A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT
BEACH DECLARING ITS INTENTION TO IMPROVE, PORTIONS OF FIRST
STREET SECOND STREET, THIRD STREET, FOURTH STREET, BAY AVENUE,
MONTER6 AVENUE, ANADE AVENUE, ISLAND AVENUE, AND LINDO AVENUE
OF SAID CITY, AND DETERMINING THAT BONDS SHALL BE ISSUED TO
REPRESENT THE COST THEREOF AND DECLARING THE WORK OR IMPROVE=
MENT TO BE OF MORE THAN L06AL OR ORDINARY PUBLIC BENEFIT, AND
THAT THE EXPENSE OF SAID "WORK SHALL BE ASSESSED UPON A DISTRICT.
The Board of Trustees of the City of Newport Beach do
resolve as follows:
SECTION 1: That the public interest and convenience
require, and it is the intention of the Board of Trustees of the
City of Newport Beach, State of California, to order the follow-
ing work to be done in said City, to -wit:
1st: That
FIRST STREET
from the northerly line of Surf Avenue to the southerly line of
Central Avenue; and also that
SECOND. STREET
from the northerly line of Surf Avenue to the southerly line of
Bay Avenue; and also that
THIRD STREET
from the northerly line of Surf Avenue to the southerly line of
Bay Avenue; and also that
FOURTH STREET
from the northerly line of Surf Avenue to the southerly line of
Central Avenue; and also that
BAY AVENUE
from the westerly line of Alvarado Street to the westerly line
of Third Street prolonged northerly across said Bay Avenue; and
also that
MONTERO AVENUE
from the northerly line of Bay Avenue to the southerly line of
Buena Vista Boulevard; and also that
ANADE AVENUE
from the northerly line of Bay Avenue to the southerly line of
Buena Vista Boulevard; and also that
ISLAND AVENUE

from the northerly line of Central Avenue to the southerly line
of Buena Vista Boulevard; and also that
LINDO AVENUE
from the northerly line of Bay Avenue to the southerly line cf
Buena Vista Boulevard; including all street and alley insections,
to be graded and paved to the official grade in accordance with
plans, profiles, and cross - sections numbered 3, 67 77 87 97 117
127 137 147 1001, and in further accordance with special speci-
fications number 25 for the construction of the concrete pave-
ments in the City of Newport Beach, California. Which said
special specifications were adopted as special specifications
for said work by the Board of Trustees for the City of Newport
Beach by Resolution Number 53 of said City.
2nd: That a cement curb be constructed along both lines
of the roadway of First Street from the north line of Surf Avenue
to the southerly line of Central Avenue; and also that a cement
curb be constructed along both lines of the roadway of Second
Street from the northerly line of Surf Avenue to the southerly
line of Bay Avenue; and also along both lines of the roadway
of Third Street from the northerly line of Surf Avenue to the
southerly line of Bay Penue; and also along both lines of the
roadway of Fourth Street from the northerly line of Surf Avenue
to the southerly line of Bay Avenue; and also along the northerly
line of Bay Avenue from the westerly line of Alvarado Street
to a line eight feet westerly from and parallel with the easterly
line of Buena Vista Avenue, prolonged southerly across Bay Avenue,
and along the southerly side of Bay Avenue from the westerly side
of Alvarado Street to a line eight feet westerly from the easterly
line of Fourth Street, prolonged northerly across Bay Avenue; and
also along both lines of the roadway of Montero Avenue, from the
northerly line of Bay Avenue to the southerly line of Buena Vista
Boulevard; and along both lines of the roadway of Anade Avenue

from the northerly line of Bay Avenue to the southerly line of
Buena Vista Boulevard; and also along both lines of the roadway
of Island Avenuefrom the northerly line of Central Avenue to the
southerly line of Buena Vista Boulevard; and also along both
lines of the roadway of Lindo Avenue from the northerly line of
Bay Avenue to the southerly line of Buena Vista Boulevard;
including curb returns at all street and alley inter-
sections and terminations (excepting along such portions of said
roadway upon which a cement curb has already been constructed
and now is to the official line and grade) in accordance with
plans, profiles, and cross - sections numbered 3, 67 77 87 97 117
127 137 147 1001, and in further accordance with specifications
numbered 21 for the construction of cement curbs in the City of
Newport Beach, California. Which said specifications were adopt
as special specifications for said work by the Board of Trustees
for the City of Newport Beach by Resolution Number 53 of said Ci
3rd: That a cement walk five (5) feet in width be
constructed along both lines of the roadway of First Street from
the northerly line of Surf Avenue to the southerly line cf Cen-
tral Avenue; and also that a cement walk five (5) feet in-width
be constructed along both lines of the roadway of Second Street
from the northerly line of Surf Avenue to the southerly line of
Bay Avenue; and also that a cement walk five (5) feet in width be
constructed along both lines of the roadway of Third Street from
the northerly line of Surf Avenue to the southerly line of Bay
Avenue; and also that a cement walk five (5) feet in width be
constructed along both lines of the roadway of Fourth Street from
the northerly line of Surf Avenue to the southerly line of Bay
Ave raze; and also that a cement walk five (5) feet in width be
constructed along the northerly line of Bay Avenue from the west-
erly line of Alvarado Street to a line seven and one -half (7'-z)
feet westerly from and parallel with the easterly line of Buena

Vista Avenue, prolonged southerly across Bay Avenue and along
the southerly line of the roadway of said Bay Avenue from the
westerly line of Alvarado Street to a line seven and one -half
(72) feet westerly from the easterly line of Fourth Street, pro-
longed northerly across Bay Avenue; and also that a cement walk
five (5) feet in width be constructed along both lines of the
roadway of Montero Avenue from the northerly line of Bay Avenue
to the southerly line of Buena Vista Boulevard; and also that a
cement walk five (5) feet in width be constructed along both
lines of the roadway of Anade Avenue from the northerly line of
Bay Avenue to the southerly line of Buena Vista Boulevard; and
also that a cement walk five (5) feet in width be constructed
along both lines of the roadway of Island Avenue from the north-
erly line of Central Avenue to the southerly line of Bay Avenue;
and also that a cement walk five (5) feet in width be constructed
along both lines of Lindo Avenue from the northerly line of Bay
Avenue to the southerly line of Buena Vista Boulevard; (excepting
along such portions of said streets and avenues upon which a
cement sidewalk has already been constructed and now is to the
official line and grade) and that all of said cement sidewalks
shall be constructed in accordance with plans, profiles, and
cross - sections numbered 3, 67 %, 81 97 117 12, 137 147 100, and
in further accordance with specifications numbered 2G for the
construction of cement sidewalks in the City of Newport Beach,
California. Which said.specifications were adopted as special
specifications for said work by the Board of Trustees for the
City of Newport Beach by Resolution Number 53 of said City.
Section 2: That the said contemplated work or improve-
ment, in the opinion of said Board of Trustees of the City of
Newport Beach, is of more than local or ordinary public benefit,
and said Board of Trustees hereby declares that the district in
the said City of Newport Beach benefited by said work or improve-

ments and to be assedsed to pay the costs.and expenses thereof is
described as follows:
All that portion of the City of Newport Beach included
within the following described exterior boundary line, to -wit:
Beginning at the intersection of the northerly line of
Surf Avenue with the westerly line of Alvarado Street, thence
northerly along and pursuing the westerly line of Alvarado Street
to the intersection with the southerly line of Bay Avenue;
thence easterly along the southerly line of Bay Avenue
seven (7) feet to a point thence northerly 557.98 feet on a line
ten (10) feet easterly from and parallel with the westerly line
of Alvarado Street;

Thence along and pursuing the center line of Buena
Vista Avenue S. 43 °3313C" W 44C.62 feet to a point;
Thence along the centre line of Buena Vista Avenue
S. 64 021'30" k 357.94 feet to a point, said point being the in-
tersection of the centre line of Buena Vista Avenue with the
centre line of Bay Avenue;
Thence westerly along and pursuing the center line of
Bay Avenue to its intersection with the easterly line of Fourth
Street prolonged northerly across Bay Avenue;
Thence southwesterly to a point in the southerly line
of Bay Avenue, said point being distant seventy (7C) feet west-
erly from the intersection of the westerly line of Fourth Street
with the southerly line of Bay Avenue;
Thence southerly along and pursuing the easterly lire of
an alley situate seventy (70) feet westerly from and running
parallel with the westerly line of Fourth Street to a point in
the northerly line of Surf Avenue distant seventy (7C)feet west-
erly from the intersection of the northerly line of Surf Avenue
with the westerly line of Fourth Street;
Thence easterly along and pursuing the northerly line
of Surf Avenue to the point of beginning. All as shown on Map
Number 103 approved by the Board of Trustees of the City of New-
port Beach on the 5th day of June, 1916, and on file in the office
of the City Engineer of said City to which said map reference is
hereby made for a more complete and detailed description of said
district.
SECTION %,30 First: The said Board of Trustees find that
the following described piece or parcel of land, included in the
district to be assessed to pay the costs and expenses of the pro-
posed work or improvement, to -wit:

Beginning at a point in the northerly line of Buena
Vista Boulevard said point being distant N. 740 24' W. 29.28 feet
fromthe intersection of the westerly line of Alvarado Street
produced northerly across Buena Vista Boulevard with the north-
erly line of Buena Vista Boulevard.
Thence N. 470 25' W. 320.25 feet to a point;
Thence S. 7C1 5C' W. 7.42 feet to a point;
Thence N. 86. 28' W. 101.23 feet to a point;
Thence N. 586 37' W. 114.87 feet to a point;
Thence N. 350 21' W. 34.10 feet to a point;
Thence N. 240 35' W. 25.88 feet to a point;
Thence S. 600 45' W. 265.72 feet to a point in the nor
erly line of Buena Vista Boulevard;
Thence easterly along and pursuing the northerly line
of Buena Vista Boulevard to place of beginning; and said property
being in said City of Newport Beach, the title to which is vested
in the State of California is all devoted to the public use to-
wit: harbor purposes.
And said Board of Trustees hereby declares and determi
that all of said piece or parcel of land above described shall be
omitted from the assessment to be made to cover the costs and
expenses of said work or improvement.
Second; The said Board of Trustees declares that the
total expenses of all work done shall be assessed on the remain-
ing lots lying within the limits of the -assessment district with-
out regard to the omitted piece or parcel of land.
SECTION 4: The City Engineer is directed to make a dia-
gram of the property affected or benefited by the proposed work
or improvements, as described in the resolution of intention,
and to be assessed to pay the expenses thereof. Such diagram
shall show each separate lot, piece, or parcel of land, the area

in square feet of each of said lots, pieces or parcels of land
-and the relative location of the same to the work proposed to be
done, all within the limits of the assessment district.
SECTION 5: The Board of Trustees of the City of Newport
Beach determines that serial bonds shall be issued to represent
assessments of twenty -five ($25.00) Dollars, or over, for the
cost of said work or improvement; said serial bonds shall extend
over a period ending nine (9) years from and after the second day
of January next succeeding the date of said bonds, and an even
annual proportion of the principal sum thereof shall be payable,
by coupon, on the second day of January every year after their
date until the whole is paid; and the interest shall be payable
semi- annually, by coupon, on the second days of January and July,
respectively, of each year, at the rate of seven (7) per cent per
annum on all sums unpaid, until the whole of said principal and
interest are paid. Said bonds shall be issued in accordance with
the provisions of an act of the legislature of the State of Cali-
fornia, entitled "An Act to provide a system of street improvemen
bonds to represent certain assessments for the cost of street
work and improvement within municipalities, and also for the pay-
ment of such bonds," approved February 27, 1893, and of all acts
supplementary thereto or amendatmry thereof.
SECTION 6: All plans, profiles and cross - sections re-
ferred to in this resolution are on file in the office of the City
Engineer of said City.
All specifications referred to in this resolution are on
file in the office of the City Clerk of said City. Said plans,
profiles, cross - sections and specifications are hereby referred
to for more particular description of said work and made a part
hereof.
All special specifications, plans, profiles, and cross -
sections herein referred to were adopted for said work by Resolu-

tion No: 53 of the Board of Trustees of said City.
SECTION 7: The streets referred to in this resolution
are public streets in the said City of Newport Beach.
SECTION 8: The Newport News, a weekly newspaper of gen-
eral circulation, published and circulated in said City of Newpor
Beach, is hereby designated as the newspaper in which this resolu
tion of intention, and notice of the passage thereof, shall be
published in the manner and by the persons required by law.
SECTION 9: The Superintendent of Streets of said City
of Newport Beach is hereby directed to post notices of the passage
of this resolution of intention in the manner and in the form re-
quired by law, and to cause a similar notice to be published by
one insertion in said newspaper in the manner required by law.
SECTION 10: The City Clerk of the City of Newport
Beach shall certify to the passage of this resolution, and is
hereby directed to post the same conspicuously for two (2) days
on or near the chamber door of said Board of Trustees, and to
cause the same to be published by two (2) insertions in said news-
paper in the manner required by law.
