Beach. The purpose of the annexation is to facilitate
Newport Beach's administration and management of the parcel and fueling station. The
City of Newport Beach intends to retain the parcel in its capacity as a fueling station for
City vehicles.
On February 28"', the City Council approved the initiation of the subject General Plan
and Code Amendment to pre -zone the parcel.
General Plan Amendment and Zone Change
The purpose of the proposed action is to establish General Plan and zoning
designations for the property prior to its annexation into the City of Newport Beach. Pre -
zoning the parcel is required before OCLAFCO can consider any application for
annexation. Staffs recommendation is that a General Plan and zoning designation of
Government, Educational, and Institutional Facilities (GEIF) be established for the
property. This designation is consistent with the current use of the parcel and is
consistent with the General Plan and zoning designation (GEIF) of the General Services
Corporation Yard of which it is a part. The Land Use Element of the Newport Beach
General Plan assigns a variable floor area ratio of 0.5 to 0.75 to the General Services
Corporation Yard site. This same ratio will be applied to the subject parcel. It should be
noted, however, that the parcel currently is occupied by a fueling station (gas pumps)
and that no change of use is proposed by this action.
Surrounding Land Uses
The existing fueling station is compatible with surrounding officelindustrial land uses,
and the City has not received complaints regarding its operation. The proposed General
Plan Amendment and Code Amendment, in and of themselves, will not change the
operational characteristics of the fueling station. Although the existing use will be
maintained, the proposed GEIF General Plan and zoning designation does permit other
uses that would be compatible with surrounding office /industrial land uses.
Charter Section 423 (Measure S)
Council Policy A -18 requires that proposed General Plan amendments be sent to a vote
if the amendment causes certain defined thresholds to be exceeded. If a proposed
amendment generates more than 100 peak hour trips, consists of 40,000 or more

square feet of non - residential floor area, or exceeds 100 dwelling units, a vote of the
citizens is required if the City Council approves the amendment.
Under the Costa Mesa General Plan, the parcel has a land use designation of Light
Industrial which allows small manufacturing, service industry, and institutional uses. The
designation allows a maximum floor area ratio of 0.75 (for very low traffic generation
uses). The proposed GEIF designation is intended primarily for governmental facilities
and institutional facilities of a public or semi - public nature. The designation would also
allow a maximum of floor area ratio of 0.75 (for very low traffic generating uses). It has
been determined that the proposed amendment is not subject to Measure S since the
amendment translates the existing City of Costa Mesa land use designation to a
comparable designation under the Newport Beach General Plan.
Environmental Review
This project has been reviewed, and it has been determined that the proposed action
qualifies for an exemption under Section 15301 (Existing Facilities) and Section 15305
(Minor Alterations in Land Use Limitations) of the California Environmental Quality Act
(CEQA) Guidelines. These exemptions cover the operation and maintenance of public
or private structures and facilities and minor alterations in land use limitations which do
not result in any changes in land use or density.
Public Notice
Notice of this hearing was published in the Daily Pilot, mailed to property owners within
300 feet of the property and posted at the site a minimum of 10 days in advance of this
hearing consistent with the Municipal Code. Additionally, the item appeared on the
agenda for this meeting, which was posted at City Hall and on the City website. The City
of Costa Mesa was also notified of the hearing.
Alternatives
The Planning Commission may recommend that the amendment be declined.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF NEWPORT BEACH RECOMMENDING ADOPTION OF
GENERAL PLAN AMENDMENT NO. 2006 -002 AND CODE
AMENDMENT NO. 2006 -003 (PA2006 -047).
WHEREAS, The subject property is located within the City of Costa Mesa and
the Newport Beach City Council, on February 14 2006, adopted a Resolution of
Application to the Orange County Local Agency Formation Commission (OCLAFCO) to
initiate proceedings to detach the property from the City of Costa Mesa and annex it into
the City of Newport Beach; and
WHEREAS, Said reorganization will facilitate administration and management of
the subject parcel which is owned by the City of Newport Beach and is part of the Newport
Beach General Services Department Corporation Yard; and
WHEREAS, OCLAFCO requires that a City "pre- zone" property prior to
considering any application; and
WHEREAS, The City Council, on February 28, 2006, initiated an General Plan
Amendment (GPI 2006 -002) and Code Amendment (CA2006 -003) to establish a land
use designation and zoning designation of Government, Educational and Institutional
Facilities (GEIF) for property located at 107 Industrial Drive in the City of Costa Mesa;
and
WHEREAS, A public hearing was held by the Newport Beach Planning
Commission on March 23, 2006 in the City Hall Council Chambers, 3300 Newport
Boulevard, Newport Beach, California. A notice of time, place, and purpose of the meeting
was given in accordance with the Municipal Code and State Law. Evidence, both written
and oral, was presented to and considered by the Planning Commission at this meeting;
and
WHEREAS, The GEIF land use designation is consistent with the existing use of
the parcel and is compatible with surrounding land uses; and
WHEREAS, This project has been reviewed, and it has been determined that the
proposed action qualifies for an exemption under Section 15301 (Existing Facilities) and
Section 15305 (Minor Alterations in Land Use Limitations) of the California
Environmental Quality Act (CEQA) Guidelines since the project involves maintenance
and operation of existing public structures and facilities and a minor alteration in land
use limitations that does not affect land use or density.

NOW, THEREFORE, BE IT RESOLVED
. Section 1. The Planning Commission hereby recommends that the City Council
of the City of Newport Beach adopt General Plan Amendment No. 2006 -002 to establish
the land use designation of Government, Educational and Institutional Facilities (GEIF)
for the subject site and amend the General Plan Land Use Map to reflect the addition of
the parcel to Statistical Area A3 of the City of Newport Beach.
Section 2. The Planning Commission hereby further recommends that the City
Council of the City of Newport Beach adopt Code Amendment No. 2006 -003 to establish
a zoning designation of GEIF for the subject site by amending Districting Map 22 to.
include the subject parcel and zoning designation
BE IT FURTHER RESOLVED that,the Planning Commission does hereby recommend
that the City Council stipulate that the approval of the amendments set forth in this
Resolution shall become effective only if the annexation described herein is approved
by the Orange County Local Agency Formation Commission.
