A resolution of the Board of Trustees of the City of New-
port Beach ordering certain portions of Bay Avenue in the City of
Newport Beach vacated, abandoned and closed, pursuant to Resolu-
tion No. twenty -two (22) of said Board of Trustees
The Board of Trustees of the City of Newport Beach do
resolve and declare as follows:
Resolved that the public interest and also the public con-
venience require that a certain portion of Bay Avenue, a public
street in the City of Newport Beach be-vacated, abandoned and
closed.
Be it further resolved: That,
Whereas, the Board of Trustees of the City of Newport
Beach did, on the l+th day of March, 1912, by the affirmative vote
of at least three Trustees of said Board, to -wit: bythe affirma-
tive vote of four of said Trustees, pass and adopt and there was
on said day approved by the president of said Board of Trustees
a resolution of Intention to vacate, abandon_add close up a cer-
tain portion of Bay Avenue, a public street of the City of New-
port Beach, which resolution of intention described the work to
be done, or improvement made, the land deemed necessary to be
taken therefor, and specified the exterior boundaries of the dis-
trict of land to be affected or benefited by said work and improv
ment, and to be assessed to pay the damages, costs and expenses
thereof;
Be it further resolved that, Whereas, the street super-
intendent of the City of Newport Beach, pursuant to said resdu-
tion of intention did, upon the passage, adoption and approval
thereof, cause to be and there was conspicuously posted along the
line of said contemplated work or improvement of not more than
three hundred feet in distance apart, and not less than three in
all, notices of the passage of said resolution of intention; the
said notices were headed: "Notice of Public Work ", in letters of
not less than one inch in length and in legible characters, stat

the fact of the passage of said resolution, its date and briefly
the work or improvement proposed and did further refer to the
said resolution of intention for further particulars, and
Whereas, the said Street Superintendent did also cause a
notice similar in substance, to be published for the period of
four successive insertions in a weekly newspaper published and
circulated in the City of Newport Beach; and
Whereas, the time prescribed by law during which objections
shall be made, has expired, and no one having presented, filed or
made said objections, the Board of Trustees do hereby resolve
that the said Board of Trustees has acquired jurisdiction to or
said work to be done or improvement made, and
Be it further resolved: That the work to be done or im-
provement made consists in the vacation, abandonment and closing
up of a part of a certain street in the City of Newport Beach,
it appearing that no assessment is necessary therefor, and for
that reason no commissioners are appointed.
Now, therefore, be it ordered; that all that portion of
Avenue, a public street in the City of Newport Beach, which lies
between the intersection of said Bay Avenue by Washington and
Main Streets in said city, be and the same is hereby vacated,
abandoned and closed up; And shall cease to be a public street
in said city.
The above and foregoing resolution ordering work to be
done and improvement made was passed, adopted and approved this
3rd day of March, 1913, by the affirmative vote of at least
trustees of the City of Newport Beach, to -wit:
Ayes: Albert Hermes, S. L. Collins, W. K. Parkinson, R. J. Stauss,
C. H. Way
Noes: None
Absent: None
The foregoing resolution No. 28 is approved by me this 3rd
day of March, 1913.

was duly and regularly adopted, passed, and approved by
the Citr Council of the City of Newport Beach, California,
at a regular meeting of said City Council held at the
regular meeting place thereof, on the 3rd day of
