COPY RESOLUTION NO. 23 COPY
A resolution of the Board of Trustees of the City of New-
port Beach, ordering certain work done or improvement made,
namely. that a portion of a public street in the City of Newport
Beach be closed up, vacated and abandoned.
WHEREAS, the Board of Trustees of the City of Newport
Beach did, on�he 4th day of March, 1912, pass and adopt a resolu-
tion declaring its intention to order certain work done or improv
ment made and in the said resolution of intention described the
work or improvement and the land deemed necessary to be taken
therefor, and did further specify the exterior boundaries of the
district of lands to be affected or benefited by said work or im-
provement and to be assessed to pay the damages, cost and expense
thereof by showing in said resolution that no assessment would be
necessary for the paying of any cost, damages or expenses, and
Whereas, the Street Superintendent of the City of Newport
Beach did thereuron, to -wit: upon the 8th day of March, 1912,
cause to be and there was conspicuously posted along the line of

the described and contemplated work or improvement, at not more
than 300 ft. in distance apart and not less than three in all,
notices of the passage of said resolution; the said notices were
headed: "Notice of public work ", -in letters not less than one
inch in length and the said notices did in legible characters
state the fact of the passage of said resolution, together with
its date and did briefly describe the work or improvement to be
made and did further refer to said resolution for further particu

Whereas, the said street superintendent did cause and
there was published a notice similar in substance in the "Newport
News ", a weekly newspaper published and circulated in the City of
Newport Beach, which newspaper was, by said resolution, desig-
nated for that purpose, said publication of said notice being by
four successive insertions in said "Newport News" on the follow-
ing dates�o -wit: March 9th - 16th - 23rd -30th- and April 6th- 1912.

And Whereas, more than ten -days have elapsed since the expiration
of the time of publication of said notice, and no person or per-
sons have filed, presented or made any objections to the said
work or improvement or to the extent of the district of lands to
be affected or benefited by said work or improvement;
Now, therefore, the Board of Trustees of the City of I�ew-
port Beach do resolve and declare as follows:
Resolved: that the public interest and convenience re-
quire that the work or improvement described in the said resolu-
tion of intention of the said Board of Trustees be done and made.
Resolved: That said work -or improvement is for closing
up, vacating and abandoning a portion of a public street in the
City of Newport Beach and that it appears that no assessment is
necessary therefor.
Resolved: that a portion of Bay Avenue a public street
in the City of Newport Beach being the work or improvement de-
scribed in said resolution of intention, the same being that por-
tion of Bay Avenue lying and being between and intersected by
Washington & Main Sts., also public streets in the City of New-
port Beach, be and the same is hereby closed, vacated and aban =J
doned.
The above and foregoing resolution was passed and adopted
and approved by the President of the Board of Trustees at a
regular meeting thereof held on the 22nd day of April, 1912, by
the affirmative vote of the following named trustees, to -wit:
AYES: Albert Hermes, S. L. Collins, W. K. Parkinson, R. J. Stauss
C. H. Way.

the records of the City of Newport Beach filed and main-
tained in my office, the foregoing Resolution No. 23
was duly and regularly adopted, passed, and approved by
the City Council of the City of Newport Beach, California,
at a regular meeting of said City Council held at the
regular meeting place thereof, on the 22 day of
April 9 1912 9 by the following vote,
