SUBJECT: Emerson Tract — General Plan Amendment and Code Amendment
Initiation (PA 2003 -149)
ISSUE:
Should the Planning Commission recommend that the City Council initiate amendments
to the General Plan and the Zoning Code relating to the annexation of the Emerson
Tract?
RECOMMENDATION:
Adopt Resolution No. 2003- recommending initiation of a General Plan
amendment (GPI 2003 -005) to the City Council and initiating code amendment (CA
2003 -007).
DISCUSSION:
The Emerson Tract is not currently within the Newport Beach sphere of influence and
consequently not addressed in the General Plan. In order to proceed with the
annexation process, a General Plan amendment is necessary. Land use types,
residential densities, and development intensities will be proposed based on existing
land uses and land use policies of the County of Orange. City Council Policy K -1 states
that amendments to the General Plan shall be initiated by the City Council after
recommendation by the Planning Commission.
Any future annexation of the Emerson Tract will require that this area be prezoned. The
California Government Code allows a city to prezone territory for the purpose of
determining the zoning that will apply to such territory after annexation to the city. The
prezoning becomes effective after the territory is annexed.

RESOLUTION NO.
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF NEWPORT BEACH RECOMMENDING THE INITIATION
OF AN AMENDMENT TO THE GENERAL PLAN TO THE CITY
COUNCIL AND INITIATING A CODE AMENDMENT RELATING
TO THE ANNEXATION OF THE EMERSON TRACT [GPI 2003-
005]
THE PLANNING COMMISSION OF THE CITY OF NEWPORT BEACH HEREBY FINDS,
RESOLVES AND ORDERS AS FOLLOWS:
Section 1. Amendments to the General Plan and Zoning Code are necessary to establish
land use and development policies and regulations for the Emerson Tract area.
Section 2. City Council Policy K -1 establishes that amendments to the General Plan
shall be initiated by the City Council after recommendation from the Planning Commission.
Section 3. Title 20 of the Newport Beach Municipal Code authorizes the Planning
Commission to adopt a resolution initiating amendments to the Zoning Code of the City of
Newport Beach.
Section 4. The Planning Commission hereby recommends the initiation of a General
Plan amendment (GPI 2003 -005) to the City Council and initiates an amendment to Title 20 of
the Newport Beach Municipal Code to establish land use and development policies and
regulations for the Emerson Tract area.
PASSED, APPROVED AND ADOPTED THIS 17TH DAY OF JULY 2003.
