AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AMENDING TITLE 20 OF THE MUNICIPAL
CODE SO AS TO LIMIT AUTOMOBILE REPAIR USES IN THE
MARINER'S MILE SPECIFIC AREA PLAN DISTRICT TO
THOSE WHICH ARE ANCILLARY TO AUTOMOBILE SALES
USES
WHEREAS, WHEREAS, the Land Use Element of the General Plan and the Mariner's Mile Specific Area
Plan state that the purpose of the Retail and Service Commercial designation is to provide for
uses that are predominately retail in character; and
WHEREAS, automotive repair uses operating independent of retail automotive sales
uses would be inconsistent with stated purpose of the Retail and Service Commercial land use
designation and the Mariner's Mile Specific Area Plan; and
WHEREAS, the Mariner's Mile Specific Area Plan Retail and Service Commercial District
needs to be amended to limit automobile repair uses to those which are ancillary to automobile sales
uses; and
WHEREAS, Chapters 20.60 and 20.84 of the Municipal Code set forth the amendment
process as the method of changing the land use regulations of a specific area plan; and
WHEREAS, pursuant to Section 20.84.30, the Planning Commission has held duly noticed
public hearings on August 24, 1995 and September 7, 1995, and has recommended approval of
Amendment 830 to the City Council; and
•WHEREAS, pursuant to the California Environmental Quality Act, it has been determined
that the proposed amendment is categorically exempt under Class 5, minor alterations in land use
limitations.
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1: Section 20.62.050 B -1 of Title 20 of the Newport Beach Municipal Code is
hereby amended to read as follows:
B. USES REQUIRING USE PERMIT. The following uses shall be permitted upon the
granting of a use permit by the Planning Commission:
1. Manufacturing of marine products, boat construction, animal hospitals,
automobile sales, automobile repair when ancillary to an existing automobile
sales use within the specific plan area, gasoline service stations, cleaning
establishments, laundries, launderettes, outdoor markets, restaurants, outdoor
restaurants, drive -in and take -out restaurants, drive -in facilities, outdoor sales
establishments, pet shops, public garages, theaters, commercial recreation,
hotels and motels, used car sales lots, nail salons, wedding chapels, health
• club /aerobics studio, dance studios, music /art schools, private instructional
facilities, arcades, day care facilities, social/service clubs, churches, museums,
marine related museums, federal post offices and other uses which, in the
opinion of the Planning Commission are of a similar nature.
SECTION 2. The Mayor shall sign and the City Clerk shall attest to the passage of this
Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the same
shall become effective thirty (30) days after the date of its adoption.
This Ordinance was introduced at a regular meeting of the City Council of the City of
Newport Beach held on September 25, 1995, and adopted on the 9th day of October, 1995, by the
following vote, to wit:
