ORDINANCE NO. 95- 11
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AMENDING TITLE 2 OF THE
NEWPORT BEACH MUNICIPAL CODE SO AS TO PERMIT
THE CONSOLIDATION OF THE UTILITIES DEPARTMENT
WITH THE PUBLIC WORKS DEPARTMENT; THE MARINE
DEPARTMENT WITH THE FIRE DEPARTMENT; AND
ADDING PERSONNEL DUTIES TO THE FINANCE
DEPARTMENT AND RENAMING THAT DEPARTMENT TO
ADMINISTRATIVE SERVICES.
The City Council of the City of Newport Beach does hereby find
as follows:
Section 601 of the Charter of the City of Newport Beach
authorizes the City Council to provide, by ordinance not
inconsistent with the Charter, for the organization, conduct and
operation of the several offices and departments of the City, and
for the consolidation, alteration or abolition of departments. The
City Council is authorized by Ordinance to assign additional
functions or duties to offices, departments of the City not
inconsistent with the Charter. The City Council thereby finds that
amendments made by this Ordinance to Chapter 2.12, consolidating
departments and reorganizing certain functions and duties of
department heads is not inconsistent with the provisions of the
Charter of the City of Newport Beach.
The City Council of the City of Newport Beach does hereby
ordain as follows:
SECTION 1: Chapter 2.12 of Title 2 of the Newport Beach
Municipal Code is amended to read:

2.12.060 General Services Department.
2.12.070 Community Services Department.
2.12.100 Public Works Department.
2.12.110 Police Department.
SECTION 2.12.010. Departments Designated.
The administrative service of the City is divided into the
following departments:
Building Department

Community Services Department
Administrative Services Department
Fire and Marine Department
General Services Department
Planning Department
Police Department
Public Works Department
SECTION 2.12.020. Authority of City Manager.
All department heads, except the City Attorney and the City Clerk,
shall be subject to the administrative authority and direction of
the City Manager.
SECTION 2.12.030. Planning Department. The Planning
Department shall be under the supervision of the Planning Director.
The term "Community Development Director" as found in Title 20 of
the Newport Beach Municipal Code shall be deemed hereafter to refer
to the Planning Director. The functions of the Planning Department
shall include:
(a) Administration and enforcement of the provisions of this
Code relating to planning, zoning and subdivisions, and advising
and assisting the Planning Commission in such administration vested
in that Commission;
(b) Preparation and presentation of reports to the City
Council and the Planning Commission on various aspects of City
planning;
(c) Preparation and maintenance of the General Plan;
(d) Advising the public on zoning and planning matters;
(e) Receipt and processing subdivision maps.
SECTION 2.12.035. Building Department. The Building
Department shall be under the supervision of the Building Director.
The functions of the Building Department shall include:
(a) Administration and enforcement of the building,
electrical plumbing and mechanical codes, including grading and
swimming pool regulations;
(b) Administration and enforcement of State regulations
governing energy conservation and sound transmission.

SECTION 2.12.040. Administrative Services Department.
The Administrative Services Department shall be under the
supervision of the Administrative Services Director/ Finance
Director, who shall have charge of financial affairs and employee
relations within the City. A. The financial functions of the
• Administrative Services Department, in addition to those duties
imposed by the City Charter, shall include:
(a) Enforcement of the City's business license
regulations.
(b) Purchase of supplies, equipment, training, and
services used by city departments.
(c) Disposal of obsolete and surplus City property.
(d) Provide centralized duplicating services for all
City departments.
(e) Provide centralized City management information
services.
(f) Provide risk management services.
• B. The employee relations functions of the Administrative
Services Department shall include: Establish personnel policies,
employee classification and compensation policies and other
conditions of employment to assist the City Manager in carrying out
the provisions of Chapter 2.28 of this Code.
SECTION 2.12.050. Fire and Marine Department. The Fire and
Marine Department shall be under the supervision of the Fire and
Marine Chief. The terms "Fire Chief" and "Marine Director" as used
in this Code shall be deemed hereafter to refer to the Fire and
Marine Chief. A. The functions of the Fire Department shall
include:
(a) The extinguishment of structural, brush and other
typos of fires.
• (b) The enforcement of laws concerned with fire
prevention.
(c) To abate any hazard or nuisance caused by any
substance that presents a threat to the public because of toxicity,
radioactivity, flammability or other characteristic dangerous to

the public health or environment.
(d) Prevention of, or responding to, accidents of a
marine nature within the City limits of contiguous unincorporated
territory under County contractual agreements.
(e) Enforcement of the provision of this Code as
• directed pertaining to the general public safety, tidelands
administration and beach parking lots within the marine
environment.
(f) Such other functions as may be delegated by the City
Manager or the City Council.
SECTION 2.12.060. General Services Department. The General
Services Department shall be under the supervision of the General
Services Director. The functions of the General Services
Department shall include:
(a) Street and beach cleaning.
(b) Refuse and garbage collection and disposal.
(c) Maintenance and repair of streets, alleys, curbs,
• sidewalks, storm drains, bridges, piers, bulkheads and floats.
(d) Maintenance and repair of City equipment.
(e) Operation of City sign shop and carpenter shop.
(f) Street striping, barricade, curb, crosswalk, parking
stall, and pavement painting.
(g) Street name, and regulation sign posting maintenance.
(h) Custodial maintenance and minor repair services for City -
owned and occupied buildings and facilities.
(i) Landscaping and maintenance of City parks, parkway trees,
and planted areas on City -owned property, easements and rights -of-
way.
SECTION 2.12.070. Community Services Department. T h e
Community Services Department shall be under the supervision of the
isCommunity Services Director /City Librarian. The functions of the
Community Services Department shall include:
(a) Advise the Board of Library Trustees.
(b) Advise and liaison to the Parks, Beaches and Recreation
Commission.

(c) Operation and management of the City's libraries,
including selection, organization and dissemination of materials in
all formats -- print, multi - media, electronic publishing.
(d) Planning coordination and direction of community
recreational and cultural activities.
• (e) Operation and control of all parks and recreational
facilities over which the City exercises jurisdiction.
(f) Master planning for the acquisition and development of
park and recreational facilities.
2.12.100 Public Works Department. The Public Works
Department shall be under the supervision of the Public Works
Director who shall also be the City Engineer Pro Tem and the
Superintendent of Streets. The term "Utilities Director" as used
in this Code shall be deemed hereafter to refer to the Public Works
Director. The functions of the Public Works Department shall
include:
(a) Planning, design, preparation of plans, and
• administration of contracts for the construction of public works,
including street, storm drain, sewer, water, harbor, street
lighting, and other public facilities;
(b) Right -of -way acquisition;
(c) Subdivision engineering services;
(d) Traffic engineering services;
(e) Engineering services for other City departments;
(f) Maintenance and operation of City water system;
(g) Maintenance and operation of City sewer system;
(h) Maintenance and operation of City street lighting system
and the maintenance of electrical equipment in City buildings;
(i) Engineering planning for water, sewer and electrical
systems.
• 2.12.110 Police Department. The Police Department shall be
under the supervision of the Police Chief. The Police Department
may have only such sworn, reserve and civilian personnel as the
City Council shall authorize. The functions of the Police
Department shall include:

(a) Prevention, repression, and investigation of crime.
(b)

Apprehension of offenders.
Recovery of property.
Traffic law enforcement and parking control.
Animal control.
Custody of lost, stolen, recovered property.
SECTION 2: That if any section, subsection, sentence, clause
or phrase of this ordinance is, for any reason, held to be invalid
or unconstitutional, such decision shall not affect the validity or
constitutionality of the remaining portions of this ordinance. The
City Council hereby declares that it would have passed this
ordinance, and each section, subsection, clause or phrase hereof,
irrespective
of the fact
that
any
one or
more
sections,
subsections,
sentences,
clauses
and
phrases
be
declared
unconstitutional.
SECTION 3: The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance. The City Clerk shall
cause the same to be published once in the official newspaper
within fifteen (15) days after its adoption.
This Ordinance was introduced at a regular meeting of the City
Council of the City of Newport Beach held on the 27th day of
March , 19 95, and adopted on the 10th day of April
1995, by the following vote, to -wit:
