Planning Commissioners are citizens of Newport Beach who volunteer to serve on the Planning
Commission. They were appointed by the City Council by majority vote for 4 -year terms. At the
table in front are City staff members who are here to advise the Commission during the meeting.

NOTICE TO THE PUBLIC
Regular meetings of the Planning Commission are held on the Thursdays preceding second and fourth
Tuesdays of each month at 6:30 p.m. Staff reports or other written documentation have been prepared
for each item of business listed on the agenda. If you have any questions or require copies of any of the
staff reports or other documentation please contact the Planning Department staff at (949) 644 -3200.
The agendas, minutes and staff reports are also available on the City's web site. The address is:

It is the intention of the City of Newport Beach to comply with the Americans With Disabilities Act (ADA)

APPEAL PERIOD: Use Permit, Variance, Site Plan Review, Resubdivision, and Modification
applications do not become effective until 14 days after the date of approval, during which time an
appeal may be filed with the City Council. General Plan and Zoning Amendments are automatically
forwarded to the City Council for final action.
If in the future, you wish to challenge in court any of the matters on this agenda for which a public
hearing is to be conducted, you may be limited to raising only those issues which you (or someone else)
raised orally at the public hearing or in written correspondence received by the City at or before the
hearing.

Notice to the Public
All matter(s) listed under CONSENT CALENDAR (Item 1 and 1 B) is considered by the Commission to be
routine and will all be enacted by one motion in the form listed below. The Planning Commission Members
have received detailed staff reports on each of the items recommending an action. There will be no
separate discussion of these items prior to the time the Commission votes on the motion unless members
of the Commission, staff or the public request specific items to be discussed and /or removed from the
Consent Calendar for separate action.
Members of the public who wish to discuss a Consent Calendar item should come forward to the lectern
upon invitation by the Chairman, state their name and Consent Calendar Item number.
ITEM NO. 1.
SUBJECT: Minutes of the regular meeting of September 22, 2005.
ACTION: Approve as written and order filed.
HEARING ITEMS:
ITEM NO. 2.
SUBJECT: Carl & Barbara Mosen

SUMMARY: Use Permit to aallow a "social club" for the purposes of group assembly. The
application also requests a parking waiver of 55 spaces associated with the existing
use.
ACTION: Approve Use Permit No. 2005 -031 (PA 2005 -136) subject to findings and conditions.

ITEM NO. 3.
SUBJECT: Riviera Magazine (PA 2005 -185)

The Cannery Restaurant (PA2005 -239)

SUMMARY: Use Permit to exceed the base Floor Area Ratio (FAR) resulting from the
conversion of a 2 n floor 3,701 square foot residential unit to an office use. The
conversion necessitates 10 additional parking spaces, which the applicant seeks
to provide at an off -site parking lot located at 520 31 at Street.
Amend the existing off -site parking agreement between The Cannery Restaurant
and the City of Newport Beach. The existing off -site parking agreement requires
The Cannery Restaurant to reserve the 45 space off -site parking lot located at the
southwest corner of 31st Street and Lafayette Avenue for the exclusive use of its
patrons and employees. The proposed amended off -site parking agreement
would allow The Cannery Restaurant to lease parking spaces to others when the
parking lot is available.
ACTION: Approve Use Permit No. 2005 -042 and Off -Site Parking Agreement No. 2005 -003
subject to the findings and conditions of approval; approve Off -Site Parking
Agreement No. 2005 -004
ITEM NO. 4.
SUBJECT Newport Marina LLC
919 Bayside Drive
SUMMARY: The applications would allow the redevelopment of the Newport Marina Apartment
complex located at 919 Bayside Drive. The existing 64 -unit apartment complex,
located on approximately 4.78 acres, will be demlished and replaced with a 17 -unit,
gated residential community. The tentative tract map proposes to establish 17
individual residential lots for custom home construction, 1 common recreational lot
with possibly a pool and shade structure, 2 landscape /open space lots and
waterfront lot containing floating docks (existing). Private streets are proposed. A
request to re -zone the site from MFR (Multi - Family Residential) to PC (Planned
Community) is sought. The rezone is accompanied with a Planned Community
Development Plan text that will establish development and use standards for the
proposed project similar to zoning standards
The coastal residential development permit is required as 64 residential units are
proposed to be demolished within the coastal zone and the project must be
reviewed for compliance with the Government Code Section 65590 (Mello Act).
The project also includes the demolition of the existing apartment building and all
associated structures, grading, installation of utilities, private streets, landscaping,
site lighting, site walls, water quality improvements, access easements and
upgrades to the public right of way adjacent to the project site.
ACTION: Recommend approval of Code Amendment No. 2005 -007, Use Permit No. 2005-
026, Tract Map No. 2004 -001 (TTM No. 15323) and Coastal Residential
Development No. 2005 -001 to the City Council.
ITEM NO. 5.
SUBJECT: Continued discussion of Recreation and Open Space, and, the Natural Resources
Elements.
ACTION: Discuss and recommend potential changes to the Recreation and Open Space
Element and the Natural Resources Element to the City Council.
