RESOLUTION OF INTENTION NO. 9
A RESOLUTION OF INTENT'IONFof the Board of Trustees
of the City of Newport Beach declaring its in-
tention to improve a portion of Bay Avenue in said
City of Newport Beach, by requiring the same to be
graded and capped between the north line of Ocean
Avenue and the west line of 24th Street so that the
said portion of said Bay Avenue shall conform to
the official grade established therefor.

The Board of Trustees of the City of Newport Beach does
hereby resolve and declare as follows:-
That the public interest and conveniA e require and that
it is the intention of the Board of Trustees of said City to im-
prove a portion of Bay Avenue and to order the following street
work done) to -wit : -
SECTION 1:- Resolved, that that portion of Bay Avenue in
the City of Newport Beach, lying between the north line of Ocean
Avenue and the west line of 24th Street in said City (except such
portions thereof as is required by law to be kept in order and
repair by any persons or company having railroad tracks thereon)
to be graded so that Bay Avenue, between said north line of Ocean
Avenue and said west line of 24th Street) shall conform to the
official grade of said Bay Avenue as established by Section (4)
Four of Ordinance Number (30) Thirty of the City of Newport Beach)
and capped according to the following specifications: - The said
Bay.Avenue, between the north line of Ocean Avenue and the west
line of 24th Street in said City) shall be filled with sand or
earth to a sub -grade six (6) inches below the official grade as
fixed by Section (4) Four of Ordinance Number (30) Thirty of the
City of Newport Beach. The surface of such sub -grade shall con-
form to the Sectional Plan Number (1) One, furnished by the En-
gineer of said City, adopted by the Board of Trustees and filed
with the City Clerk) on top of such sub -grade there shall be
placed a cap composed of gravel and clay of sufficient thickness
when th'oirougay settled and packed to bring the surface of the
road -way to the official grade. Which road -way) when completed,
shall conform in out -line to Plan Number (1) One above referred

to and leveled and thto' roughly and evenly packed.

SECTION 2: The Clerk of the City of Newport Beach is
hereby directed to post this Resolution conspiciously� for two
days) on or near the chamber door of the Council Chamber of the
Board of Trustees of said City and to publish the same by tow (2)
insertions in the Newport News) a weekly newspaper, published and
circulated in the City of Newport Beach which Newport News is
hereby designated by the Board of Trustees for that purpose.
SECTION 3:- Resolved that the Street Superintendent
shall thereupon cause to be conspiciously posted along the line of
said contemplated street works at not more than one hundred feet
in distance appart but not less than three inall, notices of the
passage of this Resolution. Said notice shall be headed "Notice
of Street Work" in letters of not less than one inch in length and
shall, in legible characters, state the fact of the passage of
this Resolution, its date and briefly the work proposed and shall
refer to this Resolution for further particulars and whereas
there is no daily newspaper published and circulated in the City
of Newport Beach, he shall cause a notice similiar in substance
to be published by one insertion in the Newport News, a weekly
newspaper, published and circulated in the City of Newport Beach,
which Newport News is hereby designated for that purpose.
The above and foregoing Resolution passed and adopted by
the Board of Trustees of the City of Newport Beach) this 25th day
of May, A. D. 1908) by the following vote, to -wit:-
AYES: C. A. Barton, J. Ferguson, J. McMillan, A. N. Smith.
NOES: None ABSENT: F. W. Beckwith
The foregoing Resolution of Intention is approved this 25th
day of May, A. D. 1908.
