1 A Resolution of the City of Newport Beach, a municipal
corporation of the sixth class incorporated under the laws of the
2 State of California, by the legislative branch of said city,
fbeing the Board of Trustees thereof7 determining and declaring
3 that the public interest and also the public necessity demands
the acquisition and construction of a municipal improvement in
4 the city of Newport Beach, to -wit: a gas distributing system,
which shall consist of and include all gas pipe and conduits,
5 both main and lateral, all gas pipe fittings and connections,
and gas meters for registering and determining the quantity of
6 gas used and consumed, and all tither apparatus and appliances
necessary and proper for receiving gas at a source of supply in
7 the City of Newport Beach and to transmit and distribute the
same to the inhabitants, public buildings and places thereof for
8 the purpose of light and heat, in order to carry out the objects,
purposes and powers of the City of Newport Beach.

The cost of which municipal improvement will be too great
10 to be paid out of the ordinary annual income and revenue of the
City of Newport Beach.

The Board of Trustees of the City of Newport Beach, a
12
municipal corporation of the sixth class incorporated under the
13
laws of the State of California, as the legislative branch of
14
said municipal corporation, does resolve, determine and declare
15
as follows:

Section 1: Resolved, that it is hereby determined and
17
declared by the Board of Trustees of the City of Newport Beach,
18
as the legislative branch of said municipality, that the public
19
interest and also the public necessity of the City of Newport
20
Beach, and of the inhabitants thereof demands the acquisition and
21
construction of a municipal improvement in the City of Newport
22
Beach, to -wit: a gas distributing system, which shall consist of
23
24 and include all gas pipe and conduits, both main and lateral, all
25
gas pipe fittings and connections, and all gas meters for reg-
istering and determining the quantity of gas used and consumed,

27 ii and all other apparatus and appliances necedsary and proper for
receiving gas at a source of supply in the City of Newport Beach

and to transmit and distribute the same to the inhabitants, public
29
30 buildings and places thereof for the purposes of light and heat,
311 the said municipal improvement being necessary and convenient to
321 carry out the objects, purposes and powers of the City of Newport
Beach.

Section 2: Resolved, that it is hereby determined and de-
clared that the estimated cost of the acquisition and construct
of said municipal improvement, to -wit: said gas distributing
system, is and will be the sum of $3C7000.00.
Section 3: Resolved, that the objects and purposes of the
acquisition and construction of said municipal improvement, to
wit: said gas distributing system, is to receive gas at a source
of supply in the City of Newport Beach, transmit and distribute
said gas to the inhabitants of the said City of Newport Beach, a
to the public buildings and places thereof, and to register and de
termine the quantity of gas used and consumed in order that the
City of Newport Beach, and the inhabitants thereof, may receive
and have a constant, adequate, and sufficient supply of gas for
the purposes:; of light and heat.
Section 4: Resolved, that the acquisition and construction
of said municipal improvement, to -wit: said gas distributing sys-
tem, is necessary and convenient to carry out the objects, pur-
poses and powers of the City of Newport Beach, and that the cost
thereof, will be too great to be paid out of the ordinary annual

income and revenue of the City of Newport Beach.
Section 5: Resolved, that in order that the City of New-
port Beach pay the cost of the acquisition and construction of
said municipal improvement, to -wit: said gas distributing system,
the Board of Trustees of the City of Newport Beach, asthe legis-
lative branch thereof, determines and declares that the public
interest and also the public necessity demands that the bonds of
the City of Newport Beach be issued and sold in the sum of $3018000
which sum is the estimated cost thereof, in order to raise money
with which to acquire and construct the said municipal improvement
And for that purpose the Board of Trustees of the City of
Newport Beach shall, at a subsequent meeting of said Board of
Trustees, order the submission of the proposition of incurring a

bonded debt in the sum of $30,000 to pay the cost of the acquisi
and construction of said municipal improvement, to -wit: said gas
distributing system, to the qualified voters of the City of New-
port reach at an election held for that purpose.
Section 6: Resolved, that all proceedings of the City of
Newport Beach in the acquisition and construction of said muni-
cipal improvement, to -wit: said gas distributing system, are and
shall be under and in accordance with an act of the Legislature o
the State of California, entitled: "An Act authorizing the incur-
ring of indebtedness by cities, towns, and municipal corporations
for municipal improvements, and regulating the acquisition, con -
struction, or completion thereof." (became a law under constitu-
tional provision without Governor's approval, February 25, 1901.)
And any and all acts that are amendatory thereof.
Section 7: The above and foregoing Resolution No. 47 was
passed by the votes of lore than two- thirds of all the members
of the Board of Trustees of the City of Newport Beach, as the leg
islative branch of said city, at a regular meeting of said Board
of Trustees held on the 8th day of November, 1915, the said Reso-
lution being passed by the affirmative vote of the following
named members of the Board of Trustees;

C. H. Way, G. P. Nilson

I, L. S. Wilkinson, do hereby certify that I am the duly
elected, qualified and acting Clerk of the City of Newport Beach,
that the legislative branch of said city is the Board of Trustees
thereof; that the whole number of the members of said Board of
Trustees if five (5) and that the foregoing Resolution No. 47 was
voted for and passed by the above named members of said Board of

Trustees of the City of Newport Beach at a regular meeting there-
of held on the 8th day of November, 1915, and that the said mem-
bers of said Board of Trustees voting in favor of and passing
said Resolution constitute more than two - thirds of all the mem-
bers of said Board of Trustees.
In Witness Whereof, I have hereunto set my official sig-
nature and the seal of the City of Newport Beach, the 8th day of
November, 1915.
