RECOMMENDATION: Review Capital Improvement Program and recommend that the City Council find it consistent with City policy documents. INTRODUCTION: The Engineering Services Division of the Public Works Department is responsible for planning and completing the City's Capital Improvement Program (CIP). The CIP serves as a plan for the provision of public improvements, special projects, and on- going maintenance programs. Section 707 (c) of the Charter of the City of Newport Beach and Section 65401 of the California Government Code states that it is the duty of the Planning Commission to make recommendations to the City Council concerning proposed public works projects. Therefore, it is necessary for the Planning Commission to review the Fiscal Year 2003- 2004 CIP in terms of its consistency with the City's planning policies. ANALYSIS: The Fiscal Year 2003 -2004 CIP lists over one hundred projects. The majority of these projects involve repairs and improvements to existing facilities and are therefore not directly applicable to planning policies. Such projects will not be analyzed unless they present an apparent inconsistency with the General Plan, Zoning Code, or other planning policy documents. Projects involving new construction or the expansion or removal of existing improvements will be analyzed in terms of their consistency or inconsistency with General Plan, Zoning Code, and other planning policy documents. Zoning Code Chapter 98 Newport and Balboa Merger (Mixmaster) 20.43 (Cannery Village/McFadden Square Documents provide for improvements to the "Mix Specific Plan) /Balboa Master Peninsula Planning Study Capital Improvement Program May 22, 2003 Page 3 of 4 The Cannery Village /McFadden Square, Central Balboa, and Old Newport Boulevard specific plans each contain a public improvement component. The public improvement components identify and prioritize public and private improvement projects in each specific plan. While it is recognized that these improvements are contingent on the City's ability to fund its share of each project, in many cases, these improvements have not been implemented within the time frames identified in the specific plan, and are not included in the proposed Fiscal Year 2003 -2004 CIP. The projects outlined above have been found to be consistent with the City's policy documents in terms of providing proper direction for the City's future development. Submitted by: SHARON Z.
