AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, AMENDING
SECTIONS 15.50.070 AND 15.50.220 (C) OF
CHAPTER 15.50 OF THE NEWPORT BEACH MUNICIPAL
. CODE RELATING TO ESTABLISHMENT OF AREAS OF
SPECIAL FLOOD HAZARD, AND STANDARDS OF
CONSTRUCTION.
SECTION 1: The City Council of the City of Newport Beach does
hereby ordain that Section 15.50.070 of Chapter 15.50 the Newport
Beach Municipal Code is amended to read as follows:
15.050.070 Basis for Establishing the Areas of Special Flood
Hazard. The areas of special flood hazard identified by the
Federal Insurance Administration of the Federal Emergency
Management Agency in the "Flood Insurance Study Orange County and
Incorporated Areas," dated February 1992, with an accompanying
Flood Insurance Rate Map and flood boundary and floodway maps dated
February 1992, and all subsequent revisions, are hereby adopted by
reference and declared to be a part of this Chapter. This Flood
Insurance Study is on file at 3300 Newport Boulevard, Newport
Beach, California (92659- 1768) . This Flood Insurance Study is the
minimum area of applicability of this Chapter and may be
supplemented by studies for other areas which allow implementation
of this Chapter and which are recommended to the City Council by
the Floodplain Administrator. Notwithstanding the building pad
elevations established by the Flood Insurance Rate Maps, the
minimum required first floor elevations for the interior living
areas of all new structures shall be at least 6.27 Mean Sea Level
consistent with the Public Works Department standard for bulkhead
..dw� elevation.
,"NOW SECTION 2: The City Council of the City of Newport Beach does
hereby ordain that Chapter 15.050.220 of the Newport Beach
Municipal Code is amended to read as follows:
15.50.220 Standards of Construction: In all areas of special
flood hazards the following standards are required:

A. Anchoring.
1. All new construction and substantial improvement shall be
adequately anchored to prevent flotation, collapse or lateral
movement of the structure resulting from hydrodynamic and
hydrostatic loads, including the effects of buoyancy.
• B. Construction materials and methods. All new construction
and substantial improvements shall be constructed
1. with materials and utility equipment resistant to flood
damage;
2. using methods and practices that minimize flood damage;
3. with electrical, heating, ventilation, plumbing and air
conditioning equipment and other service facilities that are
designed and/or located so as to prevent water from entering or
accumulating within the components during conditions of flooding;
and if
4. with Zones AH or AO, so that there are adequate drainage
paths around structures on slopes to guide flood waters around and
• away from proposed structures.
C. Elevation and floodproofing. (See Section 15.50.050 for
definitions of "new construction," "substantial damage" and
"substantial improvement. ")
1. Residential construction: Residential construction, new
or substantial improvement, shall have the lowest floor, including
basement,
a. in an AO zone, elevated above the highest adjacent grade
to a height equal to or exceeding the depth number specified in
feet on the FIRM, or elevated at least two feet above the highest
grade if no depth number is specified.
b. in an AO zone, elevated to or above the base flood
elevation, as determined by the City of Newport Beach.
C. in all other zones, elevated to or above the base flood

All new construction and substantial improvements with fully
enclosed areas below the lowest floor (excluding basements) that
are usable solely for parking of vehicles, building access or

storage, and which are subject to flooding, shall be designed to
automatically equalize hydrostatic flood forces on exterior walls
by allowing for the entry and exit of floodwater. Designs for
meeting this requirement must exceed the following minimum
criteria:
• a. be certified by a registered professional engineer or
architect to comply with a local f loodproof ing standard approved by
the Federal Insurance Administration, Federal Emergency management
Agency, or
b. have a minimum of two openings having a total net area of
not less than one square inch for every square foot of enclosed
area subject to flooding. The bottom of all openings shall be no
higher than one foot above grade. Openings may be equipped with
screens, louvers, valves or other coverings or devices provided
that they permit the automatic entry and exit of floodwater.
Upon completion of the structure, the elevation of the lowest
floor including basement shall be certified by a registered
• professional engineer or surveyor, and verified by the community
building inspector to be properly elevated. Such certification or
verification shall be provided to the Floodplain Administrator.
2. Nonresidential construction: Nonresidential construction
shall either be elevated to conform with section C.1 or together
with attendant utility and sanitary facilities
a. be floodproofed below the elevation recommended under
Section C.1 so that the structure is watertight with walls
substantially impermeable to the passage of water;
b. have structural components capable of resisting
hydrostatic and hydrodynamic loads and effects of buoyancy; and
C. be certified by a registered professional engineer or
architect that the standards of this section are satisfied. Such

certification shall be submitted to the Floodplain Administrator.

3. Manufactured homes.
a. Manufactured homes that are placed or substantially
improved, within Zones Al -30, AH, an AE on the community's Flood
Insurance Rate Map, on sites located

(i) outside of a manufactured home park or subdivision
(ii) in a new manufactured home park or subdivision,
(iii) in an expansion to an existing manufactured home park or
subdivision on a site upon which a manufactured home has incurred
"substantial damage" as the result of a flood, shall be elevated to
or above the base flood elevation and be securely anchored to an
adequately anchored foundation system to resist flotation, collapse
and lateral movement.
b. All manufactured homes that are placed or substantially
improved on sites located within Zones VI -30, V, and VE on the
community's Flood Insurance Rate map will meet the requirements of
paragraph 3a and Section 15.50.250.
C. All manufactured homes to be placed or substantially
improved on sites in an existing manufactured home park or
subdivision within Zones Al -30, AH, AE, VI -30, V, and VE on the
community's Flood Insurance Rate Map that are not subject to the
provisions of paragraph 3a will be elevated so that either the
• (i) lowest floor of the manufactured home is at or above the
base flood elevation, or
(ii) manufactured home chassis is supported by reinforced
piers or other foundation elements of at least equivalent strength
that are not less than 36 inches in height above grade and be
securely anchored to an adequately anchored foundation to resist
flotation, collapse and lateral movement.
4. Recreational Vehicles.
a. All recreational vehicles placed on sites within Zones
Al -30, AH and AE on the community's Flood Insurance Rate Map will
either:
(i) be on the site for fewer than 180 consecutive days,
(ii) be fully licensed and ready for highway use - a
recreational vehicle is ready for highway use if it is on its
wheels or jacking system, is attached to the site only by quick
disconnect type utilities and security devises, and has no
permanently attached additions, or
(iii) meet the permit requirements of Section 15.50.130 of

this Chapter.
b. Recreation vehicles placed on sites within Zones V1 -30, V,
and VE on the community's Flood Insurance Rate Map shall meet the
requirements of paragraph 4(a) and Section 15.50.250.
SECTION 3: That if any section, subsection, sentence,
• clause or phrase of this ordinance is for any reason, held to be
invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this
ordinance. The City Council hereby declares that it would have
passed this ordinance, and each section, subsection, clause or
phrase hereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses and phrases be declared
unconstitutional.
SECTION 4: The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The City Clerk shall
cause the same to be published once in the official newspaper of
the City, and it shall be effective thirty (30) days after its
• adoption.
SECTION 5: This ordinance was introduced at a regular
meeting of the City Council of the City of Newport Beach, held on
the 14th day of August , 1995, and adopted on the 28th day of
August 1995, by the following vote, to wit:
