RESOLVED, THAT, ',MEREIS, the
City of Nevmort Beach, on the 18th
its Resolution of Intention No. 40

to ordor the hereinafter
described work to be done and improvements to be made in said
city, which Resolution of Intention was duly and legally
published as required by law , as appears from the affidavit
of Vlalter Cornelius now on file in the office of the Clerk of
the City of Newport Beach; and
WHER M, notice of the passage of said Resolution of
Intention No. 40 headed "Notices of Improvement" were duly
and legally posted along the lino of said contemplated work
and improvement and in front of all the property liable to
..be assess €d therefor, in form and manner as required by law,
immediately after the passage of said Resolution of Intention,
as appears from the affidavit of�.- F. Barker, Street Super-
intendent of the City of Newport Beach, who, upon the completion
Of the posting of said notices, forthwith filed his affidavit
in the office of the clerk of the City of Nevvport Beach, mak-
ing oath that he completed the posting of said notices on the
21st day of I;iay, 1914; and
VdI'KRE'AS, more than fifteen days has expired since the
day of the second publication of the said Resolution of Inten-
tion No. 40, and the completion of the posting of said "Notices
of Improvement ";
THEREFORE, BE IT Rl>>SOLVL +D that the public interest and
60 convenience require the work hereinafter described to be done
and the Board of Trustees of the City of Newport Beach do here-
by order the following work to be done or iiprovements to be
made in the City of Iveo,rport Beach, to wit:

(a) That all of that portion of Thirty -first
Street in the City of ilewport Beach which extends in
a Northeasterly, direction from the. Northerly line of Ocean
Avenue to the Southerly line of the right of Wayy of tee
Southern Pacific Company be brought to a Sub grade six
(6) inches below,the official grade thereof, and then
capped with a crown of earth six (6} inches thick, roll-
ed and tamped to a true, even surface, conforming to
the said •rade; and that there be constructed upon and
along bot)i sides of said ortion of `Thirty -first Street
a cement sidewalk five and one -half (5 1 /P3) feet in
width and immediately on the outside or street side of
said sidewalk there be reserved a strip of land two ( °;)
feet in width for the planting; of trees rnd shrubs,
which strip of land shall be bordered on the outside,
or street-side, with a cement curb six (6) inches thick,
(b) That all of that portion of Thirty- second
Street which extends in a Northeasterly direction from
the Northerly line of Ocean Avenue to the Southerly
.line of the right of wav of the Pacific electric Rail-
road Companv; and also all that additional portion of
said Thirty- second Street Maich extends in a Northeaster-
ly direction from the Northerly line of the right of way
o. the Southern Pacific CoYupanv to the Rive Alto, all
in the City of Newport Beach, be 15rought to a subgrade
six (6) inches below the official grade thereof, and
then called with a crown of earth six J6) inches thick,
rolled and tamped to a true, even surface, conforming
to the said rade; and that there_be.,constructed upon
and along both sides of said portions of Thirty- second
Street a cement sidewalk four and one -half. (4 1/2) feet
in width, and immediately upon the outside, or street
side of said sidewalk, there be constructed a ce:.ent
curb bordering and adjoining said cement sidewalk, six
(6) inches thick,
(c) That all of that oortion of Thirty -third
Street in the Citv of Nel.rrport B(.ach which extends in
a Northeasterly $ irection from the Northerly line of
Ocean Avenue t6 the Suhtherly line of the right of i,,av
of the j'acifie Electric R;;ilr.oad Company; also all
that additional )ortion of Thirty -third Street which
extends in a Northeasterly direction fi-om the Northerly
line of the right of way of the Southern Pacific Company
to the Rive Alto, be brought to a subgrade six (6)
inches below the official ad thereof, and then cap,ed
with a crown of earth six 6) inches think, rolled and
tanned to a true, even Sur ace, conforming to the said
grade; and that a cement sidewalk be constructed upon
and along both sides of said portions of Thirty -third
Street four and one -half (4.1%2) in width, and immediately
on the outisde, or street side, of said cement sidewalk,
there shall be constructed a cement curb bordering and
adjoining said cement sidewalk six (6) - inches thick,
(d) All that portion of Thirty- fourth Street
which extends in a idortheasterl- direction from the
Northerly line of Ocean Avenue to the Southerly line of
the right of way of the Pacific Electric Railroad Com-
pany; and also all that portion of said Thirty - fourth

Pacific Coanv to the Rive alto in tie City of Newport
Beach, be graded to a subgrade six (6) inches below the

official grade thereof ,and then capped with a crown
of earth six inches (b thick, rolled and tamped to a
true, even surface con- orming to the said grade; and that
upon and along both sides of said portions of Tilirty-
fourth Street there be constructed a cement sidewalk
four and one -half (4 1/2) feet in width and immediately
on the outside, or street side, of said cement sidewalk
there be constructed a cement c rb bordering and adjoin-
ing said cement sidewalk six (6) inches thick.
(e) All that portion of Thirty -fifth Street which
extends in a Northeasterlv direction from the Uo-rtherly
line of Ocean Avenue to tte Southerly line of the right
of way of pacific Electric Railroad Company; and also
all that additional pportion of said Thirty -fifth Street
which.extends in a i'Jortheasterly direction from the
Northerly line of the right of wav of the Southern
Pacific ompany to tine Rivo Alto in the City of Newport
Leach, be graded to a subgrade six (6) inches below the
official grade thereof, and then capped with a crown of
earth six (6) inches thick, rolled and tamped to a true,
even suface conforming to the said grade, and that upon
and along both sides of said portion of Thirty -fifth
Street t1lore be constructed a cement sidewalk four and
one -half (4 1/2) feet in width, and immediately on the
outside,or street side,of said cement sidcwalk' there
shall be constructed a cement curb bordering and adjoin-
ing said cement side-,,, `talk six (6) inches thick.
Section 2. -Ri'SOLVED, that tho construction of all
cement sidewalks and cement curbs mentioned in this resolution
shall be according tu the specifications adopted and provid-
edfor in Subdivisions "A", "B ", "C ", of Section 3 of Ordinance
I, ?o. 24, as follows:
The foundation squall be filled and tamped solid
to such height as vinen surfaced by the sidewalk shall
conform to the grade mentioned and provided for in
Section 3 of this Resolution.
The cement surface of the sidewalk shall consist
of a foundation layer two and one -half (2 1/2) thchas
thick of concrete com:osed of seven (7) parts of fine
clean gravel to one part best Portland Cement, and then
finished with a laver composed in equal parts of best
Portland Cement and clean, sharp sand, one -half (1/2)
inch thick, floated and troweled to a true, oven surface,
slooin toward the street in the ratio of 3 /16th of
an inch fall to each foot in width of the sidewalk.
The curb shall consist of a core ten (10) inches
thick at the bottom, six (6) inches thick at the top,
and fifteen (15) inches deep set with the batter toward
the street, and the tor) when finished, in line with
the slopi surface of `the sidewalk. Such top, =nd
the uf;7er 'len (10) inches of the batter, or street face,
to be dressed onerhalf (1/2) inch thick v-ith the same
finish as above provided for the surface of the sidewalk.

Whenever any portion of the streets mentioned
upon which work is to be done or im�roveraents made
shall be intersected by a street or alley, then the
sidewalk to be constructed across such intersecting
street or allev shall be considered cross -wPlk and
shall be reduced or increased in width so that the
cross -walk or walks.r-.cross the intersecting streets
or alleys shall be four (4) feet in width, nd the curb
shall not be c-rried across said intersecting street
or allev, but on either side of said intersecting street
or alley the curb'shall be returned from the street
line; to the outer edge of the.cross -walk k on a curve, the
radius of which curve shall be five (5) feet, and the
cross -walk shall he sloped or tapered by an apron from
the surface of the cross -walk to the surface of the
street.
Sedtion 3. RI'SOLVI'D that the grades of all those
portions of the streets ,mentioned in this Resolution shall
be based upon a datum plane bench mark, which 'oench mark is
at the Southeast corner of the building of tho State Bank
of Newport, the elevation of which bench mark is 11.55 feet
above loin water in the Pacific Ocean, which grades are as
follows:

RESOLVED, That there is hereby excepted from the operation
of this resolution the grading and taping and construction of
sidewalk and curbs upon any portion of the described portions
of the streets mentioned where said streets, or jortions there-
of, have already been graded and taped, and sidewalks and curbs
constructed thereon to the official grade according to the
specifications hereinbefor•e in this resolution mentioned.
The clerk of the City of Newport is hereby directed to
p ost' a not ice of said work, together with the plans and
specifications therefor, conspicuously for five days on or
near the council chamber door inviting sealed proposals or
bids for doing the cork herein ordered. he is also directed to
publish a notice inviting such proposals and referring to the

specifications posted or on file, in the Ilewport News, a weekly
newspaper printed, i:ublished and cirdulated in the City of Jew-
port Beach, and said Newport News is hereby designated for
that purpose.
The above and foregoing resolution, No. %�, irr,s passed

Beach at a regular meeting thereof held on the 6th day of July,
