In addition, the new use will include some minor ancillary on -site wine tasting. The site is located on the lower level of the Atrium Court in Fashion Island, and had been previously occupied by Bristol Farms, a specialty food market that also sold beer, wine and distilled spirits. The amount of retail space in the new facility devoted to the We of alcohol is expanding by more than 25 %. Therefore, in accordance with the City's Alcohol Beverage Outlets Ordinance (Chapter 20.89 of the Zoning Code), a Use Permit must be processed. Site Overview The project site is located on the lower level of the Atrium Court in Fashion Island, 401 Newport Center Drive, Suite #A100. The retail space has interior access to the lower level of the Atrium Court and has no exterior access. Proiect Overview The applicant is proposing to open a retail facility specializing in the sale of fine wines, beers, spirits, food items and other related retail items such as glassware and bar- related items. The new use is similar to the previous use m that Bristol Farms also sold alcoholic beverages; however, Bristol Farms placed its emphasis on food sales and alcohol sales was secondary. The new user will occupy approximately 9,900 square feet of floor area (Bristol Farms occupied approximately 15,000 square feet). Of the floor area proposed to be used by Beverages and More!, 8,050 square feet is for retail sales, 1,262 for stock and storage, and the balance 591 square feet is for office, restrooms and employee areas. Included within the new use will be a small area (approximately 11 square feet) for on -site wine tasting. The wine tasting is proposed to be a minor ancillary use, primarily for "wine education" and will be used on occasion (usually on Saturdays) to sample small quantities of beer and wine (the tasting of hard spirits is prohibited), usually in conjunction with a special promotion. In order to comply with California Department of Alcoholic Beverage Control (ABC) requirements, a fee is charged for the wine tasting. Ana sis The applicant is requesting a new off -sale Type 21 alcoholic beverage license to permit the sales of beer, wine and spirits. In addition, a Type 42, On -sale General license is requested in order to permit the on -site wine tasting. The previously- existing Bristol Farms had a Type 21 off -site beer and wine license. The expansion of the license to include hard spirits and the on -site wine tasting are deemed an expansion of the alcoholic sales. In accordance with Section 20.89.030A. La. of the Alcoholic Beverage Outlets (ABO) Ordinance, a new Use Permit is required if "The alcoholic beverage outlet changes its type of retail liquor license with the Department of Alcoholic Beverage Control " Therefore, this staff analysis is required in conjunction with the findings and requirements of the ABO. Beverages & More! (PA2002 -006) March 21, 2002 Page 3 of 7 General Plan The City's General Plan designates the site as Retail and Service Commercial. The applicant's request is consistent with this designation in that retail sale of alcoholic beverages and food items are permitted uses within the Retail and Service Commercial designation. Parking Parking for the proposed facility is within the existing parking facilities for Fashion Island. While an expansion in the alcohol license is requested, the use classification remains unchanged and parking demand is not anticipated to increase over that of previous retail users of the site. Hours of Operation The hours of operation are proposed to be from 10:00am to 9:00pm, Monday through Friday; 9:O0am to 9:00pm on Saturdays; and 10:00am to 7:O0pm on Sundays. The hours will be expanded to 10:00am to 10:00pm, seven days a week during the Christmas holiday season (mid - November to January 1). The use of the wine tasting area is proposed to be available during the normal operating hours, however, as noted above, the use is ancillary to the main use and is anticipated to be used only on very limited occasions, usually on Saturdays and in conjunction with a special promotion. The hours of operation of the previously- existing Bristol Farms was 10:00am to 10:00pm seven days a week. These hours are similar to those of Fashion Island generally, and the Police Department is not opposed to the proposed new operating hours. Alcoholic Beverage Outlets Ordinance On June 8, 1998, the City Council adopted the Alcoholic Beverage Outlets (ABO) Ordinance (Chapter 20.89 of the Municipal Code). The purpose of the ordinance is to preserve a healthy environment for residents and businesses by establishing a set of consistent standards for the safe operation of alcoholic beverage retail outlets, while preventing alcohol- related problems. The ABO requires a Use Permit for new alcoholic beverage outlets and revisions to existing alcoholic beverage licenses. In addition, the ABO requires the Planning Commission to consider the following: 1. Whether the use serves public convenience or necessity. 2. The crime rate in the reporting district and adjacent reporting districts as compared to other areas in the City. 3. The number of alcohol licenses per capita in the reporting district and in adjacent reporting districts as compared to the county -wide average. 4. The numbers of alcohol - related calls for service, crimes or arrests in the reporting district and in adjacent reporting districts. 5. The proximity of the alcoholic beverage outlet to residential districts, day care centers, park and recreation facilities, places of religious assembly, and schools. Beverages & More! (PA2002 -006) March 21, 2002 Page 4 of 7 In accordance with the foregoing, and in order to provide the Planning Commission with the necessary data and analysis to make the required findings, each of the foregoing is discussed as follows: 1. Public Convenience or Necessity. Current City Council policy is applicable to bars, cocktail lounges cabarets and nightclubs. The retail sale of alcoholic beverages for off -site consumption, especially in conjunction with the sale of other food and retail items, can be argued as promoting public convenience or necessity. As noted above, on -site consumption is proposed as part of this application in the form of wine tasting. However, the use is minor in nature, limited to only rare occasions, usually in conjunction with a special promotion. The overall use characteristic of the proposed new use is a retail distribution of wine, beer, spirits and limited related food and retail items such as gourmet food, barware and glassware. The proposed new user is located in an area previously used by a similar retail user and has been intended for that type of use in the original building design. 2. Crime Rate. Citywide, there were 6,742 crimes reported citywide during calendar year 2000, of which 2,349 were Part One Crimes (serious offenses). The remaining 4,393 were Part Two Crimes that include alcohol related arrests. The project site, located within the Atrium Court of Fashion Island, is located within Police Reporting District No. 39. During 2000, the number of Part One Crimes in RD No.39 were 338 and the number of Part Two Crimes were 284. Adjacent Reporting Districts are Nos. 37 and 41. RD No. 37 had 37 Part One and 44 Part Two Crimes; and RD No. 41 had 74 Part One and 85 Part Two Crimes. While the number of total crimes reporting is higher within the RD of the subject project site as compared to surrounding RD's, the Police Department noted that the actual amount of crimes in the area is not considered significant due to the high concentration of commercial uses within RD No. 39. 3. Over Concentration. Due to the request for the on -site consumption (i.e., for the wine tasting), there is a net increase of one license within RD No. 39. There are a total of 40 active ABC licenses within RD No. 39. An analysis undertaken in 2000 in conjunction with the Use Permit for the Bristol Farms market located in the same space as the proposed Beverages & More! indicated that the census tract had a higher ratio of liquor licenses when compared with the average ratio for Orange County. However, as noted in that analysis, the area includes Fashion Island that has a high number of eating and drinking establishments. Those licenses are, for the most part, for on -site consumption. Even though on -site wine tasting is proposed as an ancillary use, the use is very minor, and a very large portion of the proposed business will result in alcoholic sales that will be consumed in a home setting. Therefore, it is not anticipated that the use, including the on -site wine tasting, is likely to contribute to alcohol- related problems or to be considered an over concentration of alcoholic use within the area. 4. Alcohol Related Crimes. There were 30 driving under the influence arrests and 43 plain drunk arrests within RD No. 39 in 2000. The number of alcohol related arrests within RD No. 39 is 11.7% of all arrests made. City-wide, alcohol related arrests are 24.6% of total arrests. The 73 total alcohol related arrests within RD No. 39 amounts to 4.55% of the DUI/Drunk arrests made in the entire City (there were 1,657 alcohol related arrests made City- wide). Therefore, the alcohol related arrests within the area of the proposed use is considerably below the city -wide Beverages & More! QA2002 -006) March 21, 2002 Page 5 of 7 rate. As noted in the section on Crime Rate above, the greatest bulk of the sales in the proposed Beverages & More! are intended for off - premise consumption and, therefore, are not likely to contribute to alcohol related problems within the area. The on -site consumption is associated with wine tasting, and will not operate as a bar. This fact also supports the finding that no increase in alcohol- rclated crime is anticipated 5. Adjacent Uses. The site is located within Fashion Island and is not adjacent to sensitive land uses. There are no residences, day care centers, schools, or park and recreation facilities in the vicinity of the project site. The project site will occupy space previously occupied by an off - premise alcohol retailer. Even though the new retailer proposes to expand the area for alcohol sales, the alcoholic beverages are intended for off -site consumption and it is not anticipated that the additional license is rely to result in alcohol related problems. The on -site wine tasting is minor in nature, restricted to a small area and will entail consumption of very small amounts of alcohol. Nevertheless, a condition has been included in the draft Resohution requiring that the wine tasting remain a small ancillary use only. In accordance with the ABO Ordinance, the Police Department has reviewed the Use Permit application and feels that no additional conditions related to design and security are necessary. Environmental Review This project has been reviewed, and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act under Class I (Minor alteration of existing structures). While the proposal involves a conversion of tbe Alcoholic Beverage license to inchule the addition of off -sale liquor and on -site wine tasting, the changes are not significant over what existed previously and involve alterations contained entirely within the interior of the existing building. Conclusion Staff believes that the findings for approval of the Use Permit can be made. The site is conducive to the retail sales of alcoholic beverages and other related retail items, and has historically been used for essentially the same type of use. The site is served by ample parking and the proposed new use does not change the use in a manner to increase parking demand. In addition, staff believes that the required findings of the ABO can be met. The Commission has the option to approve the request as proposed. Should the Commission wish to do this, Resolution No. 2002 - has been prepared for adoption and is included as Exhibit No. 2. The Commission could approve a modified project. (21 Off -Sale and 42 On -Sale Beer & Wine, Public Premises. The 42 license is used for educational wine tasting.) Beverages & morel is a specialty retailer selling beer, wine, spirits, gourmet food and related items, such as glassware, accessories, etc., which are not easily found elsewhere. We offer over 3000 brands of premium wines, 1000 different gourmet food items, 600 brands of specialty beers and 1200 brands of specialty spirits. Beverages & more! will employ local residents and will contribute significant tax revenues to the City of Newport Beach. Beverages & more! currently operates 23 stores in California. The Newport Beach location will be our 26th store. We opened our newest store in Orange, CA on December 1 s'. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NEWPORT BEACH APPROVING USE PERMIT NO. 2002 -001 (PA2002 -006) FOR PROPERTY LOCATED AT 401 NEWPORT CENTER DRIVE, #AI00 THE PLANNING COMMISSION OF THE CITY OF NEWPORT BEACH HEREBY FINDS, RESOLVES AND ORDERS AS FOLLOWS: Section 1. An application was filed by Beverages & More, Inc., with respect to property located at 401 Newport Center Drive, #A100 and legally described as Parcel 2 of PM 221 -30, requesting approval of Use Permit No. 2002 -001 to open a retail alcohol sales establishment with on -site wine tasting, within the Atrium Court portion of Fashion Island. Section 2. A public hearing was held on March 21, 2002 in the City Hall Council Chambers, 3300 Newport Boulevard, Newport Beach, California. A notice of time, place and purpose of the aforesaid meeting was given in accordance with the Municipal Code. Evidence, both written and oral, was presented to and considered by the Planning Commission at this meeting. Section 3. The Planning Commission finds as follows: The proposed location of the alcoholic retail sales establishment needing this use permit, and the proposed conditions under which it would be operated or maintained, is consistent with the General Plan and the purpose of the district in which the site is located; will not be detrimental to the public health, safety, peace, morals, comfort, or welfare of persons residing or working in or adjacent to the neighborhood of such use; and will not be detrimental to the properties or improvements in the vicinity or to the general welfare of the city. The use permit pertains to an alcoholic retail sales with ancillary on -site wine tasting establishment to be opened in a building that is designated and zoned for this activity. The use has been conditioned in such a manner to minimize the impacts associated with sale of alcoholic beverages. The plans, as conditioned, meet the design and development standards for alcoholic sales. The applicant does not propose a use that would change the operational characteristics of the site and could result in additional parking demand. 2. The operational characteristics of the proposed use, including the hours of operation, are consistent with Municipal Code requirements. Any change in the operational characteristics, including a change in the lours of operation, would require an amendment to the Use Permit, reviewed by the Planning Commission. 3. The proposed project is consistent with the purpose and intent of Chapter 20.89 of the Municipal Code (Alcoholic Beverage Outlets Ordinance) for the following reasons: a. The convenience of the public can be served by the sale of desired beverages in a retail market setting. 16 City of Newport Beach Planning Commission Resolution No. _ Paee 2 of 4 b. The crime rate in the police reporting district and adjacent reporting districts is not likely to increase as a result of the proposed use. C. The number of alcohol licenses within the report districts and adjacent reporting districts is not significantly high given the nature of the land uses in the district and when compared with County -wide data d. The percentage of alcohol- related arrests in the police reporting district in which the project is proposed is lower than the percentage citywide. Retail sales and minor on -site consump- tion (wine tasting) is not expected to increase alcoholic related crime. e. There are no residences, day care centers, schools, or park and recreation facilities in the vicinity of the ofthe project site. 4. The project has been reviewed, and it qualifies for a categorical exemption pursuant to the California Environmental Quality Act under Class 1 (Minor alteration of existing structures). Section 4. Based on the aforementioned findings, the Planning Commission hereby approves Use Permit No. 2002 -001, subject to the Conditions set forth in Exhibit "A." Section 5. This action shall become final and effective fourteen days after the adoption of this Resolution unless within such time an appeal is filed with the City Clerk or this action is called for review by the City Council in accordance with the provisions of Title 20, Planning and Zoning, of the Newport Beach Municipal Code. Use Permit No. 2002 -001 shall expire unless exercised within 24 months from the date of approval as specified in Section 20.91.050 of the Newport Beach Municipal Code, unless an extension is otherwise granted. 3. The applicant is required to obtain all applicable permits from the City Building and Fire Departments. The construction plans must comply with the most recent, City - adopted version of the Uniform Building Code. The construction plans must meet all applicable State Disabilities Access requirements. Adequate access and exiting must be approved by the Building Department, and approval from the Orange County Health Department is required prior to permit issuance. 4. The wine tasting area shall have adequate barriers as required by the California State Department of Alcoholic Beverage Control. Wine tasting shall be limited to beer and wine only; the tasting of hard spirits is prohibited. In addition, the wine tasting area shall not exceed eleven (11) square feet in area, and total gross receipts related to the wine tasting operation shall at no time exceed ten (10) percent of the total gross receipts for the business. 5. Hours of operation shall be from 10:00 AM to 9:00 PM, Monday through Friday; from 9:00 AM to 9:00 PM, on Saturdays; and from 10:00 AM to 7:00 PM on Sundays. With the exception that the hours may be extended to 10:00 AM to 10:00 PM seven days a week from November 15 to January 1 each year. 6. All owners, managers and employees selling alcoholic beverages shall undergo and successfully complete a certified training program in responsible methods and skills for selling alcoholic beverages. The certified program must meet the standards of the California Coordinating Council on Responsible Beverage Service or other certifying/licensing body which the State may designate. The establishment shall comply with the requirements of this condition within 180 days of the issuance of the certificate of occupancy. Records of each owner's, manager's and employee's successful completion of the required certified training program shall be maintained on the premises and shall be presented upon request by a representative of the City of Newport Beach. 7. That any change in operational characteristics, hours of operation, expansion in area, including expansion of the wine tasting area or operation characteristics, or other modification to the floor plan, shall require amendment to this Use Permit or the processing of a new Use Permit. a. Should this business be sold or otherwise come under different ownership or a change in operators, any future owners, operators, or tenants shall be notified of the conditions of this approval by either the current business owner, property owner or the leasing agent. NEWPORT BEACH POLICE DEPARTMENT February 21, 2002 TO: Todd Weber, Planner FROM: Inv. Tom Voth SUBJECT: Beverages & More Inc. At your request, our office has reviewed the project review plan for the Beverages and More Project located at 401 Newport Center Dr., Suite A101, Newport Beach. The location is approximately 10,000 sq. ft. and is located on the first floor of the Atrium Court in Fashion Island. Location History: In the past the location was operated as the Farmer's Market, which had an On -Sale Beer and Wine- Eating establishment license. According to Fashion Island management, the Farmer's Market area will be divided between Beverages & more and the Atrium Court Deli. The Atrium Court Deli will attempt to retain that existing Type 41 A.B.C. License. According to Beverages & more Company Sr. Vice President Steve McLaren, he and his partners would like to open a specialty beverage store designed for convenience at the location. They intend to offer domestic and import wines, beers and spirits in addition to cigars and party items. Their plan is to have an 11 sq. foot area (approximate) separated by a wall within the store for occasional wine and beer tasting. A.B.C. Investigator Zaidi told me that the wine tasting area would be restricted to adults with signs posted to that effect. This is a concept that the company employs to educate its customers. This idea has been used in all 23 of their store locations over their eight -year company history. Mr McLaren has applied for a Type 21 (Off -Sale General) and Type 42 (On Sale -Beer and Wine- Public Premise) Licenses with the California Department of Alcoholic Beverage Control. The forecasted date for opening is July, 2002 and the proposed name of the business is "Beverages & more!" For Police services information refer to the attached report by Crime Analyst Paul Salenko. Siens: Mr. McLaren told me that their signs have been configured to comply with the Fashion Island (The Irvine Co.) Sign Program. Hours of Operation: Mr. McLaren said that the intended hours of operation are on Sunday 10 a.m. to 7 p.m., Monday through Friday 10 a.m. to 9 p.m. and during the last six weeks of the year 10 a.m. to 10 p.m. Preventive Desi¢n: It should be noted that this company has a policy of not selling single beers or half -pint size bottles of hard liquor to discourage the element that "hangs out and drinks from a paper bag." Mr. McLaren also said that his employees are instructed to dissuade under - aged customers from loitering in the area of their stores and they use an electronic identification verification system. Security: Mr. McLaren stated that they would rely on the 24 -hour security, provided through the lease by Fashion Island Security. Additionally, Fashion Island Management told me that, when possible, a security officer would be posted at the location during the hours that this store is open but the mall is closed. The Police Department has no objection to the operation as described by Mr. McLaren. Once the city has approved a use permit, our department will condition the ABC license as necessary to maintain the health, safety and welfare of the community. Inv. Weber, Staff Planner FROM: Paul Salenko, Crime Analyst SUBJECT: Alcohol Related Statistics At your request, our office has reviewed police services data for Beverages & More at 401 Newport Center Drive #A100. This area encompasses our reporting district (RD) number 39 as well as part of Census Tract 630.08. This report reflects City of Newport Beach data for calendar year 2000, which is the most current data available. Calls for Service Information The calls for police services during this time are unavailable. A "call for service" is, any contact of the police department by a citizen which results in the dispatching of a unit or causes the contacted employee to take some sort of action, such as criminal investigations, alarm responses, traffic accidents, parking problems, and animal control calls, etc. Crime Information There were 6,742 crimes reported to the Newport Beach Police Department during this period. Of this total, 2,349 were Part One Crimes. Part One crimes are the eight most serious crimes (Homicide, forcible Rape, Robbery, Aggravated Assault, Burglary, Larceny - theft, Auto Theft and Arson) as defined by the FBI in the Uniform Crime Reports. The remaining 4,393 were Part Two crimes. The Part One crime rate for the entire city during this same period was 3,105.29 per 100,000 people. The national Part One crime rate was 4,124.0 per 100,000 people.
