Hamilton ISSUE: Should the City initiate a General Plan Amendment to increase entitlement in Statistical Area L1 to facilitate the expansion of the existing Newport Sports Museum? RECOMMENDATION: Staff recommends that the proposed General Plan Amendment Initiation be passed to the City Council with a favorable recommendation. DISCUSSION: The applicant desires to expand the existing Newport Sports Museum, located at 100 Newport Center Drive, into an adjacent suite currently occupied by an exercise club and enclose an existing 950 square foot patio. The subject property has a General Plan Land Use designation of Administrative, Professional, Financial and is located within the APF Zoning District. Furthermore, the site is located within General Plan Statistical Area L1 (Block 100 — Gateway Plaza), which has an entitlement of 197,545 square feet. Since all the permitted entitlement has been built, a General Plan Amendment is required to accommodate the proposed patio enclosure. An exact square footage figure would be determined and presented at public hearings before the Planning Commission and City Council should the proposed initiation be acceptable to the City Council. If ultimately approved, the proposed amendment of approximately 950 square feet will not exceed the square footage, peak hour trip or dwelling unit thresholds established by Charter Section 423 and Council Policy A -18 due to the size and proposed use of the area. Therefore, voter approval will not be required. Newport Sports Museum April 8, 2004 Page 2 Environmental Review: A request to initiate a General Plan Amendment is considered a feasibility or planning study by staff, which is statutorily exempt pursuant to Section 15262 of the Implementing Guidelines for the California Environmental Quality Act. It is anticipated that the project, if initiated, will be categorically exempt from CEQA review. Public Notice: Notice is not required for a request to initiate a General Plan Amendment. Should the request be approved by the City Council, the follow -up application will require noticed public hearings at the Planning Commission and City Council. I am the owner of that property which, as you know, currently houses the offices of Hamilton Company, Newport Sports Museum, and Body Design, a women's exercise dub. The purpose of my request is to implement plans to expand the Museum into space currently occupied by Body Design and enclose an existing pebio, consisting of approximately 950 square feet. The enclosed patio will, if the amendment is approved, be used solely by Museum guests and invitees as an area in which athletes can demonstrate their skill and ability lo, and communicate with, the children and young adults served by the Museum, all of which is dons at no charge.
