HomeMy WebLinkAbout95-20 - Amending A Portion of Districting Maps Nos. 34 and 35 to Reclassify All Parcels Located Between Campus Drive, Bristol Street North, Birch Street, and Macarthur Boulevard, From the Current Zone of M -1 -A to APF, to Create Consistency Between the DNO. 95- 20 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING A PORTION OF DISTRICTING MAPS NOS. 34 and 35 TO RECLASSIFY ALL PARCELS LOCATED BETWEEN CAMPUS DRIVE, BRISTOL STREET NORTH, BIRCH STREET, AND MACARTHUR BOULEVARD, • FROM THE CURRENT ZONE OF M -1 -A TO APF, TO CREATE CONSISTENCY BETWEEN THE DISTRICTING MAPS, CHAP- TER 20.33 OF THE ZONING CODE AND THE GENERAL PLAN LAND USE ELEMENT AMENDMENTS APPROVED ON OCTOBER 24, 1988. (PLANNING COMMISSION AMENDMENT NO. 821) WHEREAS, on November 13, 1990, the City Council Adopted Ordinance No. 90 -41 which established the Retail Service Commercial (RSC), Administrative, Professional & Financial(APF), and the Recreational & Marine Commercial (RMC) zoning districts to implement the new land use designations created by the 1988 comprehensive general plan revision; and WHEREAS, when the Administrative, Professional & Financial zoning district was adopted in 1990, references to the district were not referenced on specific lots in Districting Maps No. 34 and 35 in the Zoning Code, and therefore this District was not implemented on those specific lots at • that time; and WHEREAS, Districting Maps Nos. 34 and 35 of the Municipal Code should be amended to add references to the APF (Administrative, Professional & Financial) zoning district thus implementing'this District on specific lots; and WHEREAS, on May 18, 1995, the Planning Commission of the City of Newport Beach held a public hearing regarding Amendment No. 821, and at that time voted to recommend that the City Council approve the amendment; and WHEREAS, the public was duly noticed of the public hearing; The City Council of the City of Newport Beach DOES ORDAIN, as follows: SECTION I. The following real property in the City of Newport Beach , • County of Orange, State of California, Lots 3 -36, Tract 320, and Lots 1 -19, Tract 5169, located between Campus Drive, Bristol Street North, Birch Street, and MacArthur Boulevard, as shown on Districting Maps No. 34 and 35, referred in Section 20.01.050 of the City of Newport Beach Municipal Code, and I is • • by such reference made a part of Title 20 of said Code, is hearby amended to reclassify the Zoning Designation from M -1 -A to APF (Administrative, Professional and Financial Commercial) on all said lots as referenced above. SECTION H. The Planning Director of the City of Newport Beach is hearby instructed and directed to change Districting Maps No. 34 and 35 to show the change in Zoning Designation as described in Section I hereof; and as said Districting Map shall have been so amended, the same shall be in full force and effect and be part of Title 20 of the City of Newport Beach Municipal Code. SECTION IIL This Ordinance shall be published once in the official newspaper of the City, and shall become effective thirty (30) days after the date of adoption. This Ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach , held on the 12th day of June 1995, and adopted on the 26th day of June , 1995, by the following vote, to wit: AYES, COUNCIL MEMBERS HEDGES.
