ON PQRTIONS OF FIRST STREET, SECOND STREET,
THIRD STREET, FOURTH STREET, BAY AVENUE,
MONTERO AVENUE, ANADE AVENUE, ISLAND AVENUE,
AND LINDO AVENUE

A Resolution of the Board of Trustees of the City of
Newport Beach ordering certain work to be done on portions of
First Street, Second Street, Third Street, Fourth Street, Bay
Avenue, Montero Avenue, Anade Avenue, Island Avenue, and Lindo
Avenue, in the City of Newport Beach, and determining that bonds
shall be issued to represent the cost thereof, and declaring the
work or improvement to be of more than local or ordinary-public
benefit, and the expense of said work or improvement shall be
assessed upon a district.
The Board of Trustees of the City of Newport Beach do
resolve as follows:-
SECTION 1. The Board of Trustees of the City of Newport
Beach deems it to be required by the public interest and conven-
ience, and hereby orders: That _ FIRST STREET from the northerly
line of Surf Avenue to the southerly line of Central Avenue; and
also that SECOND STREET from the northerly line of Surf Avenue
to the southerly line of Bay Avenue; and also that THIRD STREET
from the northerly line of Surf Avenue to the southerly line of
Bay Avenue; and also that FOURTH STREET from the northerly line
of Surf Avenue to the southerly line of Central Avenue; and also
that BAY AVENUE from the westerly line of Alvarado Street to the
westerly line of Third Street prolonged northerly across said
Bay Avenue; and also that MONTERO AVENUE from the Northerly line
of Bay Avenue to the southerly line of Buena Vista Boulevard; and
also that ANADE AVENUE from the northerly line of Bay Avenue to
the southerly line of Buena Vista Boulevard; and also that ISLAND
AVENUE from the northerly line of Central Avenue to the southerly
line of Buena Vista Boulevard; and also that LINDO AVENUE from the
northerly line of Bay Avenue to the southerly line of Buena Vista

Boulevard; including all street and alley intersections, shall
be improved by the construction of cement cur b, cement sidewalk,
cement concrete pavement, and all other work or improvement
described in Resolution of Intention No. 54 for said work or im-
provement in the manner and within the limits designated in said
resolution, and reference is hereby made to said resolution for
a further and more complete description of said work or improve-
ment and the description of said work or improvement in said
resolution contained, is hereby expressly adopted and made a part
hereof the same as though fully set forth herein.
SECTION 2. That the said work or improvement, in the
opinion of the Board of Trustees is of more than local or ordinar
public benefit, and said Board of Trustees hereby declares that
the district in said City of Newport Beach benefited by said work
or improvement, and to be assessed to pay the costs and expenses
thereof, is described in said Resolution of Intention No. 54, to
which said Resolution reference is hereby made for a description
of said district.
SECTION 3. That serial bonds shall be issued to rep-
resent assessments of twegty -five ($?5.CO) Dollars, or over, for
the cost of said work or improvement; said serial bonds shall ex-
tend over a period ending nine (9) years from and after the secon
day of January next succeeding the date of said bonds, and an
even annual proportion of the principal sum thereof shall be
payable, by coupon, on the second day of January every year after
their date until tho whole is paid; and the interest shall be
payable semi - annually, by coupon, on the se mn d days of January
and July, respectively, of each year, at the rate of seven (7)
per cent per annum on all sums unpaid, until the whole of said
principal and interest are paid. Said bonds shall be issued in
accordance with the provisions of an act of the legislature of
the State of California, entitled "An Act to provide a system of

street improvement bonds to represent certain assessments for the
cost of street work and improvement within municipalities, and
also for the payment of such bonds," approved February 27, 1893
and of all acts supplementary thereto or amendatory thereof.
SECTION 4. The City Engineer is directed to make a dia-
gram of the property affected or benefited by the proposed work
or improvements, as described in the resolution of intention,
and to be assessed to pay the expenses thereof. Such diagram
shall show each separate lot, piece, or parcel of land, the area
in square feet of each of said lots, pieces or parcels of land
and the relative location of the same to the work proposed to be
done, all within the limits of the assessment district.
SECTION 5. That the proceedings for the aforesaid im-
provement shall be had and taken under an act of the Legislature
of the State of California, entitled, "An Act tD provide for work
upon streets, lanes, alleys, courts, places and sidewalks, and
for the construction of sewers within municipalities," approved
March 18, 1885 (commonly known as the Brooman Act), and under all
acts supplementary thereto or amendatory thereof.
SECTION 6. The City Clerk shall publish notice of said
work or improvement inviting sealed proposals or bids for doing
said work or improvement, and referring to the specifications
posted or on file, for two (2) days in The Newport News; and shall
post said notice, with specifications, conspicuously for five (5)
days on or near the chamber door of the Board of Trustees; and
shall require in said notice a certified check or bond, either,
as prescribed by law, and for an amount not less than ten (1C)
per cent of the aggregate of the proposal.
SECTION 7. The City Clerk shall certify to the passage
of this resolution and shall cause the same to be published for
two (2) days in the Newport News.
