HomeMy WebLinkAbout94-12 - Amending Chapters 9.04 and 15.04 of the Newport Beach Municipal CodeORDINANCE 94 -12 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING CHAPTERS 9.04 AND 15.04 OF THE NEWPORT BEACH MUNICIPAL CODE. •Section 1 The City Council of the City of Newport Beach finds and declares: WHEREAS, Health & Safety Code Section 17958 mandates that the City of Newport Beach shall adopt ordinances or regulations imposing the same requirements as are contained in the regulations adopted by the State pursuant to Health & Safety Code Section 17922; and WHEREAS, the State of California is mandated by Health & Safety Code Section 17922 to impose the same requirements as are contained in the 1991 Uniform Building Code of the International Conference of Building Officials and the 1991 Uniform Fire Code of the International Conference of Building Officials and the International Fire Code Institute; and • WHEREAS, Health & Safety Code Section 17958.5 permits the City to make such changes or modifications to the Codes as are reasonably necessary because of local conditions; and WHEREAS, Health & Safety Code Section 17958.7 requires that the City Council before making any changes or modifications pursuant to Section 17958.5 make express findings that such changes or modifications are needed due to climatic, geographic, or topographic conditions; and WHEREAS, these modifications to the Uniform Fire Code and the Uniform Building Code are necessary to keep fires manageable and reduce fire flow (water) requirements because of Newport's unique geography which includes separation of land areas by • extensive waterways and limited access to various residential areas located on islands and peninsulas; and WHEREAS, earthquakes occur without warning, the Newport - Inglewood fault is immediately adjacent to Newport Beach and an earthquake on the Newport - Inglewood fault could easily destroy 7 access to developed areas on islands or peninsulas, could result in liquifaction that could greatly magnify the damage caused by earth movement alone, and could severely stress emergency services reducing the effectiveness of firefighting personnel; and • WHEREAS, many developed areas in Newport Beach are in proximity to heavy foliated wildlands, canyons and similar areas that can facilitate the rapid spread of fire and pose a significant threat to structures, life and the community; and WHEREAS, Newport Beach is located in a unique climatic area and strong offshore winds can create the potential for large scale conflagrations; and WHEREAS, the Building Director and Fire Chief have recommended that changes and modifications be made to the Codes and have advised that these changes and modifications to the model codes are reasonably necessary due to local conditions in the City of Newport Beach and have further advised that the remainder of said changes and modifications are administrative or procedural in nature, NOW THEREFORE, the City Council of the City of Newport Beach does ordain as follows: SECTION 2 Chapter 9.04 FIRE CODE Sections 9.04.190 and 9.04.195 are amended to read as follows: Section 9.04.190. Addition to Section 10.507.(a). Section 10.507.(a) is amended to read: Sec. 10.507.(a) General. An automatic fire - extinguishing • system shall be installed in the occupancies and locations as set forth in this section. Notwithstanding any applicable provisions of this code, an automatic fire - extinguishing system shall be installed in all occupancies when the total floor area of a building regardless of 2 area separation walls or allowable area increases exceeds 5,000 square feet. 1. In all existing structures not equipped with an automatic fire - extinguishing system, when additions cause the structure to exceed 5,000 square feet the following provisions • apply. A. when such additions are 25% or less than the original building square footage, the existing structure and the addition need not be equipped with an automatic sprinkler system. B. when such additions exceed 25% but are less than 50% of the original building square footage, the addition shall be equipped with an automatic sprinkler system. C. when such additions are 50% or more of the original building square footage, the entire structure shall be equipped with an automatic sprinkler system throughout. 2. In all existing structures not equipped with an • automatic fire - extinguishing system that exceed 5,000 square feet, the following provisions shall apply. A. when additions are 1,250 square feet or less, the existing structure and the addition need not be equipped with an automatic sprinkler system. B. when additions exceed 1,250 square feet but are less than 2,500 square feet, the addition shall be equipped with an automatic sprinkler system. C. when additions are 2,500 square feet or more, the entire structure shall be equipped with an automatic sprinkler system throughout. 3. Except in Group R, Division 3 and Group M occupancies, • in partially sprinklered buildings, sprinklered areas shall be separated from non - sprinklered areas. Such separation shall not be less than that required for a one -hour occupancy separation. 3 4. Automatic fire sprinklers shall be installed in all buildings having floors used for human occupancy located more than 40 feet above the lowest level of Fire Department access. 5. For provisions on special hazards and hazardous materials, see Sections 10.501 and Articles 45, 48, 49, and 80. • Section 9.04.195. Addition to Section 12.108. Section 12.108. is amended to read: Sec. 12.108. Exit corridors shall be maintained as specified in the Building Code. Partitions, rails, counters and similar space dividers not over 5 feet 9 inches in height above the floor shall not be construed as forming a corridor. EXCEPTION: Corridor walls and ceilings need not be of fire - resistive construction within office spaces having an occupant load of 100 or less when the entire story in which the space is located is equipped with an automatic sprinkler system throughout, smoke detectors are installed within the corridor in accordance with their listing and the entire building will be equipped with an automatic sprinkler system within a five (5) • year period from date of permit issuance. SECTION 3 Chapter 15.04 BUILDING CODE Sections 15.04.120 and 15.04.130 are amended to read as follows: Section 15.04.120 Amendment to Section 3802(a). Section 3802(a) is amended to read: Sec. 3802(a) Where Required. An automatic fire - extinguishing system shall be installed in the occupancies and locations as set forth in this section. For provisions on special hazards and hazardous materials, see the Fire Code. Section 15.04.130 Deletion of Subsection 5 and 6 from Section 3802(b). Subsection 5 and 6 previously added to Section 3802(b) are • hereby deleted from the Building Code. SECTION 4 That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. SECTION 5 This Ordinance shall be published once in the official newspaper of the City and the same shall be effective 30 • days after the date of its adoption. 11 • • This Ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach held on the 28th day of February, 1994, and was adopted on the 14th day of March, 1994, by the following vote to wit: AYES, COUNCIL MEMBERS HEDGES.
