AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH
AMENDING A PORTION OF DISTRICTING
MAP NO. 31 ESTABLISHING A FRONT YARD
SETBACK OF 33 FEET FROM THE NEWLY ESTABLISHED
FRONT PROPERTY LINE ON LOT NO. 27, HAMPDEN ROAD,
AS WELL AS AN EASTERLY SIDE YARD SETBACK OF 15 FEET.
(PLANNING COMIbIISSION AMENDMENT NO. 838)
isWHEREAS, Section 20.84.010 of the Municipal Code of the City of Newport Beach
provides that Title 20 (the Zoning Code) may be amended by changing provisions whenever the public
necessity and convenience and the public welfare require such amendment; and
WHEREAS, the Planning Commission has determined that the subject amendment is
exempt from the requirements of the California Environmental Quality Act under Class 5 (Mmor
Alterations in Land Use Limitations); and
WHEREAS, the City Council, on August 14, 1995, adopted a resolution to vacate and
abandon portions of the Hampden Road right -of -way immediately adjoining the subject property; and

WHEREAS, the Modifications Committee, on September 12, 1995, approved
Resubdivision No. 1010, which allowed the consolidation of the subject parcel, vacated right -of -way
and a portion of an adjoining parcel into one parcel of land; and
WHEREAS, on Jan. 2 2nd, 1996, the City Council of the City of Newport Beach
held a duly noticed public hearing regarding this ordinance;
NOW THEREFORE, the City Council of the City of Newport Beach does hereby ordain as
follows:
SECTION 1. The following described real property in the City of Newport Beach,
• County of Orange, State of California, more particularly described as,
Parcel No. 1 of Parcel Map No. 94 -215, located at 4717 Hampden Road, at the
easterly terminus of Hampden Road,
as shown on Districting Map No. 31, referred to in Section 20.01.050 of the Newport Beach
Municipal Code and by such reference make part of Title 20 of said Code, is hereby amended so

as to establish a front yard setback of 33 feet on Lot. 27, Hampden Road, as well as an easterly
side yard setback of 15 feet.
SECTION 2. The Planning Director of the City of Newport Beach is hereby
instructed and directed to change Districting Map No. 31 referred to in Section 20.01.050 of the
Newport Beach Municipal Code and by such reference made part of Title 20, to reflect the changes
described in Section 1 above, and when said Districting Map has been so amended, the smae shall be in
full force and effect and be part of Title 20 of the Newport Beach Municipal Code.
SECTION 3. The Mayor shall sign and the City Council shall attest to the passage of
this Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the
same shall become effective thirty (30) days after the date of its adoption.
SECTION 4. This Ordinance was introduced at a regular meeting of the City Council
of the City of Newport Beach held on the 8th day of Jan., 1996, and was adopted on the 22ndday
of January , 1996, by the following vote, to wit:
